The Legal Procedures on Selling Heirs’ Inherited Property in UAE start with the title: the property is registered in the deceased’s name, and it must be registered in the heirs’ names before it can be sold. A real property transaction in Dubai is valid only once it is recorded in the register (Article 9 of Law No. 7 of 2006). For residential property, a Dubai decree adds a Land Department process for heirs who cannot agree.

This guide covers Dubai. Other emirates have their own land departments and procedures, which it does not cover.

Quick Answer

To sell inherited property in Dubai, the heirs generally need the inheritance determination, settlement of relevant estate obligations, and registration of the property in their names before the buyer’s transfer is registered. The sale procedure depends on the property type, ownership shares and whether the heirs agree.

For residential property covered by Dubai Decree No. 23 of 2020, the Dubai Land Department provides a specific process involving notification, consent, mediation and possible Probate Court proceedings. Other property may follow general co-ownership rules. Minors’ interests, outstanding debts, applicable deadlines and registration fees require separate checks.

Which route fits your property

The route depends on whether the property is residential property covered by Dubai Decree No. 23 of 2020.

Rules for the Land Department route

The decree sets conditions the Land Department must check.

  • The Land Department checks that the heirs have another dwelling or plot, or that the property does not meet their needs, that no legal impediment or third-party right blocks the sale, and that no heir will be harmed, especially the elderly, minors, unmarried, divorced and widowed women, and persons with disabilities (Decree 23/2020, Article 3).
  • Where an heir has no other dwelling, the Department works with the Housing Establishment on alternative housing, and the application is suspended for up to one year or until a solution is provided (Article 5).
  • Where the property lies outside the areas open to ownership by non-UAE nationals, the buyer must be a UAE national (Article 4).
  • Government amounts owed on the property must be paid, or settled from the proceeds if the Department approves a deferral (Article 4).
  • A disposition made in breach of the decree is void and cannot be registered (Article 11).

Any affected party can appeal a decision or action of the Department or the Housing Establishment to the Probate Court within 10 working days of being notified (Decree 23/2020, Article 7, as amended).

Rules for other property: co-owners

Other property follows the co-ownership rules.

  • Each co-owner can dispose of his own share without the others’ permission, as long as he does not harm their rights (CTL Article 1052).
  • The owners of at least three-quarters of the property can decide to dispose of the whole, for justified reasons, after notifying the others. They cannot dispose of it for 60 days from the notice, and any other co-owner can object to the court within those 60 days (Article 1061).
  • Each co-owner can ask for partition, and an agreement to stay in co-ownership cannot bind for more than five years (Article 1063).
  • If partition in kind is impossible or would cut the value, a co-owner can sell his share to another co-owner or ask the court to sell it. If it cannot be sold, he can ask for the whole property to be sold, with the price shared by shares (Article 1067).
  • Partition by agreement is not allowed if a co-owner lacks full capacity and has no guardian, or is absent or missing (Article 1064).

The co-ownership chapter applies only where it does not conflict with special legislation on co-ownership (CTL Article 1050). In Dubai, the decree prevails for the residential property it covers, and the Civil Transactions Law fills the gaps (Decree 23/2020, Article 12). Non-Muslim estates

For non-Muslims in Dubai, wills and estates follow Dubai Law No. 15 of 2017. The court where the will is registered, Dubai Courts or the DIFC Courts, decides disputes about it (Article 29), and the administrator’s duties and the creditor periods in that law apply before any distribution.

Questions about selling inherited property

Can one heir sell his share without the others’ agreement?
For property outside the Dubai decree, a co-owner can dispose of his share without permission if he does not harm the others (CTL Article 1052). For residential property covered by the decree, a sale outside its procedure is void (Article 11).
Do all heirs have to agree to sell the whole property?
Under the decree, the heirs consent or decline within 30 days, and a refusal leads to mediation and then the Probate Court. For other property, the owners of three-quarters can decide, subject to notice and an objection to the court (CTL Article 1061).
Can a foreigner buy inherited residential property?
Where the property lies outside the areas open to ownership by non-UAE nationals, the buyer must be a UAE national (Decree 23/2020, Article 4).
What if an heir is a minor?
A guardian needs the court’s permission to dispose of the minor’s real estate (Personal Status Law, Article 137), and the Probate Court must ensure that no heir, especially a minor, is harmed by a sale (Decree 31/2023, Article 9).
