A person sought for extradition may be provisionally detained in accordance with the procedures and time limits prescribed by UAE law. Detention is not automatic for the entire duration of every extradition proceeding, and the Attorney General or his delegate may order release subject to appropriate guarantees in the circumstances permitted by law. Under Article 11 of Federal Law No. 39 of 2006, an extradition request is submitted in writing through diplomatic channels and referred to the Central Authority, which is the competent department of the Ministry of Justice under the Law. After the Central Authority reviews the request and its supporting documents in accordance with Article 12, the request is referred to the competent Public Prosecution and proceeds in accordance with the statutory procedure before the competent court, which determines whether extradition is legally permissible. If the court approves the request, the person has thirty days to appeal before any surrender takes place.

How UAE Extradition Law Works

Extradition in the UAE is governed by Federal Law No. 39 of 2006 on International Judicial Cooperation in Criminal Matters, updated by Federal Decree Law No. 38 of 2023. Under Article 7, the offence must generally be punishable by deprivation of liberty for at least one year or a more severe penalty under the law of the requesting State, and the underlying conduct must constitute an offence punishable by deprivation of liberty for at least one year or a more severe penalty if committed in the UAE. Where extradition is sought to enforce a sentence, at least six months of the custodial sentence must remain to be served. The exact legal wording used by each country does not need to match, as long as the underlying conduct is a crime in both places.

When Extradition Can Be Refused

UAE law sets out clear grounds to refuse an extradition request. Article 9 of Federal Law No. 39 of 2006 sets out multiple mandatory grounds on which extradition must be refused, including circumstances relating to UAE nationality, UAE jurisdiction, political or military offences, prior proceedings or judgments, limitation periods and specified risks to the person sought.
