Does UAE labor law guarantee marriage leave? That question often appears when an employee plans a wedding and assumes there must be a fixed number of paid days.

Quick Answer

Not for employees covered by the federal private-sector law. Federal Decree-Law No. 33 of 2021 does not create a separate marriage-leave entitlement. A private employer may still grant wedding leave through a contract or HR policy. A separate Dubai decree gives 10 paid working days to eligible UAE national government employees who meet its conditions.

Identify the employment regime first. Then read the employment contract and current HR policy, ask HR in writing about pay and documents, and obtain approval before treating any absence as marriage leave.

Myth: “UAE Labor Law Gives Every Employee Marriage Leave”

The federal private-sector law creates several specific leave rights, but marriage leave is not one of them.

Private-sector employees may have annual, sick, maternity, parental, compassionate, Hajj, and qualifying study leave. The absence of wedding leave from that list means there is no fixed federal minimum that MOHRE can enforce as marriage leave.

A common workplace benefit is not automatically a statutory right. The source of the benefit must be identified.

Not Sure Which Marriage Leave Rules Apply?

Your entitlement depends on your employment regime, contract, HR policy, nationality, and eligibility. Get your position checked before assuming a specific number of paid days.

Myth: “Everyone Working in Dubai Gets 10 Paid Days”

Dubai Decree No. 31 of 2025 is narrower than that. It applies to listed categories of UAE-national employees connected with the Government of Dubai.

The employee’s spouse must also be a UAE national. The employee must complete probation, submit a UAE-attested marriage contract dated after 31 December 2024, and meet the entity’s procedure. The decree does not turn every private Dubai job into a government role.

The 10-day rule depends on nationality, employer status, probation, the marriage date, and documentation.

Myth: “Unpaid Wedding Leave Is Automatic”

Unpaid leave is an option only when the employer agrees.

Article 33 requires employer approval. A worker without a separate wedding-leave benefit will usually request approved annual leave, agreed unpaid leave, or another arrangement such as flexible work. An unapproved absence should not be treated as protected marriage leave.

A wedding date does not remove the need for leave approval.

Myth: “An HR Promise Is Enough”

A verbal promise may not answer the questions that matter when payroll or attendance is reviewed.

The written policy should state whether the leave is paid, the number of days, whether they are calendar or working days, any probation rule, the documents required, the deadline for use, and whether the leave can be combined with annual leave.

Ask HR to identify the current policy version and confirm the approval in writing.

Why Marriage-Leave Entitlement Depends on the Employment Regime

Strip away the assumptions, and the practical test has four parts.

Applicable regime: Decide whether the role falls under federal private-sector law, Dubai Government rules, another public framework, DIFC, ADGM, or another special regime.

Written source: Find the decree, contract, handbook, or approved practice that actually grants the benefit.

Eligibility and timing: Check nationality, probation, marriage date, day-counting, and the period in which the leave must be used.

Approval and evidence: Submit the required marriage certificate or attestation and keep written approval and payroll records.

Is Your Employer Refusing Marriage Leave?

Before accepting a refusal or treating an absence as approved, check whether the benefit comes from UAE law, your employment contract, company policy, or a special employment regime.

Proof: What the Current Rules Actually Provide

Federal Decree-Law No. 33 of 2021 does not list marriage leave for the private sector. A private employer can still provide a more generous contractual or policy benefit, but the wording of that benefit controls.

Dubai Decree No. 31 of 2025 creates a distinct entitlement for eligible UAE-national Dubai Government employees. It provides 10 working days with an aggregate salary. The days may be used consecutively or intermittently within one year from the marriage-contract date, subject to the decree and entity procedure.

The answer is not one number for all UAE employees. It comes from the legal regime and the employee’s written terms.

Common Mistakes to Avoid

The most common errors come from applying one employer’s rule to everyone.

Assuming marriage leave is a federal private-sector right.
Applying the Dubai Government’s 10-day decree to every employee in Dubai.
Confusing a company wedding-leave benefit with statutory annual leave.
Treating unpaid leave as available without employer consent.
Relying on a verbal approval instead of the current written policy.
Ignoring DIFC, ADGM, or another special employment regime.
Missing the one-year use period under the Dubai Government decree.
