The question “how can a father lose visitation rights uae” is decided through a court assessment of the child’s interests. A father can lose visitation rights or have them limited only through a court decision based on the child’s interest.

The Personal Status Law has no rule that ends visitation automatically. It gives the non-custodial parent the right to visit the child, with the court regulating how, when and where (Article 121 of Federal Decree-Law 41/2024).

Guardianship over the child is separate, and the court can remove it in specific cases.

This guide covers the Personal Status Law, which applies to Muslims and others it covers. Non-Muslims under the civil personal status law follow a different framework, which this guide does not cover.

Quick Answer

A father does not automatically lose visitation rights in the UAE because of divorce, disagreement with the mother or unpaid maintenance. Under Article 121 of Federal Decree-Law No. 41 of 2024, the court regulates visitation according to the child’s interests and may restrict contact where the circumstances justify it.

Visitation and guardianship are separate legal matters. Articles 153 and 154 provide grounds for removing guardianship, including specified offences against a child, serious neglect and danger to the child’s welfare. Any dispute over visitation should be addressed through the court rather than by a parent unilaterally stopping an existing arrangement.

What the Law gives a non-custodial parent

Article 121 sets the visitation right and leaves the details to agreement or to the court.

  • A parent who does not have custody may visit the child, ask for the child to visit him, take the child out and have overnight stays, as the parents agree.
  • If they disagree, the court decides what it sees fit according to the child’s interest (Article 121(1)).
  • The court may order the custodian or the parent with visitation to pay travel costs within the UAE (Article 121(3)).
  • With the parents’ agreement, the execution judge can change the times and places of visitation (Article 121(4)).
  • If the custodian refuses to comply, the court’s judgment is enforced by force (Article 121(5)).

The Dubai Court of Cassation’s General Assembly addressed overnight stays in Appeal 8/2021 (10 November 2021). It held that a child’s overnight stay is normally with the custodian. A judge may allow an overnight stay at the other parent’s home if the child’s interest requires it.

The Law does not list grounds for ending visitation. The court shapes or restricts visitation by the child’s interest, and the father’s conduct matters through that test.

Guardianship: when a father can lose it

Guardianship over the person is separate from visitation. The Law lets the court remove it in two groups of cases.

TypeCasesArticle
Mandatory removalThe guardian no longer meets the conditions. He neglects the duties of guardianship or cannot perform them. The minor’s property is at risk. He commits rape or indecent assault, or leads the minor or another person into prostitution. He receives a final judgment for an intentional felony or misdemeanour against the minor153
Discretionary removalThe child is exposed to serious danger to safety, health, honour, morals or education because of ill-treatment, a bad example (such as a notorious corrupt life or addiction to alcohol or drugs) or lack of care. No conviction is needed. The removal can be total or partial, permanent or temporary154(1)
AlternativeThe court can place the child with a specialised institution while the guardian keeps his guardianship154(2)
Temporary placementThe court, on its own or at the investigating authority’s request, can temporarily place the minor with a trusted person or institution155

Other rules that affect contact with the child

  • A custodian parent can take the child abroad only with the other parent’s written consent, or with the court’s permission for up to 60 days a year (Article 116).
  • The guardian keeps the child’s passport and hands it to the custodian when the child travels, and the court can order it to stay with the custodian if the guardian is obstructive (Article 117).
  • When the child reaches 15, he may choose which parent to live with unless his interest requires otherwise (Article 122).
  • Visitation procedures are also set in the Federal Judicial Council’s regulation on the visitation of children (Resolution 68/2025).

Questions about a father’s visitation rights

Can a father be denied visitation in the UAE?
Only by a court decision based on the child’s interest. The Personal Status Law gives the non-custodial parent the right to visit and lets the court regulate it (Article 121).
Can the mother stop visitation herself?
No. If the custodian refuses to follow a court judgment on visitation, the judgment is enforced by force (Article 121(5)).
Can a father have the child overnight?
The parents can agree to overnight stays. If they disagree, the court decides by the child’s interest. The Court of Cassation has allowed overnight stays at the non-custodial parent’s home where the child’s interest requires it.
Can a father lose guardianship?
Yes, in the cases in Articles 153 and 154, such as a final conviction for an intentional offence against the child or serious danger to the child from ill-treatment, a bad example or neglect.
Does unpaid maintenance end visitation?
Article 121 does not make visitation depend on paying maintenance. Maintenance is a separate claim with its own enforcement (Articles 98 and 100).
