Can your landlord cut off AC over unpaid rent? In Dubai, Article 34 prohibits landlords from disconnecting services or disturbing the tenant’s use of the property. The prohibition contains no unpaid-rent exception.

The landlord must use notice and court procedures under Dubai Law No. 26 of 2007, as amended by Law No. 33 of 2008.

This article addresses Dubai tenancy law. Other emirates have separate tenancy regimes and require a separate legal assessment.

Summary

In Dubai, unpaid rent does not allow a landlord to disconnect AC or other property services. Article 34 prohibits service disconnection and interference with the tenant’s use of the property. Other emirates require separate assessment under their tenancy regimes.

Rent recovery and eviction must follow the legal route. The usual unpaid-rent period is 30 days after the required notice, unless otherwise agreed. Tenants can document interference, seek police assistance, and pursue the applicable Rental Disputes Center remedies.

Can Your Landlord Cut Off AC Over Unpaid Rent?

Article 34 sets a clear prohibition with no exception for unpaid rent.

IssueLegal Position And Source
Disconnecting servicesThe landlord may not disconnect services from the property or disturb the tenant in his use of it. The rule applies even when rent is overdue (Dubai Law 26/2007, Art 34).
Unpaid rentArticle 25(1)(a) ordinarily allows eviction proceedings if rent remains unpaid 30 days after notice. The parties may agree otherwise. The notice must comply with the applicable service requirements (Dubai Law 26/2007, as amended).
Eviction judgmentA tenant is removed only through a judgment, which is executed through the competent tribunal (Dubai Law 26/2007, Art 35).
Where it is decidedThe Rental Disputes Center, established by Decree 26 of 2013, hears tenancy disputes in Dubai (Decree 26/2013).
Harm to the tenantHarmful acts can create compensation liability. Recoverable loss includes damage suffered and lost profit that naturally results from the act (Civil Transactions Law, Arts 246, 255).

Disconnection does not itself settle questions about ending a tenancy contract early.

What A Landlord Can Do About Unpaid Rent

  • Serve the required notice to pay, ordinarily allowing 30 days unless otherwise agreed. Follow the statutory notification requirements.
  • If the rent is still unpaid, file an eviction and rent recovery case at the Rental Disputes Center.
  • Keep the contract, the Ejari registration, the notice and the proof of service.
  • Enforce the judgment through the execution department. Do not change locks, cut services or remove property yourself.

What A Tenant Can Do If The AC Is Cut

A refund claim may require distinguishing different types of property deposits.

  • Document the disconnection with dated photos or video, messages and the dates the service stopped.
  • Send the landlord a written demand to restore the service, citing Article 34.
  • Report the interference to the police station responsible for the property’s location. Article 34 permits seeking cessation or an official record of the interference.
  • Apply to the Rental Disputes Center for restoration and compensation, supported by the interference records. Civil Transactions Law Articles 246 and 255 address harmful-act compensation.
  • Keep paying the rent that is due. Withholding it gives the landlord a ground for an eviction notice under Article 25(1)(a).

Which Civil Transactions Law Applies

The cited harmful-act provisions are in Federal Decree-Law No. 25 of 2025, effective June 1, 2026. Earlier events require transitional analysis.
