This guide covers heirs ownership registration dubai requirements and what follows the transfer of title. Heirs ownership registration in Dubai is the Land Department service that moves a property from the deceased to the heirs. The service is now named Inheritance Title Transfer, and it registers the property in the heirs’ names on the legal inheritance certificate and the heirs’ identification documents. Read the Department’s service page for the required documents and fees.

This guide covers Dubai. Our guide on whether a legal heir certificate is mandatory covers the documents in detail, and this one covers the registration itself and what follows it.

Three separate stages are often confused. A court identifies the legal heirs and their shares, and the Land Department then registers the inherited property in their names, which is the service in this guide. After registration, the heirs manage, sell or divide the property as co-owners under the rules in the last section.

Quick Answer

Heirs ownership registration in Dubai is carried out through the Dubai Land Department’s Inheritance Title Transfer service. The court first determines the heirs and their shares. The Department then uses the inheritance documentation and required identity records to register the property in their names and issue electronic title documents.

The Department publishes a service time of eight working hours after document submission, along with property transfer, title deed and map fees. Once registered, the heirs become co-owners, and managing, selling or dividing the property may involve separate legal rules, particularly for residential property covered by Dubai’s special decree.

What can hold up a registration

Most delays come from a missing document or an open claim.

  • No court letter. The Department requires an official letter from Dubai Courts, another UAE court or the Awqaf, addressed to it, requesting the transfer.
  • A mortgage or a developer’s interest. A no objection letter from the mortgagee is needed if the property is mortgaged, and from the developer if there is a preliminary sale agreement.
  • Missing heirs. The documents include the Emirates ID copies of all heirs, and passport copies of non-resident heirs.
  • A debt that appears later. If a debt appears after the estate is divided, the division is rescinded unless the heirs pay the debt, the creditors release it, or the deceased left other money to pay it (Civil Transactions Law, Article 1069).

After registration: how the heirs hold the property

Once registered, the heirs are co-owners. The Civil Transactions Law applies to co-ownership where no special law conflicts with it (Article 1050). Dubai’s decree on heirs’ residential property sets special provisions for the property it covers, and the Civil Transactions Law applies to matters the decree does not regulate (Decree 23/2020, Article 12).

QuestionWhat the law saysSource
Using or disposing of his own shareEach co-owner can use his own share and dispose of it without the others’ permission, if he does not harm their rights. This is an individual right and needs no majorityCTL Art 1052
Ordinary management of the propertyA decision on ordinary management is taken by the owners holding a majority of the shares by valueCTL Art 1055
Selling the whole propertyA statutory majority is needed: the owners of at least three-quarters can decide, for justified reasons, but must notify the others and cannot dispose of the property until 60 days after the notice. Any co-owner can object to the court within those 60 days, and the objection suspends the disposal until the court decidesCTL Art 1061
Residential property that heirs cannot agree onIf an heir declines to consent, or does not reply within 30 days, the Land Department mediates an amicable settlement. If an heir persists, the Department issues an official document that settlement cannot be reached, and a claim is filed against all the heirs in the Probate Court. A disposition made in breach of the decree is voidDecree 23/2020, Arts 6, 11; Decree 31/2023, Arts 6 to 9
Dividing the propertyEach co-owner can ask for partition, unless he is bound to remain in co-ownership by law or by an agreement of up to five years. If partition in kind is impossible or would seriously reduce the value, a co-owner can sell his share to another co-owner or ask the court to sell it, and if the share cannot be sold, he can ask for the whole property to be sold and the price shared by sharesCTL Arts 1063, 1067
A minor’s shareA guardian must obtain the court’s permission to dispose of a minor’s real estate. The court may grant permission only where it determines that necessity or an apparent benefit justifies the disposalPSL Art 137
