Drug possession is the most common drug charge in Dubai. Unauthorized possession of narcotic drugs or psychotropic substances may constitute an offence under Federal Decree-Law No. 30 of 2021, as amended. The applicable offence and penalty depend on factors including the substance, purpose of possession, quantity where legally relevant, circumstances of the conduct and the statutory provision engaged. Many people are stopped at the airport, at a venue, or during a routine police check, often without knowing the substance was illegal in the UAE. If you have been accused of drug possession, do not sign any statement before speaking to a lawyer.

Drug Trafficking and Supply

Conduct involving trafficking, promotion, supply or other unlawful dealing in narcotic drugs or psychotropic substances is subject to specific offences and penalties under Federal Decree-Law No. 30 of 2021, as amended. The applicable offence and sentence depend on the precise conduct, intent, substance and statutory provision established in the case. Evidence relevant to an allegation of trafficking or supply may include the quantity and packaging of the substance, communications, financial records and other evidence capable of establishing the particular prohibited conduct and required criminal intent.

Drug Transporting and Smuggling

Moving drugs into, out of, or through the UAE, including bringing a substance through the airport in transit, is treated as a separate and serious offense. This applies even to travellers who never intended to enter the country and were only passing through on a connecting flight.

Prescription Medication Offenses

Certain painkillers, sleep aids, anxiety medication and ADHD medication that are freely available abroad are controlled in the UAE. Bringing controlled medication into the UAE must comply with the prescription, documentation and any prior-approval requirements applicable to the particular medicine. The competent authority and applicable requirements should be identified under the current UAE medical-products and narcotics regulatory framework.

Drug Use and Positive Blood or Urine Tests

A person can be charged with drug use even without any substance found on them, based on a positive blood, urine or hair test. A positive toxicology result may constitute evidence relevant to an allegation of drug use, but criminal liability must be determined under the territorial and substantive provisions of UAE law and the circumstances in which the substance was consumed. A positive test should not be stated as automatically criminalizing lawful consumption that occurred outside the UAE.

Cultivation and Manufacturing

Growing a controlled plant or producing a narcotic or psychotropic substance, including in small amounts at home, is treated as a serious offense under UAE law, separate from simple possession.

What UAE Drug Law Covers

Federal Decree-Law No. 30 of 2021 on Combating Narcotics and Psychotropic Substances replaced the previous federal narcotics legislation and remains the principal federal drug law, subject to its subsequent amendments, including amendments introduced in 2025. It separates drug use, simple possession and commercial trafficking into different levels of offense, and lets the court look at the type and amount of the substance before deciding the sentence. UAE law provides a voluntary treatment pathway under which an eligible person who voluntarily seeks treatment for drug or psychotropic-substance abuse before an arrest warrant is issued may, subject to the applicable statutory requirements, receive treatment without a criminal case being initiated on that basis.

Punishment under UAE drug law ranges from a fine to life imprisonment, depending on the substance and the charge. UAE narcotics laws strictly regulate possession and use of controlled substances. Travelers should assess any substance or medication against UAE law, as legality in another jurisdiction does not by itself make possession or use lawful in the UAE.
Some common medicines, including certain painkillers, sleep aids and anxiety medication, are controlled or banned in the UAE. Always check before you travel.
Products containing cannabis-derived or other controlled substances must be assessed against the substances, preparations, concentrations and quantities listed in the schedules and regulations applicable under UAE law. Travelers should not assume that a product permitted abroad is lawful to possess or import into the UAE.
Travelers in transit through UAE ports may be subject to UAE narcotics legislation and the specific rules governing non-resident foreigners found with controlled substances at UAE ports, depending on the circumstances, substance and quantity involved.
Under Article 75 of Federal Decree-Law No. 30 of 2021, as amended, deportation is mandatory for a foreign national convicted of an offence under the Decree-Law, subject to the statutory exceptions specified in Article 75.
