Most parents think custody and guardianship mean the same thing. They do not. Under UAE law they are two separate legal rights, and they can belong to different parents. Understanding the difference is the starting point for understanding your role in your child’s life.

Custody (Hadana in Arabic) is the right to care for the child every day. It covers where the child sleeps, what they eat, their daily routine, health care appointments, and being physically present in their life. The parent with custody is responsible for the child’s physical and emotional well-being day to day. Under Federal Decree-Law No. 41 of 2024, custody for Muslims generally starts with the mother for younger children. For non-Muslims under Federal Decree-Law No. 41 of 2022, joint custody is the starting point.

Guardianship (Wilaya in Arabic) is the legal authority to make the big decisions in a child’s life. This includes which school the child attends, what medical treatment they receive, whether they can travel outside the UAE, and who holds the child’s passport. Under UAE law, the father is traditionally the legal guardian. He holds these decision-making rights even when the mother has day to day custody. This is one of the most misunderstood aspects of UAE family law.

A mother can have the child living with her every day and still need the father’s permission to enroll the child in a different school or take them abroad for a holiday. Under Article 157 of the UAE Personal Status Law, the guardian has the right to hold the child’s passport and must hand it over only when the child is traveling. The custodian (usually the mother) cannot travel outside the UAE with the child without the guardian’s written consent unless a court order says otherwise.

Father's Rights

You have the right to make decisions about your child’s education. No school can be chosen without your consent as guardian. If the mother is trying to enroll the child in a school you disagree with, you can challenge this through the court.

You have the right to hold your child’s passport. Under Article 157 of the UAE Personal Status Law, the guardian holds the child’s passport and provides it only when the child is travelling.

You have the right to decide on medical treatment. Major medical decisions for the child require your consent as guardian. Emergency treatment is an exception, but non-emergency medical procedures need your agreement.

You have the right to refuse international travel. The custodian parent cannot take your child outside the UAE without your written permission. If you withhold permission, the mother must apply to the court to override your decision.

You have the right to information about your child. As guardian, you are entitled to information about your child’s education, medical care, and general wellbeing. If the custodian parent is keeping this from you, this can be challenged in court.

Guardianship Rights Advice and Clarification

Many parents are not sure what their guardianship rights actually are under UAE law. We advise parents on exactly which rights they hold, which decisions they can make independently, and which require the other parent’s consent or a court order. Knowledge of your rights is the first step to protecting them.

Guardianship Transfer and Modification

A court can transfer guardianship from one parent to another when the current guardian is not acting in the child’s best interests. Grounds include neglect, abuse, repeated failure to make decisions, disappearance, or serious misconduct. Guardianship Will Registration for Expats

Non-Muslim expats in Dubai can register a guardianship will through the DIFC Wills Service Centre or the Abu Dhabi Judicial Department. This allows you to name the guardian of your choice for your minor children if you die or become incapacitated. Without a registered guardianship will, a court appoints the guardian.

Guardianship Disputes Between Parents

When parents disagree on major decisions for the child, such as which school the child attends, what medical treatment they receive, or whether to change the child’s name, we represent the parent whose position is being overridden. We take the dispute to the Dubai Personal Status Court and argue for the decision that serves the child’s best interests.

Travel Permission and Passport Disputes

The guardian in Dubai has the right to hold the child’s passport. The custodian needs the guardian’s written permission to take the child outside the UAE. When a guardian unreasonably refuses travel permission for a school trip, a family holiday, or a medical trip abroad, we apply to the court for an order overriding the refusal.

Medical Decision Disputes

When parents disagree on medical treatment for a child, especially in urgent situations, time matters. We apply to the court for emergency orders in cases where a guardian’s refusal to consent to necessary medical treatment is putting the child at risk. Guardianship for Muslim Families Under the 2024 Law

For Muslim families, guardianship is governed by Federal Decree-Law No. 41 of 2024, which came into force on 15 April 2025. This law replaced the previous 2005 Personal Status Law. Under this framework, the father is the legal guardian of the child and holds authority over education, travel, medical decisions, and financial management.

Guardianship for Non-Muslim Families Under the 2022 Law

For non-Muslim families, Federal Decree-Law No. 41 of 2022 applies a more joint and gender-neutral approach to guardianship. Both parents share guardianship rights by default. Decision-making authority is not automatically concentrated in the father. Either parent can apply to the court for specific guardianship powers if the other parent is not cooperating.

Guardianship Case

Guardianship cases in Dubai follow a structured legal process. Here is what happens from the moment you contact us to the final court order.

Assessment of Your Rights and the Dispute

We start by reviewing your current custody and guardianship status, the specific dispute at hand, and what outcome you need. We assess which law applies to your family, what the court is likely to decide, and what the fastest legal route to resolution looks like.

