Licensed financial institutions must provide consumers with the disclosures and information required under the applicable UAE Central Bank Consumer Protection Standards, including the relevant Key Facts Statement and contractual information before entering into the mortgage or financing agreement. If a bank misrepresented the interest rate structure, the total cost of the loan, the early repayment conditions or any other material term, this can be grounds for a legal claim. We have handled cases where banks applied terms that were not properly disclosed at the signing stage.

A mortgage is issued based on the bank’s valuation of the property. An intentionally or negligently inaccurate property valuation may give rise to legal consequences depending on the circumstances, evidence, the valuer’s duties and whether the legal elements of fraud, misrepresentation, negligence or another cause of action are established. We advise borrowers who discover their property was overvalued at the time of mortgage on their legal options against the valuer and the bank.

In off-plan property purchases, some developers have used mortgage funds provided for the construction escrow for other purposes. This is covered by Dubai Law No. 8 of 2007 on Escrow Accounts for Real Property Development. Misuse of funds held or required to be held in a project escrow account may give rise to regulatory, civil or criminal consequences where the requirements of Dubai Law No. 8 of 2007 and other applicable legislation are satisfied. We represent buyers who have been victims of off-plan financing fraud.

False statements, unauthorized charges or improper conduct in connection with a mortgage application may give rise to regulatory, civil or criminal liability depending on the conduct, evidence and applicable law. Mortgage Agreement Review and Drafting

Before signing a mortgage agreement, obtaining independent legal advice can help the borrower understand the contractual terms, regulatory disclosures and legal consequences of the financing arrangement. Mortgage agreements in Dubai can contain terms that significantly disadvantage the borrower. Early repayment penalties, variable rate clauses, default trigger conditions, and cross-collateralization provisions are all common and all carry risk. We review your agreement, explain every term in plain language, and advise you on what to negotiate before signing.

Mortgage Dispute Resolution

When a dispute arises between a borrower and their lender over payment amounts, interest calculations, insurance obligations, or any other mortgage term, we represent the borrower. Bank Foreclosure Defense

Under Article 25 of Dubai Law No. 14 of 2008, where the statutory conditions for enforcement are satisfied, the creditor-mortgagee may commence foreclosure and forced-sale procedures provided that the debtor or person in possession of the mortgaged property is served with at least 30 days’ notice through the Notary Public.

Mortgage Default and Restructuring Support

Understanding The Law

Property financing in Dubai is governed by a specific legal framework that is different from most other countries. Dubai Law No. 14 of 2008 Concerning Mortgage in the Emirate of Dubai is the primary legislation. This law sets out who can give a mortgage, who can hold one, how it must be registered, and what happens when payments stop. Understanding this law is essential before you sign any mortgage agreement or take any action in a mortgage dispute.

What Makes a Mortgage Valid in Dubai

A mortgage in Dubai must be registered with the Dubai Land Department to be legally valid. A mortgage that is not registered with the DLD is void and cannot be enforced. The lender must be a bank or financial institution licensed by the UAE Central Bank. A private individual or unlicensed company cannot hold a registered mortgage under Dubai law. A mortgage may be created over qualifying real property or real property rights in accordance with Dubai Law No. 14 of 2008. A purchaser of an off-plan property may also mortgage that property where it is registered in the Interim Real Property Register maintained by the DLD, subject to the applicable legal requirements.

Property Financing for Expats in Dubai

Expats can take out a mortgage in Dubai. The UAE Central Bank sets the maximum loan-to-value ratio. For expats buying a property worth up to AED 5 million, the maximum LTV is 80 percent, meaning you must have at least 20 percent as a deposit. For expatriates purchasing a first home or owner-occupied property, the maximum LTV is 80% where the property value is AED 5 million or less and 70% where the property value exceeds AED 5 million, subject to the applicable UAE Central Bank mortgage regulations. For qualifying off-plan mortgage schemes, the applicable maximum LTV is 50%, subject to the UAE Central Bank mortgage regulations and the lender’s eligibility and credit requirements. UAE nationals receive slightly more generous ratios. These ratios apply to first home purchases. Second and subsequent properties have lower maximums.

