Who May Have To Pay For Building Defects

The search phrase Construction Defects Dubai covers claims against developers, contractors, and engineers. The right claim depends on the defect and your legal relationship with each party. Structural failures and faulty installations have different rules. Start by making the property safe and recording the problem. Then check the contracts, handover dates, and completion certificate. A repair promise does not remove the need to check deadlines. A lawyer and technical expert can help identify the responsible parties.

Record The Damage And Notify The Responsible Party

Arrange urgent help if the building presents a safety risk. Follow official safety directions and avoid entering unsafe areas merely to take photographs.

For a claim that can wait for inspection:

  • Photograph each defect and record the discovery date.
  • Tell the developer or contractor in writing.
  • Keep proof that the notice reached its recipient.
  • Arrange an independent technical inspection where needed.
  • Preserve damaged parts before nonurgent repairs.
  • Ask counsel to check the earliest possible filing deadline.

Describe the symptoms without guessing their cause. A ceiling stain may come from a pipe, waterproofing, or a common building system. Those causes can point to different duties.

Which Rules Govern Construction Defects Dubai Claims

Two legal routes need separate analysis. Developer liability under Dubai law concerns owners in jointly owned property, such as apartments sharing common areas.

Dubai Law No. 6 of 2019 on Jointly Owned Real Property applies across Dubai under Article 3. Article 40 sets the developer’s structural and installation duties.

The federal route concerns the engineer and contractor responsible for the work. Read the official Civil Transactions Law, Federal Decree-Law No. 25 of 2025, especially Articles 818–824.

This law took effect on June 1, 2026. Its contractor chapter runs from Articles 812–839.

Article 40 still refers to contractor provisions in the former 1985 Civil Code. Counsel should check how that reference works with the replacement law.

A buyer should not assume a direct claim against every project participant. The contracts, ownership position, and legal basis matter.

Separate Structural Failures From Installation Problems

A structural defect affects the building’s strength or safety. Cracking alone does not prove that legal test. An engineer should explain the cause and seriousness.

Under Article 40, the developer remains liable for structural defects for ten years from the completion certificate.

The developer’s liability for defective installations lasts one year. This covers installations such as mechanical, electrical, sanitary, and sewerage works.

That year generally starts on unit handover. If the owner does not take possession, Article 40 uses the completion certificate date.

Keep ordinary finishing problems separate from structural claims. A loose tile, faulty fitting, or paint defect may require a contractual claim. It does not automatically receive ten-year protection.

A hidden defect is a problem that was not reasonably apparent during inspection. Discovery after handover makes the original inspection records useful but does not establish liability by itself.

How the Engineer and Contractor Share Responsibility

Decennial liability means the statutory ten-year guarantee for qualifying buildings and fixed installations. Article 821 addresses total or partial collapse and defects threatening structural integrity and safety.

The engineer and contractor can be jointly liable. This means the law can hold them responsible together for the covered harm.

The guarantee starts when the owner takes delivery of the work. It can apply even where collapse results from defective land or the owner approved defective construction.

Article 821 contains an exception where the parties intended the structure to last less than ten years. Check that wording against the actual project.

Article 822 distinguishes the engineer’s role:

  • A design-only engineer answers for defects attributable to the design prepared, rather than execution methods.
  • A supervision-only engineer shares responsibility with the contractor for execution defects under that supervision.

Article 819 also addresses harm or loss resulting from the contractor’s work. Its exception concerns an unavoidable event.

Under Article 832, the main contractor remains responsible to the owner for subcontractors. Article 821 preserves the contractor’s separate recovery rights against them.

Calculate Each Deadline From The Correct Event

A limitation period is a legal deadline for bringing a claim. It differs from the period during which a statutory guarantee covers defects.

For the engineer and contractor, Article 824 bars a guarantee claim after three years from collapse or discovery of the defect.

Do not confuse these separate dates:

  • Developer structural liability: ten years from the completion certificate.
  • Developer installation liability: one year from handover, subject to Article 40’s possession rule.
  • Engineer and contractor guarantee: ten years from delivery of the work.
  • Guarantee claim deadline: three years from collapse or defect discovery under Article 824.

Article 40 does not state its own deadline for suing the developer. Do not automatically apply Article 824 to that separate claim.

Ask counsel to calculate all potentially relevant deadlines. Keep the first complaint, inspection report, and repair correspondence. These may help establish when the problem became known.

