The act of disowning parents in UAE has no legal effect. A child cannot end the legal relationship with a parent by declaration, and the Personal Status Law keeps a duty on a wealthy child to maintain parents who have no money (Article 107). The duty applies to sons and daughters, adults and minors, and it does not depend on the relationship between them.
The Personal Status Law (Federal Decree-Law No. 41 of 2024) applies to UAE citizens where one or both parties are Muslim, to non-Muslim citizens unless special provisions or another permitted law apply, and to non-citizens unless one asks for his or her own law (Article 1). A section below covers non-Muslims.
Quick Answer
Disowning parents in UAE does not legally end the parent-child relationship. Under Article 107 of Federal Decree-Law No. 41 of 2024, a financially capable child may owe maintenance to parents who lack sufficient resources. The law addresses this financial obligation rather than requiring an adult child to maintain personal contact.
The court considers the parents’ financial circumstances, the child’s means and the responsibilities of other children. A declaration of disowning does not remove inheritance rights. The applicable rules must be checked carefully, particularly where a non-Muslim personal-status framework may apply.
What the law still requires
The law speaks of maintenance owed to parents, not of affection or contact.
| Point | What the law says | Article |
|---|---|---|
| Who owes it | A wealthy child, male or female, adult or minor, owes maintenance to parents who have no money from which they can spend | 107(1) |
| If the parents’ money is not enough | The wealthy children must supplement it | 107(2) |
| Several children | The maintenance is divided among the children according to each one’s financial capacity | 108(1) |
| A child who pays voluntarily | He has no recourse against his siblings | 108(2) |
| A child who pays under a judgment | He may recover from each sibling their share under the judgment, if he paid with the intention of recourse | 108(3) |
| A child’s household | If the child’s earnings exceed his own needs and those of his spouse and children, he must include his parents in his family | 109 |
| Priority | If the payer cannot maintain everyone, the wife comes first, then the children, then the parents, then other relatives | 110(2) |
| How the amount is set | The court considers the payer’s means, the recipient’s condition and the economic situation at the time and place. Maintenance covers food, clothing, housing, treatment and education according to custom | 95, 96 |
| Ongoing maintenance for parents | Maintenance due from the date of filing the claim is a preferential debt that takes precedence over all other debts | 98 |
Article 107 makes no exception for a parent’s conduct. Whether a child owes maintenance depends on the parents’ means and the child’s capacity.
What disowning parents in UAE cannot change
Four things stay fixed whatever a child declares.
- Parentage. The law establishes lineage by birth in a marriage, acknowledgment, evidence or scientific methods (Article 87), and it has no procedure for a child to give it up.
- Inheritance. Who inherits is decided by the inheritance rules. A child’s will is limited to one-third of the estate, and a bequest to an heir needs the other adult heirs’ approval or a compelling interest approved by the court (Articles 173 and 184).
- The financial duty. It continues for as long as the parents have no money and the child has the means.
- The parents’ access to the court. A parent can sue for maintenance in the court where the parent or the child lives or works (Article 3).
The Personal Status Law has no article that regulates an adult child’s contact with his parents. Its duty toward parents is financial.

If a parent claims maintenance from you
Prepare evidence of your means.
- Start with the conditions: the parents have no money from which they can spend, and you have the means (Article 107).
- Gather proof of your income, your obligations and your household, because the court weighs your capacity against the parents’ condition (Article 96).
- Identify your siblings. The maintenance is divided among the children by capacity, and you may recover a sibling’s share if you pay under a judgment (Article 108).
- Respond in the case and raise any facts about the parents’ own means, including money or property they hold.
- If a judgment is issued, keep records of every payment. A judgment fixes the amount and how it is enforced.

Non-Muslims
The civil personal status law has no article on a child’s duty to maintain his parents, and it applies other laws in force to matters it does not cover (Article 15). On inheritance, a testator can leave all property he owns in the UAE to anyone he chooses, under the controls in the executive regulations (Article 11), so a registered will can record a different choice.
