The Legal Limits on Cancelling a Cheque

A cheque can be cancelled after signing in the UAE only in limited circumstances. If it is still in your possession, you can void or destroy it. Once handed over, the Commercial Transactions Law, Federal Decree-Law No. 50 of 2022, restricts stop-payment instructions to specific cases: loss or theft of the cheque, and the holder’s bankruptcy.

Instructing the bank not to pay outside those cases, closing the account or emptying it before presentment, or deliberately signing so the cheque cannot be paid are all acts listed in Article 675. They carry imprisonment of six months to two years and/or a fine of at least 10% of the cheque value (minimum AED 5,000, maximum twice the value). If you believe the holder has no right to the money, the lawful route is to retrieve the cheque by agreement or raise the dispute through legal proceedings.

Establish the Position of the Actual Cheque

Locate your cheque record and identify the number, amount, date, and named payee. Check whether the instrument was handed over and what correspondence accompanied delivery. If you issued several cheques for the same relationship, record each separately. A request about one cheque should not be confused with a request to retrieve every cheque the other party holds.

Keep a note of what has happened to an unused cheque you void or destroy while it remains with you. Cancelling a Post-Dated Cheque in the UAE

Post-dated cheques are common for rent and installments. The date on the cheque does not give the drawer a right to cancel it before that date. If you want to cancel a post-dated cheque, agree its return with the holder and get written confirmation, for example as part of a tenancy termination or loan settlement.

Document the Return and Any Remaining Disagreement

When the cheque is returned, match it to the number and other details in your records and obtain the signed acknowledgment described above. Keep the return confirmation with the agreement and proof of completion. If several cheques were held, record which have been returned and which remain outstanding so an incomplete handover does not go unnoticed.

If the holder refuses to return the cheque, preserve the refusal and the reason given. Explain to your adviser what you have already requested and what evidence you provided. Repeated demands using stronger language may add little if the real disagreement is about whether the obligation has ended. A clear record helps focus the assessment on that issue.
