Federal Decree Law No 41 of 2022

Federal Decree-Law No. 41 of 2022 on Civil Personal Status applies to non-Muslim UAE citizens and non-Muslim foreign residents within Article 1.

The petition should still address jurisdiction, marriage proof, identity, children, and any related financial claims. No-fault divorce does not eliminate procedural requirements.

Financial applications may involve separate facts and expert evidence. A divorce judgment does not automatically resolve every property, support, or debt issue.

Foreign recognition should be planned before filing. The wording and finality of the UAE order may affect registration or recognition in another country.

Joint Custody and Child Arrangements

The civil framework begins from joint custody after divorce. Cabinet Resolution No. 122 of 2023 provides procedures for custody applications and related decisions.

Cabinet Resolution No. 122 of 2023 also addresses child support and related financial matters. Salary, assets, expenses, marriage duration, age, and circumstances may require proof.

Submit reliable financial documents. Bank statements, salary certificates, company records, leases, school fees, medical bills, and debt documents should be organized by date.

Do not conceal assets or provide unsupported estimates. Incomplete disclosure can delay expert work and undermine credibility.

Inheritance and Wills for Non Muslims

Article 11 of the 2022 law permits a testator within its scope to leave UAE property by will, subject to the Executive Regulations. A registered will can change the default result.

Without an effective will, Article 11 provides a civil distribution. Half passes to the surviving spouse, while the other half is shared equally among children without gender distinction.

Different rules apply where there are no children. An heir of a foreign deceased may also request another applicable succession law, unless a registered will provides otherwise.

Dubai Law No. 15 of 2017 separately regulates wills and estates of non-Muslims in Dubai, including registered wills at Dubai Courts and the DIFC Courts.

Federal Decree-Law No. 41 of 2024 states a 30-day appeal and cassation period for personal status judgments governed by that law. Other procedural rules may apply to a civil case.

Do not assume every decision uses the same period. Obtain advice immediately after any judgment, order, or notification and keep proof of the relevant date.

Enforcement is a separate stage. Payment, custody, visitation, document delivery, and other orders may require applications before the Personal Status Execution Judge.

A settlement should identify how each obligation will be performed and enforced. Vague wording creates difficulty after the case appears finished.