Attempt at Agreed Resolution

Before filing a court case, we send a formal legal communication to the other parent stating the specific guardianship right being exercised or disputed and requesting compliance. Many guardianship disputes are resolved at this stage when the other parent receives a formal letter from a licensed lawyer.

Filing with the Dubai Personal Status Court

If the dispute cannot be resolved through correspondence, we file the application with the Dubai Personal Status Court. We prepare all documentation, official Arabic translations, and evidence. For urgent matters such as medical decisions or imminent travel, we apply for emergency orders at this stage.

Court Assessment and Hearing

The court may refer the case to a social welfare specialist who assesses the child’s situation, the home environment, and the specific dispute. We prepare you for this assessment and attend every court hearing. We present your case clearly, challenge any misrepresentations, and make sure the court has the full picture.

Judgment and Enforcement

The court issues a guardianship order or a specific order on the disputed issue, such as school enrollment, passport release, or travel permission. If the other parent ignores the court order, we apply to the Execution Court for enforcement immediately. Court orders in Dubai on guardianship matters are enforceable, and non-compliance has consequences.

What Happens Without a Guardianship Will

If an expat parent dies or becomes seriously incapacitated in Dubai without a registered guardianship will, the Dubai courts decide who looks after the children. The court appoints a guardian based on the law that applies and may not choose the person the parents would have chosen.

The ADJD Guardianship Will

The Abu Dhabi Judicial Department also allows guardianship will registration. ADJD wills are valid across all 7 UAE emirates, which makes them a good choice for families with assets or connections in multiple emirates. ADJD will cost significantly less than DIFC will. Government fees start from approximately AED 950.

The DIFC Guardianship Will

The DIFC Wills Service Centre allows non-Muslim expat parents in Dubai to register a guardianship will specifically for their minor children. This will name who should care for your children, who should manage their finances, and who should make decisions on their behalf. It is enforceable in Dubai under Dubai Law No. 2 of 2025.

Choosing the Right Guardian for Your Children

The guardian you name in your will should be someone who lives in the UAE, knows your children, shares your values about their upbringing, and is practically able to step into the role if needed. Expats are often advised to name a local guardian as a backup while the permanent guardian from abroad makes arrangements to arrive.

Guardianship Disputes

School Enrollment Refusal

One of the most common guardianship disputes in Dubai is when a father refuses to sign a school enrollment form or refuses to agree to a school change. Without the guardian’s signature, many schools will not admit the child.

Passport Withheld from Travelling Parent

When a guardian withholds the child’s passport as a way of controlling the custodian parent or preventing travel, it causes immediate practical harm. We apply to the court for a specific order requiring the passport to be made available for a specific trip or on a regular basis.

Travel Permission Unreasonably Refused

A guardian cannot refuse travel permission arbitrarily. If the custodian parent wants to take the child on a family holiday, a school trip, or to visit grandparents abroad and the guardian refuses without good reason, we apply to the court for a travel order.

Medical Treatment Disagreement

When parents disagree on medical treatment for a child, we advise on which decisions require guardian consent and which do not. In urgent situations, emergency treatment can proceed without consent. For non-emergency treatment where the guardian refuses consent without good medical reason, we apply for a court order authorizing the treatment.

Relocation Abroad with Children

When a custodian parent wants to relocate permanently to another country and take the children with them, they need the guardian’s consent. If the guardian refuses, it goes to court. The court weighs the custodian’s right to move with the child’s right to maintain a relationship with both parents.

Who is the legal guardian of a child in Dubai after divorce?

For Muslim families under Federal Decree-Law No. 41 of 2024, the father is typically the legal guardian even when the mother has day-to-day custody. He holds authority over major decisions, including education, travel, and medical care. For non-Muslim families under Federal Decree-Law No. 41 of 2022, guardianship is approached on a joint basis between both parents by default.

Can a mother be the guardian of her child in Dubai?

Under the traditional Muslim personal status framework, the mother is the custodian rather than the guardian. However, the new Federal Decree-Law No. 41 of 2024 strengthened the role of both parents, and courts have discretion to assign guardianship rights in ways that serve the child’s interests. For non-Muslim families, mothers and fathers share guardianship by default. A mother can also apply to the court for specific guardianship powers if the father is not fulfilling his role.

Can I take my child on holiday without the father's permission in Dubai?

No. Under UAE law, the custodian parent cannot take a child outside the UAE without the guardian’s written permission. This applies even for short holidays. If the guardian unreasonably refuses, you can apply to the court for a specific travel order. The court considers the purpose of the trip, the planned return date, and the child’s relationship with both parents when deciding.

Who holds the child's passport in Dubai?

Under Article 157 of the UAE Personal Status Law, the guardian has the right to hold the child’s passport.
