When Dubai Social Media Defamation Rules Apply
Dubai social media defamation rules can apply to online insults and damaging accusations. The full words and their context matter. A post does not need to be public for every offense.
Keep the original material before you report it or respond. Penalties may include prison and large fines. A claim for damages may also be possible.
The right next step depends on the evidence, the harm, and the law that applies.
What To Do After An Online Accusation Or Harmful Post
Preserve complete digital evidence before acting:
- Save the post link, account details, and full thread.
- Record dates, times, and who could see the content.
- Keep unedited screenshots and the original device.
Avoid retaliatory posts. Obtain advice on a police complaint, a settlement, or a civil claim. Ask whether an urgent step can limit further publication.

Social Media Defamation Rules Under UAE Law
Federal Decree-Law No. 34 of 2021 on Countering Rumors and Cybercrimes is the main law for the online conduct discussed here. Article 43 has two parts. The first is insulting another person.
The second is attributing to another person a quality that would make him or her subject to punishment or contempt by third parties.
The law defines a website to include social media sites, networks, and platforms, as well as personal pages and accounts (Article 1). Article 43 does not say the statement must be public. It speaks of using an information network, information technology equipment, or an information system.
The law does not say that every critical or negative comment is an offense. Not every negative comment insults someone or attributes a quality that exposes the person to punishment or contempt. A lawyer should read the actual post and its context before you report it or reply to it.
Which Provisions Apply To Online Conduct
Article 43 is not the only provision that can apply to harmful online content. The points below distinguish the main offenses and penalties.
- Insult or damaging attribution: Article 43 covers online insults and qualities exposing a person to punishment or contempt. The penalty is imprisonment and/or AED 250,000 to AED 500,000. The offense has an aggravating circumstance if directed at a public official or person entrusted with public service, during or because of that work. This means a factor that can increase the seriousness of the offense.
- Edited media: Article 44 covers editing a record, photo, or scene to defame or insult. The penalty is at least one year and/or AED 250,000 to AED 500,000.
- Private-life publication: Article 44 can cover private or family material published without consent and with harmful intent, even if true. The penalty is at least six months and/or AED 150,000 to AED 500,000.
- Fake identity: Creating an account, email, or website in another person’s name carries imprisonment and/or AED 50,000 to AED 200,000 (Article 11). Using it in a way that offends the person carries imprisonment of at least two years.
- Online threats: Article 42 covers threats used to force action or inaction. The penalty may reach two years and/or AED 250,000 to AED 500,000. A threat to commit a crime or dishonorable acts, with a request to act or refrain, carries temporary imprisonment of up to ten years.
A court can order the devices used to be forfeited and the data deleted (Article 56). It can also order electronic supervision, a ban on using networks, or the closure or blocking of a site (Article 59). A company can share liability for fines or damages when an employee commits the offense in its name and for its benefit (Article 58).
These penalties do not prevent a more severe penalty under the Penal Code (Article 72). The Penal Code, Federal Decree-Law No. 31 of 2021, also has its own defamation and insult offenses.
Civil Claims for Reputation Damage
A person harmed by a defamatory post can also seek damages in the civil courts. Civil lawyers in Dubai can review the loss and the claim period. Any harm to another obliges the person who caused it to compensate (Article 246 of the Civil Transactions Law).
The law counts attacks on a person’s freedom, honor, dignity, reputation, social standing, or financial standing as moral damage, meaning nonfinancial harm (Article 254). Compensation covers the loss suffered and the profit lost, as a natural result of the harm (Article 255). On request, the court can also order a specific act connected with the harm as compensation (Article 256).
A damages claim is not heard after 3 years from the day the injured person learned of the harm and of the person responsible. If the harm arises from a crime and the criminal case is still open after those three years, the period starts only when the criminal case ends. The outer limit is 15 years from the harmful act (Article 258).
The Civil Transactions Law applies from June 1, 2026, and not to earlier facts unless it says so (Article 4). For a post made before that date, ask a lawyer which version applies.

Preserve The Evidence First
Electronic evidence carries the same legal weight as physical forensic evidence in criminal cases (Article 65). Keep it in a form that shows where it came from.
- Take screenshots that show the account name, the full text, the date, and the time. Do not crop or edit them.
- Copy the link to the post, comment, or profile, and note the username and the platform.
- Save messages in their original form, such as the full chat thread, and keep the phone or account where they sit.
- Note who could see the content and how it spread, such as views, shares, and tags.
- Keep your own replies, and do not answer with insults of your own. Your reply could be a separate offense.
- Do not hack accounts or secretly photograph or record people to gather proof. Those acts can be offenses too (Articles 2 and 44).
How Context Changes The Legal Assessment
A review by defamation lawyers in Dubai should separate opinion from insults and damaging allegations. Private information needs its own review. The label used by the writer is not decisive.
The full wording, image, emojis, replies, and surrounding conversation can change the meaning. Translation may also matter when Arabic and another language appear together.
Audience and distribution are relevant to evidence and harm. Record whether the content was public, sent to a group, forwarded, tagged, or repeated by another account. Keep proof of views, shares, business loss, medical effects, or requests for removal.
Truth does not automatically answer every issue. Article 44 can address publication about private or family life without consent, even where the information is true, when the required harmful intent exists. A review should therefore test privacy and defamation separately.
Documents To Prepare For Legal Advice
- The original post, message, image, audio, or video in its complete form.
- The profile URL, username, phone number, platform, date, and timestamp.
- Screenshots showing the material before any edit or removal.
- The surrounding thread and any earlier dispute that explains context.
- Proof of the audience, forwarding, shares, tags, or commercial impact.
- Police references, platform reports, removal requests, and settlement messages.
Do not rely only on a cropped screenshot. Original devices and account access may help investigators verify source and integrity.
How to Report a Defamation Case in Dubai
- Preserve the evidence, as set out above.
- Report the incident through an official Dubai Police channel, such as its eCrime service or smart app. Check the current submission route before sending the evidence.
- Describe the post and the harm, and attach your evidence. You may be asked for a statement and for the original material.
- The matter may go to the public prosecution, the authority that investigates and brings criminal cases, and then to court. Cybercrime lawyers in Dubai can assess the conduct against the relevant offense. For offenses under Articles 43 and 44, an amicable settlement, an agreed resolution with the victim, may be invoked before the judgment becomes final (Article 68).
- Consider a separate civil claim for compensation, and watch the time limit above.
Ask about any criminal complaint deadline at once. The civil damages period does not set the criminal complaint period.
If you are deciding whether to report a post, discuss the original online material on WhatsApp.

If Someone Accuses You of Defamation
- Stop posting about the person, and do not reply to the complaint online.
- Do not delete or change the content without advice. Article 18 punishes an account manager who conceals or tampers with digital evidence to impede investigators. The penalty is at least six months and/or at least AED 200,000.
- Keep a record of what you wrote and the context around it, and ask a lawyer about a settlement under Article 68.
The firm’s published success stories may help you assess its approach to evidence and case preparation. For an online dispute, look for how the account, full conversation, and claimed harm were established.

Protect The Record Before Making The Next Post
Preserve the original evidence and stop any retaliatory exchange. A platform report does not decide whether a crime occurred or protect a filing deadline. Review the full conversation and the dates before choosing a complaint, defense, or damages claim.