Alternatives

Negotiate a Payment Plan

Banks in Dubai generally prefer to recover the full debt rather than go through the foreclosure process. Foreclosure proceedings involve statutory notice, execution and auction procedures, and their duration depends on the circumstances of the case, court procedures, any challenges and the auction process. Many borrowers successfully negotiate a formal payment restructuring plan with their bank before the 30-day notice period expires or even after the notice has been issued. We prepare restructuring proposals and negotiate directly with the bank on your behalf.

Challenge the Foreclosure Notice

If the bank has not followed the correct procedure under Dubai Law No. 14 of 2008, the foreclosure notice can be challenged. Article 25 of Dubai Law No. 14 of 2008 requires the relevant debtor or person in possession to be served with at least 30 days’ notice through the Notary Public before foreclosure and forced-sale procedures are commenced.

Voluntary Sale Before Auction

If you are unable to pay and a negotiated restructuring is not possible, A voluntary sale may, depending on market conditions and the lender’s consent, provide an alternative to a forced public auction. The financial outcome depends on the property, market conditions and terms of the proposed sale. A voluntary sale requires the bank’s consent and the mortgage must be discharged through the proceeds. We manage the legal steps for a voluntary sale and make sure all DLD requirements are met correctly.

Challenge the Auction Process

If the property has already been sent to auction,Depending on the circumstances and applicable procedural requirements, a borrower may have grounds to challenge aspects of the execution or auction process or seek appropriate relief from the competent execution judge. For Expats

Expats make up the majority of Dubai’s property buyers. Getting a mortgage in Dubai as a foreign national works differently from your home country. Here is what every expat property buyer and investor needs to know.

Expats can get mortgages in Dubai from UAE-licensed banks and financial institutions. Under Article 4 of Dubai Law No. 14 of 2008, a creditor-mortgagee must be a bank, financing company or institution duly licensed and registered with the UAE Central Bank to provide real property financing in the UAE.
The maximum LTV for expats buying a first property up to AED 5 million is 80 percent. For expatriates purchasing a first home or owner-occupied property valued above AED 5 million, the applicable UAE Central Bank maximum LTV is 70%. For off-plan properties the maximum is 50 percent regardless of nationality.
A mortgage must be registered with the Dubai Land Department to take effect under Dubai Law No. 14 of 2008. The applicable registration fees should be stated by reference to the DLD fee schedule in force at the time of registration. Without DLD registration, the mortgage is void.
A mortgagee cannot acquire or sell the mortgaged property solely by relying on a contractual self-help provision. Enforcement against the mortgaged property must follow the statutory foreclosure and execution procedures. Any separate immigration consequences are governed by the applicable immigration laws and should not be presented as part of the mortgage foreclosure regime. The foreclosure process must go through the Dubai courts. You have legal rights throughout this process.
Islamic finance (Murabaha, Ijara) is widely available in Dubai and is often chosen by expats for religious or financial reasons. The legal structure is different from a conventional mortgage and disputes are handled differently.

What happens if I default on my mortgage in Dubai?

Where there is a default in payment or a contractual condition requiring early repayment is satisfied, Article 25 of Dubai Law No. 14 of 2008 requires at least 30 days’ notice through the Notary Public before the creditor-mortgagee commences foreclosure and forced-sale procedures against the mortgaged property. If you do not pay within those 30 days, the bank applies to the Dubai Execution Court for an order to attach and sell your property at public auction. The duration of foreclosure and auction proceedings varies depending on the execution procedures, service, valuation, auction process and circumstances of the particular case. You have legal rights throughout this process and options to challenge, restructure or sell voluntarily before the auction.

Can a bank foreclose on my property in Dubai?

Yes, but only through a court-supervised process under Dubai Law No. 14 of 2008. A bank cannot take possession of your property or sell it directly. If the debt remains unpaid following the statutory notice period, the creditor-mortgagee may request the execution judge to issue an attachment order against the mortgaged property for sale by public auction in accordance with the applicable DLD procedures. Self-help remedies are void under UAE law. Any clause in a mortgage agreement purporting to give the bank the right to take the property without court proceedings is unenforceable.

