Start With The Bank And Preserve The Transfer Record

A wrong bank transfer in the UAE search usually concerns money sent to an unintended recipient. Contact your bank immediately and ask whether the payment can be stopped or recalled. A recipient generally cannot keep money without a lawful basis. Recovery depends on the transfer status, evidence, and applicable law. Save the payment record and explain the mistake clearly. If bank assistance fails, legal action may be needed. Do not assume that spending the money removes the repayment duty.

Request A Trace Or Recall Without Delay

A payment recall is a request to recover a transfer already sent. It is different from canceling an instruction that has not yet been processed.

Contact the bank through its official app, branch, or verified telephone number. Give it:

  • The transaction reference and payment date.
  • The amount and currency.
  • The destination account details entered.
  • The intended recipient’s correct details.
  • A short explanation of the error.

Ask for a complaint reference and written confirmation of the next steps. Ask whether the bank needs a signed recall request or further evidence.

Do not send another payment to correct the mistake until you understand what happened. A second transfer can increase the amount at risk.

How The Law Addresses A Wrong Bank Transfer UAE Claim

Restitution means returning a benefit received without a proper legal basis. The relevant civil rules appear in the official Civil Transactions Law, Federal Decree-Law No. 25 of 2025.

The law took effect on June 1, 2026. Its provisions do not mention bank transfers by name. A lawyer must connect the facts to the correct rule.

Three possible routes should be kept distinct:

  • Article 274 addresses taking another person’s property without lawful grounds.
  • Articles 275–279 address payment made to perform something that was not due.
  • Articles 246 and 255 may support compensation for additional proven harm.

A payment to an unrelated account may fit Article 274. A payment against an obligation later found not to exist may fit the undue-payment provisions.

These routes can overlap factually. They should not produce duplicate recovery for the same loss.

When The Recipient Must Return The Money

Article 274 requires repayment where property was acquired without the required legal basis. It also addresses benefits and gains from that property.

Article 275 requires return of an undue payment that remains available. If it no longer exists, the recipient must restore its equivalent or value.

For money, that generally means returning the corresponding amount. Spending the transfer does not, by itself, answer an ordinary repayment claim.

However, the legal basis must still be established. The recipient may say the transfer paid an invoice, repaid a loan, or fulfilled another obligation.

Collect the documents showing why that explanation is wrong. A statement records the amount transferred between accounts. It may not explain why the payment was made.

Exceptions That Need Careful Review

The law contains exceptions to straightforward recovery. They should be checked before sending an absolute demand.

Under Article 275, a payer who knew the payment was not due generally cannot reclaim it under that provision. Limited legal capacity or coercion can change the result.

Legal capacity means the ability to make legally effective decisions. Coercion means improper pressure that forces the payment.

Article 276 permits recovery in specified situations:

  • The expected basis for the obligation never arose.
  • That basis existed but later ceased.
  • Payment was made before its due date without knowing about the agreed term.

Article 279 limits recovery from a recipient lacking contractual capacity to the enrichment actually obtained. Enrichment means the financial benefit retained or received.

Article 277 concerns paying another person’s debt to a creditor acting honestly. Recovery from that creditor can be barred after specified changes in its position.

These include losing debt documents or collateral securing payment, or allowing the claim against the true debtor to expire. The payer may then have a claim against that debtor.

Why The Recipient’s Knowledge Matters

Good faith generally concerns honest conduct without knowing the payment was not owed. Article 278 treats recipients differently according to their knowledge and refusal to repay.

An honest recipient generally returns what was received. If that person refuses repayment, Article 278 adds specified gains and personal benefits from the claim’s filing date.

For a recipient acting in bad faith, those consequences can run from receipt or the date bad faith began.

The article also addresses benefits that were not obtained. The calculation requires evidence and legal analysis. It is not a guaranteed interest rate on every mistaken transfer.

Keep the message that first explained the mistake. Record replies, acknowledgments, and any promise to return the funds. Do not edit or selectively crop the conversation.

Separate A Bank Complaint From A Recipient Claim

A complaint about the bank’s handling of the transfer is different from demanding repayment from the recipient. Sanadak is the UAE’s financial and insurance complaints body.

Its official complaint submission and eligibility page explains when a bank complaint can be escalated.

Its eligibility check asks whether:

  • You first submitted an official complaint to the financial institution.
  • Fifteen calendar days have passed.
  • No written response arrived, or the response was unsatisfactory.
  • The complaint meets the other eligibility requirements.

