How Mediation Is Different from Court

In court, a judge listens to both sides and then makes a decision for them. In mediation, both parties make their own decision together. This means the agreement is more likely to be kept because both people chose it.Personal status proceedings before the Dubai Courts are generally conducted in private in accordance with the applicable court procedures. Mediation sessions are private and confidential. Statements, proposals and information exchanged during mediation are subject to the confidentiality and evidentiary rules prescribed by the applicable legal framework, including any statutory exceptions.

The UAE Legal Framework for Family Mediation

Family mediation in the UAE is supported by law. The Dubai Personal Status Court sends many family cases to the Family Guidance and Reconciliation Centre before they go to a judge. Federal Decree-Law No. 40 of 2023 regulates mediation and conciliation in civil and commercial disputes at the federal level. Family and personal status disputes in Dubai are also subject to the specific personal status and Dubai conciliation framework applicable to those disputes. In Dubai, the conciliation framework was further developed by Law No. 9 of 2025, which amended Law No. 18 of 2021 Regulating Conciliation in the Emirate of Dubai and expressly addressed family disputes and the role of the Family Guidance and Reconciliation Committee.

The Process

Assessment and Preparation

Family Guidance Referral (If Applicable)

Certain family disputes must first be referred for conciliation through the Family Guidance and Reconciliation Committee before proceeding before the competent court. However, the requirement does not apply universally to every personal status claim, and statutory exceptions apply.

Mediation Sessions

Mediation sessions bring both parties together with the mediator. In some situations, parties meet separately first. The mediator guides the conversation, helps each side understand the other's position, and explores options for agreement. Sessions are flexible. Drafting the Settlement Agreement

In Dubai, a qualifying family conciliation agreement may become directly enforceable where it is documented and approved in accordance with the applicable conciliation procedures and the executory formula is affixed to it. Once a qualifying conciliation agreement has acquired executory force in accordance with the applicable legal requirements, a party may seek its enforcement through the competent enforcement procedures.

Is Mediation Mandatory Before a Family Court Case?

Family mediation is not mandatory in Dubai in the traditional sense. However, Family disputes that are subject to mandatory conciliation must be referred to the Family Guidance and Reconciliation Committee before being registered or determined by the competent court, subject to the exceptions prescribed by applicable law. This center uses mediation techniques. Family Guidance and conciliation is a required pre-court procedure for family disputes falling within the mandatory conciliation framework, subject to the statutory exclusions and the nature of the particular claim. But you can also choose private mediation before any court proceedings begin, and many families find this route faster and more effective.

Is a Mediated Agreement Legally Binding?

A qualifying conciliation agreement may acquire executory force where it satisfies the applicable legal requirements, is approved by the competent conciliator and has the executory formula affixed to it. Once the agreement has acquired executory force in accordance with the applicable procedures, it may be enforced through the competent enforcement authorities. The agreement is not just a promise. It is a legal document with teeth.

Is Mediation Confidential?

Mediation and conciliation proceedings are subject to confidentiality requirements under the legal framework applicable to the particular process, subject to any statutory exceptions. Information, statements and proposals exchanged during mediation are subject to the confidentiality and evidentiary restrictions prescribed by the applicable legislation, including any statutory exceptions. Financial information shared, positions taken, and proposals made during mediation are all protected. This is one of the biggest reasons families choose mediation over court.

What Happens If Mediation Does Not Work?

If mediation does not produce an agreement, both parties retain all their rights to go to court. The fact that mediation was attempted does not disadvantage either side in court proceedings.
