Sharia law divorce in the UAE is governed by Federal Decree-Law No. 41 of 2024 on Personal Status. A marriage can end by talaq from the husband, khula at the wife’s request, or a court divorce for harm or other legal grounds.
Every route must be documented in court. A husband must document a talaq within 15 days (Article 58), and a khula must also be documented within 15 days (Article 68).
This guide explains each route and the rights that follow. For electronic divorce, see is divorce through WhatsApp valid under UAE law.

Revocable and Irrevocable Divorce
Most first and second divorces are revocable (Article 60). During the waiting period, the husband can take his wife back, and this must be documented within 15 days (Article 64).
A third divorce, or a divorce before the marriage was consummated, is irrevocable. Khula is also irrevocable.
The Waiting Period (Iddah)
- Divorced, not pregnant: three menstrual cycles, or three lunar months if she does not menstruate (Article 84).
- Pregnant: until birth or miscarriage (Article 85).
- Widow: four months and ten days (Article 86).
Rights After Divorce
- Maintenance: during the waiting period after a revocable divorce.
- Compensation: if the husband divorces by his sole will without her request or fault, up to one year’s maintenance (Article 102).
- Custody: the mother usually has priority for the children (Article 114).
- Documentation delay: if the husband does not document the talaq on time, the wife can claim compensation equal to maintenance (Article 58(2)).
