A divorce settlement with special needs child uae should address custody, maintenance, treatment, and future guardianship. Article 123(2) continues custody beyond 18 for specified mental incapacity or a person bedridden because of illness. The person’s interests may require a different arrangement.
Article 106(2) addresses an adult son unable to earn because of disability or otherwise, where he lacks property. Other child-maintenance categories remain subject to Article 106.
This guide covers the Personal Status Law. Non-Muslim couples under the civil personal status law follow Article 9 of that law for financial requests.
The Personal Status Law discussed here is Federal Decree-Law No. 41 of 2024.
Summary
A settlement should identify the child’s custody arrangements, treatment, maintenance, housing, insurance, and future representation needs. Custody ordinarily ends at 18, but Article 123(2) provides exceptions for specified mental incapacity or illness-related bedridden status. The person’s interests remain relevant.
Article 106(2) separately addresses an adult son unable to earn who lacks property. A disability diagnosis does not automatically establish legal incapacity. Medical travel, changes in maintenance, and enforceability should be addressed under the applicable statutory conditions.
Planning A Divorce Settlement With Special Needs Child UAE
| Issue | Legal Position And Source |
|---|---|
| Custody after 18 | Custody ordinarily ends at 18. Article 123(2) continues custody for the specified mental incapacity categories or a person bedridden because of illness. It continues with the custodian or next entitled person, unless the person’s interests require otherwise (Article 123). |
| Maintenance covers | Food, clothing, housing, treatment and education, according to custom (Article 95). |
| Adult child unable to earn | Article 106(2) addresses an adult son unable to earn because of disability or otherwise, if he lacks property. Other child-maintenance categories remain subject to Article 106 (Article 106(2)). |
| Setting the amount | The court considers the paying parent’s means, the child’s condition and the economic situation (Article 96). |
| Changing maintenance | An increase may be retrospective for no more than six months. A reduction is not retrospective and ordinarily runs from the judgment, unless the court specifies another date. A variation claim generally requires one year after finality, unless the court finds exceptional circumstances (Article 97). |
| Priority | Continuing maintenance from the date of the claim is a privileged debt (Article 98). |
| Travel for treatment | Article 116(2) permits court-authorized travel beyond 60 days annually for the child’s interests, treatment, or qualifying necessity. The required hearing of the other parent or relevant guardian must occur (Article 116(2)). |

What To Include In The Settlement
A settlement is stronger if it names the child’s specific needs and who pays for each.
- Custody and who the child lives with, and how visitation works around his care routine (Article 121).
Urgent protective needs may require emergency child custody applications.
- The cost of treatment, therapy, equipment, medication and special education, and how it is shared or adjusted over time.
- Housing suited to the child’s needs.
- Travel for medical treatment, including consent for the child’s passport and trips (Articles 116 and 117).
- Health insurance and who maintains it, because Dubai’s health insurance law makes the sponsor responsible for dependents.
- A review mechanism, since the court allows changes in the amount only on the terms of Article 97.
- What happens at 18: who acts for the child, who keeps custody and who pays.
The recurring financial obligations are addressed in child maintenance in the UAE.
Guardianship After 18
A child who lacks capacity may need a guardian after 18.
- Article 125 governs the statutory categories of incapacity and partial capacity. A disability diagnosis alone should not be treated as establishing legal incapacity.
- Civil Transactions Law Article 154 addresses interdiction by law for the specified mental incapacity categories. Article 155 addresses court-ordered interdiction for prodigality or impaired judgment. Their conditions and the timing of disputed acts must be distinguished.
- Article 126 permits a court-appointed tutor for a specified period, an indefinite period, or a particular task. The court may appoint the mother over the minor’s property.
- A guardian who misuses the minor’s money can be punished by imprisonment and a fine of AED 5,000 to AED 100,000, or either (Article 251).
Separate representation arrangements may require obtaining legal guardianship in the UAE.
