The question is: is legal heir certificate mandatory for property transfer in uae? A legal heir certificate is mandatory for a property transfer to heirs in Dubai. The Dubai Land Department’s Inheritance Title Transfer service moves a property from the deceased to the heirs on the basis of the legal inheritance certificate and the heirs’ identification, and its required documents begin with the Legal Notification of Inheritance. Read the Department’s service page.

This guide covers Dubai. Other emirates have their own land departments and procedures, which it does not cover. The UAE has no single document called a legal heir certificate, so the paragraphs below use the names the Land Department uses.

Quick Answer

Yes. For an inheritance title transfer in Dubai, the Dubai Land Department requires the Legal Notification of Inheritance, also described as the legal inheritance certificate, along with the official court letter and the heirs’ identity documents. Agreement between all heirs does not replace these requirements.

The process starts with the appropriate court documentation and continues through the Dubai Land Department or a registration trustee centre. Additional documents may be required for a mortgaged property or preliminary sale agreement. The Department publishes a service time of eight working hours after document submission, separate from the court stage.

What the Land Department requires

The service lists five required documents. The first and the last come from the court.

DocumentWho issues itWhat it shows
Legal Notification of Inheritance (the legal inheritance certificate)The court, through the inheritance judge. In Dubai, a Reporting Judge of the Probate Court issues the certificates and decisionsWho the heirs are and their shares
Official letter addressed to the Land DepartmentDubai Courts, another UAE court, or the Awqaf and Minors Affairs FoundationA request to transfer ownership to the heirs
Emirates ID copies of all heirsThe heirs, if they are citizens or residentsTheir identity
Passport copies of non-resident heirsThe heirsTheir identity
No Objection LetterThe mortgagee if the property is mortgaged, or the developer if there is a preliminary sale agreementThat the lender or developer does not object to the transfer

The Department lists Dubai Courts, other UAE courts and the Awqaf as the sources of the court letter. It does not mention the DIFC Courts.

The inheritance judge’s powers come from the Personal Status Law, which gives that judge the task of identifying heirs and liquidating and distributing the estate (Article 5). The Dubai Probate Court’s Reporting Judge opens the estate file and issues the certificates and decisions (Dubai Decree 25/2023, Article 10). Why is legal heir certificate mandatory for property transfer in uae

The certificate is the basis of the whole service.

  • A real property transaction in Dubai is valid only once it is recorded in the register (Law 7/2006, Article 9). The register shows the deceased until the heirs are recorded.
  • The Land Department does not decide who the heirs are. It registers them on the court’s document, and the service is built on that document.
  • Agreement among the heirs does not replace it. The required documents are the same whether the heirs agree or not.
  • Where one heir wants to sell residential property and the others refuse, the Land Department route and the Probate Court add their own documents in addition (Dubai Decree 23/2020).

Steps to transfer the property to the heirs

Start with the court, then go to the Land Department.

  1. Open the estate file at the court and obtain the Legal Notification of Inheritance. For non-Muslims with a will, the court where the will is registered handles it (Dubai Law 15/2017, Article 29).
  2. Ask the court for the official letter addressed to the Land Department.
  3. Collect the identity documents of every heir, and the mortgagee’s or developer’s no objection letter if one applies. For estate liabilities, see what happens to debt when a borrower dies in the UAE.
  4. Submit everything at a Land Department service centre or a registration trustee centre.
  5. Pay the fees and receive the electronic title deeds and maps in the heirs’ names, showing each share.

Questions about the heir certificate

What is the document called in the UAE?
The Land Department calls it the Legal Notification of Inheritance, and describes the service as based on the legal inheritance certificate.
Do I need it if all the heirs agree?
Yes. The required documents do not depend on whether the heirs agree. The court’s notification and letter are needed in every case.
Can heirs who live abroad be registered?
Yes. The service covers citizens, residents and tourists, and non-resident heirs provide passport copies.
What if the property is mortgaged?
The Land Department requires a No Objection Letter from the mortgagee. If there is a preliminary sale agreement, it requires one from the developer.