What Can Be Done Before Construction Finishes

Article 818 provides a route for defective work during performance. The owner can require compliance and correction within a reasonable period set by notice.

If the contractor fails to correct matters, the owner must establish the condition of the work. The owner may then seek the remedies the article provides.

These include ending the contract or using another contractor for completion or correction at the first contractor’s expense.

The article also permits an immediate termination request in specified serious cases:

  • Correction is impossible or conflicts with the contract terms.
  • Delay makes completion within the agreed period clearly unlikely.
  • Conduct shows an intention not to perform.
  • The contractor makes performance impossible.

Article 825 addresses unjustified refusal of delivery after formal notice. A contractor is not liable for later loss or damage occurring without its fault or negligence.

Do not treat every unfinished item as grounds for immediate termination. Follow the contract and obtain advice before replacing the contractor or denying site access.

Build An Evidence File That Explains The Loss

A useful expert report should connect the observed defect with its likely cause. It should explain the repair method and identify any urgent protective measures.

Give the expert and lawyer:

  • The sale agreement and construction contract, if available.
  • Approved drawings and specifications.
  • The completion certificate and handover records.
  • Inspection reports and the original snagging list.
  • Dated photographs and repair histories.
  • Notices, replies, and access requests.
  • Repair quotations, invoices, and proof of related losses.

Snagging means recording unfinished or defective items near handover. A snagging list helps document the condition, but it may not identify a hidden structural cause.

Separate estimated repair costs from amounts already paid. Explain any loss of use with actual records. Avoid claiming the same expense twice through different legal routes.

Choose Where To File The Defect Claim

Jurisdiction means the legal authority to hear a dispute. Article 42 gives the Rental Disputes Settlement Centre exclusive jurisdiction over disputes concerning rights and obligations under Law No. 6 of 2019.

That rule should be considered separately from a construction contract claim against an engineer or contractor. Check the contract’s court or arbitration clause.

Arbitration means submitting a dispute to an agreed private tribunal. Article 42 does not resolve every question about an arbitration clause’s effect. Obtain advice on the particular claim.

Protect Rights When Discussing Repairs

Article 823 makes clauses excluding or limiting the engineer’s or contractor’s covered guarantee void, meaning they have no legal effect.

Article 40 also invalidates later agreements contradicting the developer’s statutory liability. It preserves owners’ other rights under relevant legislation.

Still, review any settlement, release, or acceptance form before signing. Identify the defects covered, the repair standard, inspection access, and the proposed completion date.

For a focused review, send the handover records and defect chronology through WhatsApp. Avoid sending an unstructured collection of photographs without dates or locations.

Check Older Projects Against The Transition Rules

The new law’s effective date does not decide every issue alone. Article 4 generally prevents retroactive application to earlier facts and acts.

Articles 6 and 7 address limitation transitions. New rules apply to periods still running, while older rules govern earlier commencement, suspension, and interruption.

A shorter new period generally starts from June 1, 2026. A shorter remaining period under the former law can still control.

Older commentary often cites Articles 880 and 883 for the guarantee and filing period. The corresponding current provisions are Articles 821 and 824. Counsel must identify which text applies.

Questions Owners Ask About Defect Liability

Can A Developer Be Liable For Construction Defects?

Yes. Article 40 addresses structural defects and defective installations in jointly owned property. The applicable period depends on the defect category and relevant starting date.

What Is The Difference Between Snagging And A Structural Defect?

Snagging records incomplete or defective items. A structural claim requires the relevant legal test, supported by technical evidence. A finishing defect does not automatically threaten building safety.

How Long Do I Have To File A Construction Defect Claim?

Article 824 provides three years from collapse or discovery for the covered guarantee claim. Other claims require separate deadline analysis. Do not wait for informal repairs to finish.

Can The Contractor Blame A Subcontractor?

The main contractor remains responsible to the owner under Article 832. Its separate claim against a subcontractor does not automatically defeat the owner’s rights.

Can Structural Liability Be Excluded In The Contract?

Article 823 invalidates exclusions or limits on the covered engineer and contractor guarantee. Article 40 separately protects the developer liability it establishes.

Is Expert Evidence Needed For A Defect Claim?

It is often important to explain cause, seriousness, and repair costs. The evidence needed depends on the dispute and forum. Photographs alone may not establish structural failure.

Preserve The Earliest Discovery Evidence
