Alimony in Dubai means financial support paid by a husband to his wife. It covers her food, housing, clothing, medical care, and daily needs. Under UAE law, a husband’s maintenance obligations during marriage and any financial obligations following divorce depend on the applicable personal status regime and the circumstances prescribed by law. The amount is decided by the court based on the husband’s income and the wife’s needs.

In Islamic law, alimony is called Nafaqa. It is a husband’s religious and legal duty to provide for his wife financially. This includes housing, food, clothing, medical care, and anything she needs to live at the standard of their marriage. This duty exists during the marriage and continues for a period after divorce. It does not depend on whether the wife works or earns her own income.

In Dubai, the husband pays alimony to the wife. Post-divorce financial support is determined under the personal status regime applicable to the parties. For non-Muslims governed by the Civil Personal Status framework, the court determines any alimony entitlement in accordance with the statutory criteria and applicable executive regulations. The husband pays it. The court sets the amount if the parties cannot agree.

The amount is determined based on the husband’s monthly income and the family’s standard of living. We had a case in which the court awarded:

Yes. Under UAE law, a wife’s right to alimony does not depend on whether she works. Under the Muslim Personal Status Law, a wife’s financial means do not by themselves extinguish the husband’s maintenance obligation during marriage. For non-Muslims governed by the Civil Personal Status framework, the wife’s income and financial circumstances may be relevant to the court’s assessment of post-divorce financial support.

Alimony for Muslim Couples

For Muslim couples, alimony is governed by Federal Decree-Law No. 41 of 2024, which came into force in April 2025. The husband must support the wife during the marriage and during the iddah period after divorce. The right to alimony starts from the date the husband stopped paying, not the date of the court order. A claim for a wife’s maintenance for a period preceding the filing of the case is subject to the statutory limitation prescribed by the applicable Personal Status Law, which under Federal Decree-Law No. 41 of 2024 does not exceed two years preceding the date of filing the claim.. The maximum alimony the husband pays cannot exceed 60 percent of his net income.

Alimony for Non-Muslim Couples

For non-Muslim couples, alimony is governed by Federal Decree-Law No. 41 of 2022. For non-Muslims governed by Federal Decree-Law No. 41 of 2022 and its Executive Regulations, post-divorce financial support is determined in accordance with the statutory criteria and procedures applicable to the claim. Alimony can be paid monthly or as a lump sum. It can be adjusted annually. It stops when the wife remarries or when the custody of the children ends.

Many wives going through divorce in Dubai do not realize they can get financial support from the court immediately, before the divorce is even finalized. This is called temporary alimony.

How to Apply

Temporary alimony is financial support that the court orders the husband to pay while the divorce case is still going through the court process. A divorce can take 6 months to a year or longer. You should not have to go without financial support during that whole time. Under Article 100 of Federal Decree-Law No. 41 of 2024, the court may, during the hearings of an alimony case and upon the wife’s request, award temporary maintenance for her and her children, and the decision is immediately enforceable by operation of law.

Alimony Problems

My Ex Is Not Paying the Alimony the Court Ordered

This is the most common alimony problem we deal with. When a husband ignores a court alimony order, we take immediate enforcement action. Where a court-ordered maintenance obligation is not complied with, appropriate enforcement measures may be sought from the competent authority where the statutory requirements for those measures are satisfied. These tools work. Most people pay very quickly once enforcement begins.

My Husband Divorced Me and Left the UAE Without Paying

This is a serious situation but not a hopeless one. If your husband has left Dubai, we can apply for a court judgment in his absence and then explore international enforcement options. We also investigate whether he has any remaining assets in the UAE, including bank accounts, property, or business interests that can be attached.

The Alimony Amount Is Too High, and I Cannot Pay It

If the court has ordered alimony that genuinely exceeds what you can pay, you can apply for a modification. You need to show that your financial circumstances have changed since the order was made or that the original order did not accurately reflect your financial position. We represent husbands in these modification cases and argue for a realistic amount.

I Am Pregnant and Going Through a Divorce

Under UAE law, if the wife is pregnant at the time of divorce, her alimony rights are significantly stronger. A pregnant divorcee’s maintenance rights during the waiting period and any maintenance or nursing-related entitlements following birth are determined separately under the applicable provisions of the Personal Status Law. We make sure all of this is claimed correctly from the start.

My husband claims he has no money, but I know he does.

The effect of a wife’s employment and income on maintenance depends on the applicable personal status regime and the nature of the maintenance claim. Under the non-Muslim Civil Personal Status framework, the divorcee’s income may be relevant to the assessment of post-divorce financial support. If your ex has stopped paying alimony, citing your employment as the reason, this is not legally valid. We enforce the existing order and make sure you receive what you are entitled to.

What is alimony in Islam, and how does it apply in Dubai?

In Islam, alimony is called Nafaqa. It is the husband’s religious and legal duty to provide for his wife financially. This includes housing, food, clothing, and medical care. UAE personal status law for Muslims is based on Islamic principles and gives the wife the legal right to claim this support through the courts if the husband fails to provide it. The right exists during the marriage and for a period after divorce.

How much alimony can a wife get in Dubai?

