Both husbands and wives can file for divorce in Dubai. You do not need your spouse’s agreement to start the process. A person may file divorce proceedings before the competent UAE court where the applicable jurisdictional requirements are satisfied. The fact that the marriage was concluded abroad does not, by itself, prevent UAE courts from having jurisdiction.

The applicable personal status law depends on factors including nationality, religion and any legally permitted choice of law. Federal Decree-Law No. 41 of 2024 applies within its statutory scope, while Federal Decree-Law No. 41 of 2022 provides a civil personal status framework for non-Muslims within its scope. Non-Muslim expats can also ask the court to apply their home country law. We explain this in full in Section 7 below.

Divorce in Dubai goes through the Personal Status Court. Referral to family guidance or reconciliation depends on the applicable personal status regime and the nature of the proceedings. Divorce proceedings under Federal Decree-Law No. 41 of 2022 on Civil Personal Status are exempt from referral to Family Guidance and are presented directly to the court.

If you or your spouse is Muslim, the new UAE Muslim Personal Status Law applies. This law came into effect in April 2025 and replaced the previous Federal Law No. 28 of 2005. It is based on Islamic Sharia and covers Talaq (husband initiates), Khula (wife initiates), contested divorce, custody up to age 18, maintenance and more. Divorce cases go to the Personal Status Court.

If both spouses are non-Muslim, the Civil Personal Status Law applies. Under this law, you can divorce without giving a reason. There is no fault required. Either spouse can file. Custody is joint until the child turns 18. Alimony is decided by the judge based on factors including the length of the marriage and each party’s financial situation. This law has been in effect since February 2023.

Non-Muslim expats have the right to ask the Dubai court to apply their home country law to their divorce, custody and alimony. This is a major opportunity that many expats do not know about. A Dubai court has already granted divorce under Indian law in a case heard in 2024. Whether this is better for you depends on your specific situation. We advise on this in the first consultation.

Where one spouse is Muslim and the other is non-Muslim, the applicable legal framework must be determined under the scope and choice-of-law provisions of the UAE Personal Status Law and other applicable legislation. Custody and Guardianship Are Not the Same Thing

In UAE law, custody and guardianship are two separate things. Custody means who the child lives with day to day. Guardianship means who makes the big decisions about the child’s life such as education, travel and medical care. The father is usually the guardian even when the mother has custody. Both can be challenged in court if the child’s interests require it.

How Custody Works for Muslim Couples?

Under the new Federal Decree-Law No. 41 of 2024, custody for Muslim couples extends to age 18 for both boys and girls. The court follows the best interests of the child. Mothers generally have day-to-day custody in the early years, but this is not automatic. Fathers have full guardianship rights. Either parent can request a change if circumstances change.

How Custody Works for Non-Muslim Couples

Under Federal Decree-Law No. 41 of 2022, non-Muslim couples have joint custody by default. Under Federal Decree-Law No. 41 of 2022, both parents have an equal right to joint custody until the child reaches the age of 18, subject to the court’s power to determine or modify custody arrangements in accordance with the applicable law and the child’s interests. Custody runs until the child turns 18. Under Federal Decree-Law No. 41 of 2022, joint custody applies until the child reaches 18 years of age, after which the child has freedom of choice, subject to the applicable legal provisions.

Visitation Rights

The parent who does not have day to day custody has the right to regular visitation. The court sets a visitation schedule. If one parent is blocking the other from seeing the children without good reason, we can apply for a court order to enforce visitation rights.

Travel With Children After Divorce

Taking a child out of the UAE after divorce requires the permission of the other parent or a court order. If your former spouse is trying to take your child abroad without permission, we can apply for an emergency court order to prevent this. Act immediately if this is happening.

Avoid These

Can I get divorced in Dubai if I got married in another country?

Yes. You can file for divorce in Dubai even if your marriage took place in another country. You just need to provide your foreign marriage certificate with an official Arabic translation. Dubai courts may have jurisdiction over a divorce involving a marriage concluded abroad where the applicable jurisdictional requirements under UAE law are satisfied.

Does my spouse have to agree to the divorce?

No. In Dubai you can file for divorce without your spouse’s agreement. For non-Muslims, either spouse can file without giving a reason. For Muslims, the court can grant divorce even if one spouse refuses under certain conditions. You do not have to stay in a marriage you want to leave.

How long does divorce take in Dubai?

A mutual divorce where both agree takes 4 to 6 weeks. A contested divorce takes 6 months to 1 year or more. The timeline depends on how complex the case is and how cooperative both parties are.

Can I file for divorce online in Dubai?

Some steps in the Personal Status Court can be initiated online through the Dubai Courts digital platform. However, the full divorce process still requires court appearances, document filing and hearings. We advise on what can be done digitally and what requires a court visit.

What happens at the Family Guidance Centre?

