A traffic notice can describe anything from an ordinary parking contravention to conduct carrying imprisonment. Treating every notice as a criminal case creates unnecessary alarm, but assuming every road matter can be closed by paying a fine is equally unsafe. The correct answer depends on the provision applied, the prescribed penalty, the accident outcome, and whether police or the public prosecution has opened a criminal file.
Federal Decree-Law No. 14 of 2024 on Traffic Regulation has applied since 29 March 2025 and replaced the former federal traffic law. It keeps an administrative enforcement system for routine contraventions while creating express criminal offenses for conduct such as impaired driving, driving during suspension, certain unlicensed driving, leaving an injury accident, dangerous pedestrian crossing, causing death, and refusing accurate identification. Local fine, black-point, impoundment, licensing, insurance, and court processes may operate alongside the federal offenses.

Routine traffic enforcement commonly produces a fixed fine, black points, vehicle impoundment, or a licensing restriction. Those consequences may be imposed through the competent traffic or licensing authority without turning every event into a prosecution for an offense carrying imprisonment. The driver should still check the issuing emirate, notice number, payment or objection deadline, impoundment condition, and whether the record shows only an administrative violation.
A criminal road case is different. The driver may be arrested or summoned, questioned by police, referred to the public prosecution, and ultimately tried before a criminal court. Federal Decree-Law No. 14 of 2024 expressly prescribes imprisonment for several forms of conduct in Articles 34 to 41. Article 33 also preserves any more severe penalty under another law, so the traffic decree law is not necessarily the only source of exposure.

Article 35: Driving Under the Influence Is a Criminal Offence
Article 35 covers driving or attempting to drive on the road while under the influence. For alcohol, it prescribes imprisonment and a fine from AED 20,000 to AED 100,000, or either penalty. The court must suspend the driving license for at least three months for a first offense and at least six months for a second offense and cancel it for a third offense.
Narcotic, psychotropic, and similar substances follow a separate and more severe financial range. The prescribed penalty is imprisonment and a fine from AED 30,000 to AED 200,000, or either penalty. The court may suspend the license for at least six months for a first offense and one year for a second offense and may cancel it for a third offense. The distinction should not be replaced with one generic DUI figure.
The article also refers to attempting to drive, so a defense should not assume that movement over a long distance is always necessary. The evidence may include police observations, body-camera or road footage, toxicology results, medical records, admissions, witness accounts, the vehicle position, and the time between driving and testing. Medication or another substance requires careful factual and scientific review rather than an automatic conclusion.

Articles 36 and 37: Suspended, Missing, or Unrecognized Licenses
Article 36 makes driving during a license-suspension period a separate offense where the suspension is based on an order of the competent court, Licensing Authority, or Traffic Control Authority. The prescribed penalty is imprisonment for up to three months and a fine of at least AED 10,000, or either penalty. Paying the earlier fine does not restore a license if the suspension remains active.
Article 37 distinguishes an unrecognized foreign license from having no valid license for the vehicle category. A first offense involving a license issued by a foreign state that is not recognized in the UAE carries a fine from AED 2,000 to AED 10,000. Recidivism carries at least three months’ imprisonment and a fine from AED 5,000 to AED 50,000, or either penalty.
Driving without a license, or with a license that does not authorize that type of vehicle, carries up to three months’ imprisonment and a fine from AED 5,000 to AED 50,000, or either penalty. On recidivism, the article provides at least three months’ imprisonment and a fine from AED 20,000 to AED 100,000, or either penalty. Visitors, residents, recognized foreign licenses, international permits, vehicle classes, and license conversion rules should therefore be checked precisely.
Accident-Site, Pedestrian, Fatality, and Identification Offenses
Article 38 addresses deliberate failure to stop without an acceptable excuse after an accident that caused injury, failure by the owner of a vehicle involved in a crime or accident to provide identifying information, fleeing from police or causing a road chase, and deliberate collision with specified authority vehicles. The prescribed penalty is imprisonment for up to two years and a fine from AED 50,000 to AED 100,000, or either penalty.
Article 39 creates criminal exposure for particular pedestrian conduct. Crossing outside a designated place is punishable by imprisonment and a fine from AED 5,000 to AED 10,000, or either penalty, when it results in a traffic accident. Crossing outside designated places on roads whose speed limit is 80 kilometres per hour or more carries at least three months’ imprisonment and a fine of at least AED 10,000, or either penalty.
Article 40 applies where a person’s fault causes death through use of a vehicle on the road. The basic penalty is imprisonment and a fine of at least AED 50,000, or either penalty. The minimum rises to one year’s imprisonment and a fine of at least AED 100,000, or either penalty, where the fault involves passing a red light, driving under the influence, driving with a suspended or cancelled license, or driving in a valley while floods are running.
Article 41 punishes refusing to give a name or address or giving incorrect information to a properly identified traffic police officer when caught committing an offense or violation under the traffic framework. The penalty is up to three months’ imprisonment and a fine from AED 10,000 to AED 20,000, or either penalty. Providing false details can therefore create exposure beyond the original road issue.
What Happens When a Traffic Matter Enters the Criminal Process
Police may secure the scene, obtain statements, test the driver, inspect vehicles, collect recordings, and refer the file to the Public Prosecution. Article 31 permits arrest in specified red-handed situations, including causing death or casualty, serious property damage, reckless driving, impaired driving, certain failures to identify, and attempts to escape. Article 32 permits vehicle seizure in several situations, including where the vehicle is connected to an accident involving a crime and is needed as evidence.
Public Prosecution decides the procedural direction and charges; the criminal court determines guilt and sentence. Article 42 additionally allows the court, after conviction for a driving-related crime, to suspend a license for up to three years and prevent renewal for up to two further years, or to deprive an unlicensed person of the right to obtain a license for up to three years. Those measures are distinct from the specific license consequences in Article 35.
A victim or family may also pursue compensation, and an insurer may investigate coverage, fault, exclusions, and policy obligations. A police report, technical accident plan, medical report, death certificate, repair estimate, footage, expert opinion, and final criminal judgment may affect the connected claim. Criminal fault and civil compensation should be coordinated, but they are not the same legal question.
Evidence and Immediate Steps After a Serious Traffic Incident
Stop safely, comply with lawful police instructions, obtain medical help, and do not leave an injury scene unless directed or genuinely unable to remain. Preserve dashcam footage, photographs, location history, vehicle data, call records, insurance communications, repair estimates, medical records, test details, and the exact notice or case reference. Do not repair an accident-damaged vehicle before the required permit or inspection process is addressed.
Before giving a detailed further statement, confirm whether you are being treated as a witness, complainant, or accused person; which article is under consideration; whether an interpreter is required; and whether any license, vehicle, travel, bail, or attendance measure applies. Correct factual errors through the proper authority instead of altering evidence or contacting other participants to align accounts.