Court proceedings can affect eligibility. Check the current rules before pursuing both routes.

A bank complaint addresses the institution’s conduct. It should not be presented as an automatic order forcing an unrelated recipient to repay.

Ask the bank to explain what it did, what response it received, and what remains unresolved. Avoid assuming a recall request guarantees recovery.

RouteWhat It AddressesEvidence to Prepare
Bank recallWhether a sent payment can be recoveredTransfer receipt and bank reference
Bank complaintHow the bank handled the transfer or recallOfficial complaint and written response
Civil claimWhether the recipient must repayEvidence of the mistake and recipient communications

Assemble Proof That The Transfer Was A Mistake

A clear evidence file should explain the intended payment and the actual destination. Put events in date order.

Include:

  • The transfer receipt and relevant bank statements.
  • The account details used and the intended details.
  • The invoice or instruction that should have been followed.
  • Messages showing how the error occurred.
  • The bank complaint and recall references.
  • Recipient replies, if lawfully available.
  • Proof of any repayment already received.
  • Documents supporting further financial loss.

For a business transfer, identify who authorized the instruction. Preserve the approval trail and the original payment request.

Do not publish the recipient’s account details or accuse them online. Share sensitive financial evidence through appropriate banking and legal channels.

Calculate The Civil Filing Periods Separately

A limitation period is the deadline after which a court may refuse to hear the claim. Waiting for a bank response does not justify ignoring it.

Article 290 governs this category of restitution claims. It provides three years from learning of the recovery right. It also sets an outer fifteen-year period from that right arising.

A separate harmful-act compensation claim has its own rules under Article 258. Its three-year period concerns knowledge of the harm and the responsible person.

That article also contains an outer fifteen-year period. A related criminal case can affect the stated rule in qualifying circumstances.

Have counsel identify the correct starting date for each proposed claim. Do not assume every demand letter or complaint stops the clock.

Additional Loss and Possible Criminal Issues

Compensation beyond the transfer requires its own legal basis and proof. Article 255 addresses loss suffered and lost profit that naturally result from the harmful act.

Document any extra expense and explain how the conduct caused it. The amount claimed should not be an unsupported estimate of inconvenience.

Keeping money sent by mistake is not automatically a criminal offense in every case. Knowledge, conduct, and the applicable criminal provisions must be assessed.

If deception caused the transfer, Article 247 addresses harm resulting from deception. Fraud allegations can also raise separate criminal and procedural questions.

Explain honestly whether you selected the wrong account or followed false instructions. These are different factual problems, even where recovery steps overlap.

Check Payments Made Before June 2026

The transition rules matter for older transfers. Article 4 generally prevents the new Civil Transactions Law from applying retroactively to earlier facts and acts.

Articles 6 and 7 separately address limitation periods still running when the new law began. Earlier commencement, suspension, and interruption remain subject to the former rules.

A shorter new period generally begins from June 1, 2026. If the old period’s remainder is shorter, that remainder may control.

Give counsel the payment, discovery, complaint, and acknowledgment dates. Do not replace older article references without checking which law governs the event.

Questions Senders Ask After A Mistaken Transfer

How Do I Recover Money Sent To The Wrong Account?

Contact the bank immediately, request a trace or recall, and preserve the receipt. If repayment fails, legal advice can identify a civil claim and any separate complaint route.

Can A UAE Bank Reverse A Completed Transfer?

Do not assume an automatic reversal. The payment system, settlement status, recipient response, and any legal authority matter. Ask the bank for the available recovery process.

Can I Cancel An Aani Payment After Sending It?

A completed instant payment should not be treated as a pending instruction. Contact the participating bank immediately and ask about the applicable mistaken-payment recovery process.

What If The Recipient Has Spent The Money?

Articles 274 and 275 address equivalent-value repayment where applicable. Spending the funds alone does not remove the duty. Special defenses and capacity issues still require review.

Can Sanadak Help With The Bank’s Response?

It may consider an eligible complaint about a licensed financial institution. Follow its complaint requirements. A complaint about bank conduct differs from a civil claim against the recipient.

What Should I Do If Unexpected Money Reaches My Account?

Tell your bank and leave the funds untouched pending verified instructions. Do not send money to a stranger’s alternative account or disclose security codes.

Preserve The Receipt Before The Trail Goes Cold

Act promptly on the recall request and keep a dated record of every response. Recovery depends on proof of the mistake and the correct legal route.
