The search query “how to appoint legal heir certificate in dubai” concerns obtaining a court document that identifies the heirs. To get a legal heir certificate in Dubai, a concerned party opens an estate file at the court that has jurisdiction over the estate, and the court’s judge issues the certificate that identifies the heirs. For Muslim and most other estates, that court is the Dubai Probate Court, where a Reporting Judge issues the certificates, decisions and orders (Article 10 of Dubai Decree No. 25 of 2023). An estate file is opened at the court on the request of a concerned party.

The UAE has no single document called a legal heir certificate. The Land Department calls the court document the Legal Notification of Inheritance, and courts also speak of an inheritance certificate or a decree of distribution. This guide uses “legal heir certificate” for the court document that names the heirs.

A legal heir certificate does one thing: it establishes who the heirs are and their shares. It is not estate administration, which covers the inventory, the debts and the division of the estate, and it does not move any property into the heirs’ names. Registering inherited real estate is a separate Land Department service that needs the certificate and a court letter.

Quick Answer

To obtain a legal heir certificate in Dubai, a concerned party generally opens an estate file with the court that has jurisdiction. The relevant judge identifies the heirs and issues the court documentation. For many estates, this is handled through the Dubai Probate Court; a registered non-Muslim will may require proceedings before Dubai Courts or the DIFC Courts.

Prepare the death certificate, identification and relationship documents, any registered will, and relevant asset information. The resulting inheritance documentation identifies the heirs but does not itself transfer real estate. A separate Dubai Land Department process is needed for inheritance title registration.

Which court issues it

The court depends on the estate and on where any will was registered.

Filing is a request to open an estate file. For the wider estate process, see how to start an inheritance case in Dubai.

  1. Decide who files. An heir can, and so can a creditor, an executor, a guardian or trustee, a judicial agent or a government entity, with a detailed memorandum stating the reasons.
  2. Prepare the request. It must give the names of the heirs and their personal phone numbers. If you do not know a number, give the residence address, work address or email address, and pay the notification fee.
  3. The court’s president approves the request, and the estate file is opened.
  4. The Awqaf and Minors Affairs Foundation, the Guardianship and Minors’ Assets Administration and the Community Development Authority are added to the file automatically as parties, and the other parties are notified electronically.
  5. The Reporting Judge proposes a settlement to the parties. If they accept, the settlement is drafted under the judge’s supervision, and if not, the estate claim goes to the Probate Court’s divisions.
  6. Collect the certificate and the court letter you need for the Land Department, banks or other authorities.

Steps at the DIFC Courts for a DIFC will

A DIFC will follows a probate route of eight steps.

StepWhat happens
1The executor submits the Probate Application Form, a Witness Statement and a copy of the death certificate, and pays the fee. A Case Progression Officer reviews them
2The executor or a lawful attorney attends in person to sign the application, with the original death certificate and identification
3The executor provides a list of the principal assets, such as real estate, accounts and vehicles, for a schedule to the Probate Order
4The Probate Order is prepared in English and Arabic, and a judge signs it
5The executor collects the original order
6 to 8For assets in Dubai outside the DIFC, the DIFC Courts submit an enforcement application to the Dubai Courts, whose Enforcement Department issues directions to the authority holding each asset. An incomplete asset list can require a supplementary order

Documents to prepare

Gather the documents before you file.

  • The death certificate, and the identity documents of the deceased and every heir.
  • Documents that show each heir’s relationship, such as marriage and birth certificates.
  • Any will, with proof of registration, and any later will or revocation.
  • A list of the assets and debts, with title deeds and bank letters.
  • For a DIFC probate, the original death certificate and a schedule of the principal assets.

The certificate is what the Land Department requires for a transfer of property to the heirs, together with an official court letter. Our guide on whether a legal heir certificate is mandatory for property transfer explains the department’s requirements. Questions about the heir certificate

Who can ask the Probate Court to open an estate file?
An heir, or one of the listed parties, such as a creditor, executor, guardian, trustee or government entity, with a detailed memorandum stating the reasons (Dubai Courts announcement, 2023).
Does the law say how long it takes?
The Probate Court’s decree sets time limits for estate claims, such as one year to decide a claim, extendable (Decree 25/2023). It sets no single period for issuing a certificate.
Does the certificate transfer ownership of the property?
No. It establishes the heirs and their shares. The property is registered in their names through the Land Department’s Inheritance Title Transfer service, on the certificate and an official court letter.
Which court do non-Muslims use?
The court where the will is registered, Dubai Courts or the DIFC Courts (Dubai Law 15/2017, Article 29). Without a will, the civil personal status law applies, subject to the options the law gives a foreign heir (Article 11).
Can a foreign heir be listed?
Yes. The Land Department accepts citizens, residents and tourists as heirs, and non-resident heirs provide passport copies.
