WhatsApp legal rules UAE users need to follow are mostly the rules of the Cybercrimes Law, and they apply to private chats and groups as much as to public posts. The law punishes insulting, threatening, exposing private information and spreading certain false news over an information network, and it does not exclude a message because it was sent in private. Read the Cybercrimes Law on the UAE legislation portal.

Quick Answer

WhatsApp legal rules in the UAE can apply to both private and group messages. Threats, insults, privacy violations, impersonation, fraud and certain unauthorised sharing of personal data may constitute offences under Federal Decree-Law No. 34 of 2021 on Combating Rumours and Cybercrimes.

Forwarding a message is not automatically illegal, but its content and circumstances matter. Preserve original chats and relevant evidence, avoid sharing private material without authorisation, and obtain legal advice before relying on screenshots or recordings in a dispute.

WhatsApp Legal Rules UAE Users Should Know

Forwarding, Groups And What An Admin Owes

Forwarding is not automatically an offence. Article 52 punishes false news only when it would:

  • incite public opinion;
  • disturb public peace;
  • spread terror;
  • or harm:
    • the public interest;
    • the economy;
    • public order;
    • or public health.

The penalty is at least one year in prison and a fine of at least AED 100,000, and re-disseminating counts as much as creating.

Forwarding someone’s personal data is a separate risk. Article 6 covers anyone who disseminates or re-disseminates personal data without permission, and keeping data you know was obtained illegally is also an offence.

Some guides say a group admin is liable once they know of illegal content, but the text says otherwise. Article 53 applies to someone who makes illegal content available and does not remove it within the period in an order issued to them, or who refuses such an order. Ask a lawyer whether it reaches a group admin.

Business Messages And Customer Data

Businesses face two sets of rules: consent for data and honesty in advertising.

If YouThe RuleSource
Message customers who have not agreedProcessing personal data without consent is prohibited, with listed exceptions. Consent must be provable, clear and easy to withdraw.Data protection law, Arts 4, 6

Advertise with inaccurate informationPromoting goods or services through a misleading advertisement online is an offence.Cybercrimes Law, Art 48

The data protection law is Federal Decree-Law No. 45 of 2021. Its text leaves some details to regulations that I could not find on the official portal, so check the current position.

Screenshots, Recordings And Evidence

In criminal cases, electronic evidence has the same probative force as physical forensic evidence (Cybercrimes Law, Article 65). In civil and commercial disputes, the Evidence Law recognises electronic evidence when its conditions are met. The origin and integrity of a message matter.

Recording or transmitting a conversation to invade someone’s privacy, without consent, is an offence (Article 44). Be careful before you record a call or share a private chat.

  • Keep the whole conversation, with dates, times and phone numbers, and not only a cropped screenshot.
  • Export the chat and keep the original device and backup.
  • Do not edit, crop or annotate the original files.
  • Do not forward the messages to others. Give them to the police or your lawyer.

Calls And The Telecom Rules

Voice and video calls over the internet are a separate regulatory matter. The telecoms regulator has said such services must comply with the UAE’s licensing framework, and WhatsApp’s calling feature has not been generally available. Check the regulator’s current list of approved applications.

Frequently Asked Questions

▼ Are Private WhatsApp Chats Covered By The Cybercrimes Law?
The law punishes insults, threats and privacy invasion committed through an information network or system, and it does not exclude private chats (Articles 42 to 44).
▼ Can I Be Punished For Forwarding A Message?
Only in the cases the law lists, such as false news with the effects in Article 52, or personal data shared without permission under Article 6. A forward can also repeat an insult under Article 43.
▼ Is It An Offence To Take A Screenshot Of A Chat?
Not by itself. The offence in Article 44 requires an intention to invade someone’s privacy, without consent, in cases the law does not authorise. Sharing the screenshot to harm someone is the risk.
▼ Can The Other Side Settle?
For insult, threats, privacy invasion and several other offences, the accused can rely on an amicable settlement with the victim before the judgment becomes final (Article 68).

Final Takeaway

WhatsApp legal rules in the UAE depend on what a person sends, records, forwards or discloses. Private conversations are not automatically exempt from cybercrime or privacy laws. Businesses must also consider personal data protection and advertising obligations. Keep original evidence intact, avoid unauthorised disclosure and seek case-specific legal advice where messages may have legal consequences.
