Child custody in Dubai is decided based on the best interests of the child. The court looks at the child’s age, the situation of each parent, and which parent can best care for the child day-to-day. The law that applies depends on whether you are Muslim or non-Muslim.

For Muslim couples, the mother has priority in custody following separation, followed by the persons specified under Federal Decree-Law No. 41 of 2024. The court may depart from the statutory order where the best interests of the child are otherwise. Custody does not automatically transfer to the father merely because the child gets older.

The personal status law applicable to a custody dispute depends on the statutory scope of the relevant UAE legislation, including factors such as nationality, religion and any legally permitted choice of law. Non-Muslim expats can also ask the court to apply their home country’s law. Getting this right from the start affects everything about the outcome.

Under the new laws, custody extends to age 18 for both boys and girls. Under Federal Decree-Law No. 41 of 2024 for Muslims, children aged 15 and above can express which parent they want to live with. The court takes this seriously but is not bound by it if another arrangement better serves the child.

Simple custody matters that are part of a mutual divorce can be resolved in a few weeks. Contested custody cases where parents disagree typically take 6 months to 1 year. Complex cases involving international elements or relocation disputes can take longer.

Your Right to See Your Children After Divorce

The parent who does not have day-to-day custody has the legal right to see their children regularly. The court sets a visitation schedule. This usually includes weekly visits and holiday time. If the other parent is blocking your access to your children without good reason, we apply to the court to enforce your rights. This can be done quickly. A parent who refuses to comply with a visitation order faces serious legal consequences.

Taking Your Children Outside the UAE

Under Federal Decree-Law No. 41 of 2024, a custodial parent may travel outside the UAE with the child with the written approval of the other parent or, where applicable, with court authorization subject to the statutory requirements. The applicable rules may differ according to the personal status regime governing the family. If the other parent refuses permission for a trip, you can apply to the court for a travel order. If you are worried your ex might take the children abroad without your permission, we apply for a travel ban immediately. This prevents anyone from taking the children out of the country without court approval.

Guardianship Rights in Dubai

Guardianship is separate from custody. Guardianship and parental decision-making rights depend on the personal status regime applicable to the family. Under the Muslim Personal Status Law, custody and guardianship are legally distinct, while the non-Muslim Civil Personal Status framework provides for joint parental custody and related parental responsibilities. A mother can challenge guardianship rights if the father is not acting in the child’s best interests. We advise both mothers and fathers on their guardianship rights and how to protect them.

What Is Child Custody in Dubai?

Child custody means who the child lives with and who takes care of them day to day. In Dubai, custody is separate from guardianship. The court decides custody based on the best interests of the child. This is the most important principle in every custody case in the UAE.

How Dubai Courts Decide Custody

The court looks at many things when deciding custody. The child’s age matters. Young children are usually better with a primary caregiver who can be with them more often. The mental and physical health of each parent matters. The living situation each parent can provide matters. Whether each parent has been actively involved in the child’s life matters. Whether the parent has a criminal record matters. And for older children, what the child themselves wants is taken into account. The court also considers whether the parent meets the conditions set by UAE law for being a custodian.

Custody and Guardianship Are Not the Same Thing

Custody is about daily care. It means where the child sleeps, eats, and goes to school every day. Guardianship is about the bigger decisions in the child’s life, including education choices, medical decisions, travel permission, and financial management. In Dubai, these two rights can belong to different parents. A mother can have custody while the father has guardianship. Both rights are important, and both can be challenged in court.

How Custody Works for Muslim Couples

Under Federal Decree-Law No. 41 of 2024, which came into force in April 2025, custody for Muslim couples extends to age 18 for both boys and girls. Custody usually starts with the mother for younger children. The court can transfer custody to the father or another relative if it is in the child’s best interest. Children aged 15 and above can express which parent they prefer to live with. Custody and guardianship are separate legal concepts under the UAE Personal Status Law. The applicable guardianship rights and responsibilities must be determined in accordance with the statutory provisions governing guardianship and the circumstances of the case.

How Custody Works for Non-Muslim Couples

Under Federal Decree-Law No. 41 of 2022, non-Muslim couples have joint custody as the starting point. Both parents share in the child’s upbringing, and neither parent has automatic dominance. Either parent can apply to change this if there is a good reason. Custody runs until the child turns 18. Under Federal Decree-Law No. 41 of 2022, both parents have an equal right to joint custody until the child reaches the age of 18, after which the child has freedom of choice.