How does property financing work for expats in Dubai?

Expats can get mortgages from UAE-licensed banks. The maximum loan-to-value is 80 percent for a first property up to AED 5 million, meaning you need at least a 20 percent deposit. The mortgage must be registered with the Dubai Land Department. The DLD registration fee is 0.25 percent of the loan amount. UAE Central Bank regulations impose consumer-protection, responsible-financing and disclosure requirements on licensed financial institutions, including requirements relating to interest or profit rates, fees and the calculation and disclosure of financing costs.

Can I challenge a bank foreclosure notice in Dubai?

Yes. If the bank did not issue the notice through a UAE Notary Public, the notice is invalid. If the debt amount in the notice is incorrect, it can be challenged. If the bank included unauthorised fees or charges in the demand, these can be contested. We review every foreclosure notice for legal errors before advising on response. An error in the notice gives you extra time and negotiating leverage.

What is the difference between a conventional mortgage and Islamic finance in Dubai?

A conventional mortgage involves the bank lending you money and you paying it back with interest. Islamic finance structures like Murabaha involve the bank buying the property and selling it to you at a higher price. With Ijara, the bank buys the property and leases it to you while you gradually buy it out. Both types must be registered with the DLD. Disputes over Islamic finance agreements are handled differently from conventional mortgage disputes and require specific legal knowledge.

If my property sells at auction for less than my debt, do I still owe the rest?

Under Article 30 of Dubai Law No. 14 of 2008, where the proceeds of sale are insufficient to settle the secured debt, the creditor is entitled to claim the remaining balance from the debtor. This means you can lose the property and still owe money. We advise borrowers specifically on strategies to maximise the auction price and minimise the risk of a shortfall.

Can I sell my property in Dubai if it has a mortgage?

Yes. You can sell a mortgaged property in Dubai but the mortgage must be discharged before or at the time of transfer. In practice, the sale proceeds are used to pay off the outstanding mortgage first and the balance goes to you. Under Article 10 of Dubai Law No. 14 of 2008, a mortgagor may dispose of mortgaged property with the mortgagee’s approval and subject to the statutory requirements concerning transfer of the mortgage obligations. The transaction structure and discharge requirements should therefore be determined in accordance with the lender’s approval and applicable DLD procedures. What is mortgage fraud in Dubai and what can I do about it?

Mortgage fraud in Dubai includes a lender misrepresenting loan terms, a property valuer inflating a valuation to justify a larger mortgage, a developer misusing escrow funds and a broker providing false information to secure a loan approval. Depending on the facts and evidence, conduct involving fraud or misrepresentation in a mortgage transaction may give rise to criminal, civil, regulatory or contractual remedies where the relevant legal requirements are satisfied. Time limits apply so contact us as soon as possible.

Does a mortgage need to be registered with the Dubai Land Department?

Yes. A mortgage in Dubai that is not registered with the Dubai Land Department is void and has no legal effect. Only a DLD-registered mortgage can be enforced through the courts. The registration fee is 0.25 percent of the loan amount. A mortgage application and mortgage contract must comply with the execution and registration requirements prescribed by the DLD under Dubai Law No. 14 of 2008, including any electronic procedures accepted by the DLD.. A mortgage must be registered with the DLD to take effect as a mortgage under Article 7 of Dubai Law No. 14 of 2008. The timing of loan disbursement is also subject to the financing agreement and the lender’s applicable procedures. If a lender did not register the mortgage, you can challenge any enforcement action they attempt.

Can I restructure my Dubai mortgage without going to court?

Yes. Mortgage restructuring is a negotiated process between you and your bank and does not require court proceedings.Mortgage restructuring may be negotiated directly between the borrower and lender without court proceedings where both parties agree. Whether restructuring is available depends on the lender’s assessment, the financing agreement and the borrower’s circumstances.