Family Guidance applies where required under the applicable personal status regime. Divorce proceedings under Federal Decree-Law No. 41 of 2022 on Civil Personal Status are expressly exempt from referral to Family Guidance. A counsellor meets with both spouses to see if reconciliation is possible. If reconciliation fails, the counsellor prepares a report and the case moves to court. We prepare you for this meeting so you know what to expect and how to handle it.

Who gets custody of the children in Dubai?

Custody in Dubai is decided based on the best interests of the child. For Muslim couples, the new 2024 law extends custody to age 18. For non-Muslims, joint custody is the default under Federal Decree-Law No. 41 of 2022. The parent who does not have day to day custody gets regular visitation. We represent both mothers and fathers in custody cases.

Can I take my children out of Dubai after divorce?

You need the other parent’s written permission or a court order to take your children out of the UAE after divorce. Taking children abroad without permission is considered child abduction under UAE law and can result in criminal proceedings. Contact us before travelling with your children.

How is school enrollment handled after divorce?

After divorce, the parent with day to day custody generally handles school enrollment. If the guardianship order names the father as guardian, schools may require his signature for major decisions. We advise on how to handle school matters after divorce and help you get the right court orders in place so there are no disputes at the school gate.

My spouse is threatening to take the children if I file. What do I do?

Contact us immediately before doing anything else. We can advise you on how to protect your custody rights from the moment you file. We can also apply for preventive measures to stop your spouse from removing the children from Dubai or from their current school and living situation while the case is ongoing.

Will I have to pay alimony if my wife files for divorce?

Under UAE law, the husband may be required to pay alimony to the divorced wife. The amount and duration depends on factors including the length of the marriage, the wife’s age and financial situation, and whether the wife was the cause of the divorce. The court decides based on the specific facts of your case.

Does the wife get half of everything in a Dubai divorce?

No. There is no automatic 50-50 split under UAE law. For Muslims, each spouse keeps what is in their name, and the wife claims alimony and the deferred dowry. For non-Muslims, the court assesses financial contributions and needs. A good lawyer makes sure you get a fair result based on what you actually contributed to the marriage.

How much does divorce cost in Dubai?

The cost depends on the type of divorce, whether it is contested or mutual, the complexity of custody and financial issues, and the number of court hearings needed. We give you a clear cost estimate at the first consultation. No hidden fees.

My spouse is claiming I earn more than I do. What can I do?

Financial disputes during divorce are common. We advise you on how to properly document your income and financial situation for the court. We also advise on how to challenge inflated or inaccurate financial claims made by the other side. Financial credibility matters enormously in alimony and custody decisions.

What law applies to my divorce as a non-Muslim expat?

If you are Muslim, Federal Decree-Law No. 41 of 2024 applies. If you are non-Muslim, Federal Decree-Law No. 41 of 2022 applies. Non-Muslim expats can also ask the court to apply their home country law. We explain this in full in Section 7 below.

Can I use my home country law for my divorce in Dubai?

Foreign parties may request application of their national law or another applicable law where permitted under UAE choice-of-law and personal status rules. The scope and effect of that request depend on the applicable legislation and circumstances of the case. This right is established under Federal Decree-Law No. 41 of 2022. Whether this is better for you depends on your nationality and your specific situation. We advise on this in the first consultation.

Will divorce affect my UAE visa?

If your visa was sponsored by your spouse, your visa status will be affected by divorce. You have 30 days after the divorce to arrange a new visa. You can transfer to a work visa, a parent visa through your children, or another appropriate visa type. We advise on your visa options as part of the divorce process.

Can I get a divorce in Dubai if I left the UAE?

If you have left the UAE but your spouse is still there, you may be able to file for divorce through a legal representative with a power of attorney. We handle divorce cases for clients who are outside the UAE. Contact us and we will tell you exactly what is possible for your situation.

Can I divorce my Muslim husband in Dubai?

Yes. As a Muslim woman you can file for Khula in Dubai. This is a divorce initiated by the wife. It generally involves returning the dowry or agreeing to financial terms. The new Federal Decree-Law No. 41 of 2024 has made Khula more accessible for women. You can also ask the court for judicial divorce on grounds of harm.

My husband has left Dubai and is not responding. Can I still get divorced?

Yes. If your spouse cannot be located or is not responding, the court can still proceed. There is a process for serving notice by publication. The case moves forward even if the other spouse does not participate. We handle these situations and make sure your divorce case proceeds.

Can I get a divorce if my spouse is violent?

Yes. Domestic violence is a ground for divorce and a criminal matter in the UAE. You can apply for a protection order under Federal Law No. 10 of 2019 and file for divorce at the same time. If you are in danger, contact us immediately. We handle these cases with complete confidentiality.

What is the difference between Talaq and Khula?

Talaq is when the husband initiates the divorce under Islamic law. Khula is when the wife initiates and typically involves returning the dowry to the husband.