Dubai has one of the largest expat populations in the world, and expat custody cases are among the most complex. Here is what every expat parent needs to know.

You can fight for custody of your children in Dubai even if you are not a UAE national. Your nationality does not affect your right to go to court.
A non-Muslim foreign national may seek application of their national personal status law where permitted under the applicable UAE choice-of-law and personal status rules. The availability and scope of such a request depend on the circumstances and applicable legislation.

If you want to leave Dubai with your children after the divorce, you need a court order allowing relocation. The other parent cannot stop you from leaving yourself, but they can stop you from taking the children.
Foreign nationals may bring or participate in custody proceedings before the competent UAE courts where the applicable jurisdictional and procedural requirements are satisfied10.

This is one of the most important rights expats have in Dubai that most people never use.Where permitted under the applicable UAE personal status and choice-of-law rules, a non-Muslim foreign national may request application of their national law, subject to the requirements and limitations prescribed by UAE law.. For example, a British couple may be able to have their custody case decided under English law. A Dubai court has already applied Indian law in a custody case. My Ex Is Refusing to Let Me See My Children

This is one of the most common and most painful situations. If you have a court order giving you visitation rights and the other parent is blocking access, we file an enforcement application with the court immediately. The court can impose serious penalties on a parent who refuses to comply with a visitation order, including fines and, in serious cases, loss of custody. You do not have to accept being kept away from your children.

My Ex Wants to Take Our Children Out of the UAE

If your ex wants to relocate abroad with your children, they need your written consent or a court order. If you do not agree, we fight the relocation application in court. Who gets custody of children after divorce in the UAE?

For Muslim couples, custody usually starts with the mother for younger children and can move to the father as children get older, though the court decides based on the child’s best interests. For non-Muslim couples, joint custody is the starting point. In all cases, the court’s primary consideration is what is best for the child, not which parent wants custody more.

Until what age do mothers have custody in Dubai?

Under Federal Decree-Law No. 41 of 2024, custody generally ends when the child reaches 18. Following separation, the mother has priority in the statutory order of custody, but this does not mean that the mother is automatically guaranteed custody until age 18. Previously, custody transferred from the mother to the father at an earlier age. The new law is much more protective of the mother’s role and focuses on the child’s best interests throughout. For non-Muslims, joint custody runs to 18 under Federal Decree-Law No. 41 of 2022.

Can a father get custody of his children in Dubai?

Yes, absolutely. Fathers have the full right to apply for custody in Dubai. The court does not automatically favour the mother. If the father is the more present and capable caregiver, or if the mother is unable to provide proper care, the court can award custody to the father. My ex is not letting me see my children. What can I do?

If you have a court order giving you visitation rights and the other parent is blocking access, contact us immediately. We file an enforcement application with the court. The court can impose fines and other penalties on a parent who refuses to comply. In serious cases, the court can review and change the custody arrangement if the blocking continues.

Can I take my children out of Dubai on holiday?

You need the other parent’s written permission or a court order to take your children outside the UAE. Even for a short holiday. If the other parent refuses permission unreasonably, you can apply to the court for a travel order. The court generally allows short holiday trips when the parent provides a guarantee, such as the passport of a relative.

Which custody law applies to expats in Dubai?

Federal Decree-Law No. 41 of 2022 applies to non-Muslim foreign nationals within its statutory scope, subject to the choice-of-law options and other provisions permitted under UAE law. This gives joint custody as the starting point. Expats can also ask the court to apply their home country’s law instead. Will my UAE visa affect my ability to get custody?

Your visa status does not prevent you from applying for custody. However, courts generally expect the custodial parent to have a valid UAE residence visa. My ex has taken our children to another country without my permission. What can I do?

How do I change a custody arrangement in Dubai?

You apply to the Personal Status Court to modify the existing custody order. You need to show that there has been a significant change in circumstances since the original order was made and that the change you are proposing is in the child’s best interest. Can custody be changed if the parent with custody remarries?

Under Federal Decree-Law No. 41 of 2024, marriage of a female custodian to a man who is not related to the child is relevant to the statutory conditions of custody; however, the court may maintain custody where the best interests of the child require otherwise. What happens to custody if one parent moves to another emirate?

Moving within the UAE is generally not a problem for custody.
