If a child is in danger now, call the police on 999. Knowing how to get emergency custody of a child in uae starts with asking the court for an urgent or temporary order, because the law has no separate procedure called emergency custody. The Personal Status Law exempts urgent and temporary custody orders from Family Guidance (Article 8), and it lets the court act by order on petition.

This guide follows the Personal Status Law (Federal Decree-Law No. 41 of 2024), which applies to UAE citizens where one or both parties are Muslim, to non-Muslim citizens unless special provisions or another permitted law apply, and to non-citizens unless one asks for his or her own law (Article 1). A section below covers non-Muslims.

The Remedies Are Different

Four remedies are often confused. They are not interchangeable.

RemedyWhat It Is, and What It Is NotArticle
Urgent or temporary custody orderAn order about who cares for the child while the main case is pending. These orders are exempt from family guidance. A dispute over the child’s interest goes to the Judge of Summary Matters (the urgent matters judge), who decides by order on a petition.8, 6, 112
Temporary protective placementWhere the grounds for depriving a guardian of guardianship exist, the court can temporarily entrust the child to a trustworthy person or a competent institution until the guardianship issue is decided. It concerns the guardian, and it is not an order allocating custody.155
Revocation of guardianship over the personMandatory in the cases in Article 153, such as a lost condition, failure of duties, property at risk, sexual offenses against the ward, or a final conviction for an intentional crime against the ward. Discretionary under Article 154 for serious risk from mistreatment, a bad example, or addiction. The court can place the child in an institution instead while guardianship continues.153, 154
Lapse of the custodian’s rightA custodian’s rights lapse if a condition is lost, the duties are not performed, or she moves to a place of residence where the child’s interest is lost. This is decided in the main case, and the person can apply again if the reason ends.115

Revoking guardianship over the person also ends or suspends guardianship over the property, and guardianship passes to the next in line if qualified (Articles 162 and 163).

Other Situations The Law Covers

Violence, travel, and handover raise separate legal routes.

SituationWhat The Law ProvidesArticle
Violence or abuse at homeReport it. The public prosecution can issue a restraining order. The Ministry, the competent authority, or the social support center can refer a victim to a shelter at once in an emergency, and the Public Prosecution decides within 24 hours.DV Law 5, 8, 11, 17
The child may be taken abroad.A custodial parent needs the other parent’s written consent, or the court can authorize limited travel with a guarantee of return. Taking the child out of the state without permission is an offense under Article 252.PSL 116, 252
The other parent will not hand the child over.A visitation ruling is enforced by force if the custodian refuses. The Cabinet can assign handovers and enforcement to a qualified entity.PSL 121; Decree-Law 3(3)

Steps Explaining How to Get Emergency Custody of a Child in the UAE

Move in order: safety first, then evidence, then the application.

  1. If the child is in danger, call 999. The government also lists the Ministry of Interior (116111), the Community Development Authority (800988), and the Dubai Foundation for Women and Children (800111) for violence and abuse of women and children.
  2. Write down what happened, with dates, places, and people. Keep medical reports, school records, and messages.
  3. File an urgent application in the personal status court. Say who the child is, where the child lives, what the risk is, what order you want, and why it cannot wait.
  4. Ask for the order you need and no more: a temporary custody arrangement, a protective placement where the guardian’s conduct is the problem, or a condition on travel or the passport.
  5. Challenge or appeal the right decision in the right period, as the table below shows.
  6. Expect a main case to follow, where the court decides custody on the merits.

The law does not fix a time within which the court must decide an urgent request, and it does not guarantee that an urgent order will be granted. The court decides in the interest of the child.

Deadlines, By Type Of Decision

Each deadline belongs to one type of decision.

What The Court Looks At

The court checks whether the custodian meets the conditions in Article 113, including sanity, trustworthiness, freedom from dangerous disease, no addiction, and no earlier conviction for a crime against modesty. It can depart from the usual order of custody where the child’s interest requires (Article 114). For the grounds considered in a custody challenge, see how to remove custody from a parent in the UAE.

A child of 15 can choose which parent to live with, unless the child’s interest requires otherwise (Article 122). A mother does not lose custody because she leaves the marital home, unless the child’s interest requires otherwise (Article 120).

Non-Muslims

Under the civil personal status law, joint custody after divorce is a joint and equal right of both parents, and either parent can ask the court to decide a dispute in the child’s interest (Article 10). That law has no article on urgent custody orders and applies other laws in force to matters it does not cover (Article 15). Ask a lawyer how interim relief is sought in your case. For the joint custody application process, read how to file for joint custody in the UAE.

Questions About Urgent Custody

Is There A Legal Term For Emergency Custody?

Not in the Personal Status Law. The law speaks of urgent and temporary orders (Article 8), orders on petition (Article 6), and a temporary placement of a child where the grounds for depriving guardianship exist (Article 155).

Do I Have To Go To Family Guidance First?

Not for urgent and temporary custody orders (Article 8). In other cases, the supervising judge may refer the parties if he or she thinks a settlement is feasible.

Can I Take The Child Myself If I Fear For His Safety?

The law sends custody disputes to the court, and it gives the court the power to place a child temporarily with a trustworthy person (Article 155). Removing a child without a court order or the other parent’s consent can undermine your case, so take advice before you act.

What If The Other Parent Plans To Take The Child Abroad?

A custodial parent needs the other parent’s written consent or the court’s authorization (Article 116). Ask the court for urgent orders if travel is imminent, and give the evidence of the risk.