There is no fixed amount. The court considers the husband’s income, the wife’s financial needs, the lifestyle during the marriage, the number of children, and the current cost of living in Dubai. The amount of maintenance is determined in accordance with the statutory criteria and limits prescribed by the applicable Personal Status Law, taking into account the relevant financial circumstances. Every case is different. We assess your specific situation and give you a realistic estimate in the first consultation.

Does a wife lose her right to alimony if she works?

No. Under UAE law, a wife’s right to alimony does not disappear because she works. The husband’s obligation to provide is independent of whether the wife has her own income. Even a wife who earns a good salary can still claim alimony from her husband. This has been confirmed by UAE courts repeatedly.

How long does alimony last in Dubai?

For Muslims, iddah alimony lasts for three months after a revocable divorce. Compensation alimony can be ordered for up to one year. Child maintenance continues until the child is financially independent or married. For non-Muslims under Federal Decree-Law No. 41 of 2022, the duration is set by the court based on the circumstances, including the length of the marriage.

Can alimony be paid as a lump sum in Dubai?

Yes. Alimony in Dubai can be paid monthly or as a one-time lump sum payment depending on what the court orders or what both parties agree. A lump sum can sometimes be a cleaner solution, as it avoids ongoing enforcement issues. We advise on which option is better for your specific situation.

Can I claim alimony while my divorce case is still in court?

Yes. This is called temporary alimony, and you can apply for it at any point during the divorce proceedings. Under Article 100 of Federal Decree-Law No. 41 of 2024, the court can issue a temporary support order quickly. You do not have to wait for the divorce to be finalized to start receiving financial support.

Can I claim alimony for past years when my husband did not pay?

Under Federal Decree-Law No. 41 of 2024, a wife’s claim for past maintenance may cover a period not exceeding two years preceding the date of filing the claim.. Under UAE law, alimony is considered a debt owed by the husband from the date he stopped paying. If he has not been providing for you for three years, you can claim all of that back when you file your case. We calculate the full amount and include it in your claim.

What documents do I need to claim alimony in Dubai?

You will need your marriage certificate with Arabic translation, Emirates ID copies for both parties, proof of the husband’s income such as salary certificates or bank statements, proof of your living expenses and housing costs, and any evidence of previous non-payment. What happens if my ex refuses to pay alimony in Dubai?

Where a court-ordered maintenance obligation remains unpaid, the beneficiary may pursue the enforcement measures available under UAE law, subject to the statutory requirements and procedures applicable to each measure.. These tools are very effective. Most people pay quickly once enforcement begins.

Can alimony be reduced if circumstances change?

Yes. Either party can apply to the court to modify the alimony amount if circumstances change significantly. If the husband loses his job or his income drops substantially, he can apply for a reduction. If the wife’s expenses increase significantly, she can apply for an increase. Alimony under Federal Decree-Law No. 41 of 2022 can also be adjusted annually.

Does alimony stop when the wife remarries?

Yes. Under both Muslim and non-Muslim personal status law in the UAE, the wife loses her right to spousal alimony if she remarries. Child maintenance continues regardless of remarriage because it is the father’s obligation to the children, not to the ex-wife. If you remarry and your ex finds out, they can apply to stop alimony payments immediately.

Can a husband be jailed for not paying alimony in Dubai?

In serious cases, yes. If a husband repeatedly refuses to comply with a court alimony order and all other enforcement measures have failed, the court can initiate criminal proceedings. Failure to comply with a court-ordered maintenance obligation may give rise to enforcement measures and, where the elements of an applicable criminal offence are established, criminal liability. Does UAE alimony law apply to expats in Dubai?

The law applicable to an expatriate’s maintenance claim depends on the relevant UAE personal status and choice-of-law rules and the circumstances of the parties. Non-Muslim expats can request their home country law to be applied instead, but the obligation to pay still exists under either law.

I have an alimony order from another country. Can I enforce it in Dubai?

A foreign alimony judgment may be recognized and enforced in the UAE where the applicable statutory conditions for recognition and enforcement of foreign judgments are satisfied. The process requires submitting the foreign order with an official Arabic translation. My ex left Dubai and is in another country. Can I still get alimony?

Possibly. If your ex has assets in Dubai, including bank accounts or property, we can apply to freeze those assets or enforce against them. We also advise on international enforcement options. What is iddah alimony, and who gets it?

During the applicable waiting period, maintenance rights are determined according to the type of divorce, pregnancy status and the duration prescribed by the Personal Status Law.

What is compensation alimony in the UAE, and how is it different?

Compensation alimony (Mutaa) is paid in addition to iddah alimony when the husband divorces the wife unilaterally without any fault on her part. Under Federal Decree-Law No. 41 of 2024,Where the statutory requirements are satisfied, the court may award compensation arising from divorce within the limits and according to the criteria prescribed by the applicable Personal Status Law. Can a wife claim alimony during marriage without divorcing?

Yes. If a husband stops providing for his wife during the marriage, she can file a maintenance claim with the court even without starting divorce proceedings. The court can order the husband to pay maintenance immediately. This is known as Nafaqa, and the right exists independently of divorce.
