How Service Charges Are Calculated and Set in Dubai
Service charges in Dubai are calculated based on an approved annual budget prepared by the Management Entity and approved by RERA. The budget covers the cost of maintaining and operating common areas including lifts, lobbies, pools, gyms, parking, security, landscaping, utilities and building insurance.
Each unit owner pays a share proportionate to the size of their unit relative to the total building. The approved service charge rate is listed on the RERA service charge index which is publicly available and updated annually. A management entity that charges more than the RERA-approved rate is acting outside its authority.

What Service Charges Must and Must Not Cover?
Service charges must cover the maintenance and operation of common areas only. They cannot include costs relating to individual units, costs for services not provided, or charges that were not in the RERA-approved budget. When a management entity includes unauthorised items in the service charge demand, owners have the right to challenge the calculation. We have represented owners who were being charged for costs that had no basis in the approved budget and recovered the difference.

Unpaid Service Charges
Under Dubai Law No. 6 of 2019, the management entity has the right to recover unpaid service charges from unit owners. The recovery process involves a formal demand followed by a claim through the RERA complaints system or through the Dubai courts. Courts in Dubai treat service charge arrears as a debt owed by the unit owner.
Judgments for unpaid service charges can be enforced against the owner’s assets. An unpaid service charge can also block the transfer of the unit at the DLD in some circumstances — the new buyer cannot register the property until outstanding service charges are cleared. Challenging a Service Charge
An owner who believes a service charge demand is incorrect has the right to challenge it. The first step is to request a copy of the RERA-approved budget and the actual expenditure. If the charge exceeds the approved amount or includes items not in the budget, a formal complaint to RERA can trigger an investigation.

The Legal Framework
Dubai Law No. 6 of 2019 on the Ownership of Jointly Owned Properties in the Emirate of Dubai replaced the older Strata Law No. 27 of 2007 and significantly restructured how shared buildings are managed. Under this law, jointly owned properties must have a management entity that runs the building’s day-to-day operations and an owners committee that represents the interests of unit owners and oversees the management entity. RERA supervises both. The law also governs the Statement of Building Management, which is the binding document that sets out the rules, obligations, and service charge structure for the building.
The Three Parties in Every Strata Dispute
Most strata disputes in Dubai involve three parties. The unit owners are the individuals who own apartments, offices, or shops in the building. The Owners Committee is an elected body of owners who oversee the management of the common areas. The management entity is the licensed company appointed to manage the building. How RERA Handles Owners Association Disputes in Dubai
RERA oversees all owners’ associations and management entities in Dubai under Dubai Law No. 6 of 2019. When an owners’ association dispute cannot be resolved internally, RERA is the primary regulatory body with authority to intervene.
Filing a RERA Complaint
RERA complaints about owners’ association matters can be filed through the Dubai REST platform or through the DLD service channels. A complaint against a management entity should document the specific breach, the service charge discrepancy, or the maintenance failure with supporting evidence, including the Statement of Building Management, service charge demands, correspondence, and inspection reports. RERA reviews the complaint and contacts the management entity. If the management entity is in breach, RERA can issue a formal warning, impose a fine, or require specific remedial action.
What RERA Can and Cannot Do
RERA can require a management entity to correct service charge calculations, carry out maintenance work, provide financial accounts, and comply with the Statement of Building Management. RERA can impose fines for regulatory breaches. In serious cases, RERA can direct the replacement of a non-compliant management entity. What RERA cannot do is award financial compensation directly to an individual owner for losses suffered. Financial compensation claims for losses caused by management failures require court proceedings.
