In Dubai, property ownership is proven through the title deed registered with the Dubai Land Department. Under Dubai Law No. 7 of 2006, all transactions that create, transfer or cancel property rights must be registered at the DLD to be legally valid. A property without a clean DLD registration is a property with a problem.
Title Issues
Title issues arise when there is something wrong with how the property is registered. This includes errors in the owner’s name or identification details, incorrect property descriptions, missing registration of rights such as mortgages or easements, and incomplete transfers where the seller signed but the DLD registration was never finalised. These problems do not fix themselves. They get worse with time and can block a future sale, mortgage or inheritance transfer.
Ownership Disputes
Ownership disputes arise when two or more parties claim rights to the same property. How the DLD Handles Property Title Disputes in Dubai
The Dubai Land Department is the authority responsible for all property registration in Dubai under Law No. 7 of 2006. When a title or ownership problem involves the DLD record, the resolution path depends on the type of problem.
What the DLD Can Correct Directly
The DLD can correct straightforward registration errors administratively. This includes typographical errors in names or identification numbers, missing registration details that can be supported by clear documentation, and cancellation of outdated mortgage registrations when the bank confirms the debt has been repaid. These corrections require the right supporting documents and sometimes a formal legal application. We prepare all DLD submissions and attend the DLD on your behalf.
When a Court Order Is Required
The DLD cannot make corrections that are disputed by another party. When an ownership claim is contested, when a fraudulent transfer needs to be reversed, when competing claims need a judicial determination, or when encumbrances are disputed, the matter must go to the Dubai Property Court. The court reviews the evidence, determines the correct ownership position, and issues an order that the DLD must then execute. We handle the full court proceedings and the subsequent DLD implementation of the court’s order.
Preventing the Problem from Getting Worse
In urgent ownership disputes, the DLD can place a restriction on a property that prevents it from being sold, mortgaged, or transferred while a dispute is pending.
