A uae bank credit card debt dispute. must separate the principal balance, regulated charges, complaint process, collection conduct, and any court claim.

Quick Answer

For a uae bank credit card debt dispute. request the signed agreement, complete statements, transaction records, and a calculation separating principal, interest, fees, and payments. File a formal bank complaint first. If eligible, escalate after the current waiting period to Sanadak. Article 148 of Federal Decree-Law No. 6 of 2025 governs the complaint unit and decision routes. Collection pressure must follow CBUAE rules. The outcome depends on the records, contract, calculations, conduct, and proceedings.

Write to the bank immediately. Identify each disputed transaction or charge and request documents. State what is admitted and what is disputed without making unnecessary admissions. Keep paying any undisputed amount only under a documented strategy.

If the bank does not resolve the complaint, check current Sanadak eligibility. A complaint already before a court may be rejected. If court papers arrive, respond through the correct procedure without waiting for the complaint process.

Current UAE Legal Framework

Federal Decree Law No 6 Of 2025

Federal Decree-Law No. 6 of 2025 regulates the Central Bank, licensed financial institutions, and insurance business. The CBUAE Rulebook records that the Law has been effective since 16 September 2025.

Article 148 provides for the UAE Banking and Insurance Disputes Settlement Unit, known as Sanadak. Bank and insurance customers may use the unit within its jurisdiction and procedures.

For disputes not exceeding AED 100,000, the concerned bank or insurer cannot challenge the committee’s resolution, which is final and enforceable against that institution.

For disputes above AED 100,000, the resolution is not final and immediately enforceable in the same way. The institution or concerned party may challenge it before the competent Court of Appeal within 30 days.

Article 148 also states that licensed financial institutions must not charge interest on accrued interest, or compound interest, on customer facilities. Central Bank rules control the calculation.

Consumer Protection Regulation And Standards

Clause 5.2.2.5 of the Consumer Protection Regulation requires financial institutions to prohibit undue and coercive pressure when collecting repayments or debts.

The Consumer Protection Standards require written debt-collection policies. Institutions should discuss financial difficulty before escalating, where reasonably possible, and document those discussions.

The Standards also require disclosure of interest calculations, payment allocation, fees, annual rates, and complaint channels. Credit card statements must explain the cost of minimum payments.

UAE Bank Credit Card Debt Dispute Audit

Transactions

  • Mark every transaction you do not recognize and identify its date, merchant, amount, and currency.
  • Report suspected unauthorized transactions through the bank’s prescribed channel immediately.
  • Preserve card alerts, authentication messages, merchant correspondence, and police reports where relevant.
  • Do not describe a transaction as fraud until the available evidence supports that allegation.

Interest And Fees

  • Confirm the annual interest or profit rate in the signed agreement and statements.
  • Check the date interest started and whether payments were allocated correctly.
  • Identify late fees, over-limit fees, insurance, and add-on charges separately.
  • Check whether the bank charged interest on accrued interest contrary to Article 148.
  • Test unpaid card interest using the reducing-balance method required by the Standards.
  • Check notices of any permitted rate or fee changes.

Payments And Credits

Compare bank transfers, receipts, and salary deductions against the card ledger. Record payments applied late, to another account, or not applied at all.

A reconciliation should begin with an agreed opening balance. It should then show transactions, payments, credits, interest, and fees in date order. Unsupported totals are difficult to challenge or defend.

Step By Step Complaint Process

Complain To The Bank

  • Use the bank’s official complaint channel and obtain a reference number.
  • State the card number only through secure channels.
  • List disputed items and requested corrections precisely.
  • Request the agreement, application, fee schedule, statements, and calculation method.
  • Attach proof of payments and prior reports.
  • Ask for a written final response and preserve delivery evidence.

Escalate To Sanadak

Sanadak’s current eligibility page states that a consumer must first complain to the institution. It currently asks whether 15 calendar days have passed without a satisfactory written response.

Because public guidance has shown different waiting periods, verify the live eligibility page when filing. Do not rely on an older article or screenshot.

Sanadak may reject a duplicate complaint, a matter already before a court, an issue outside CBUAE jurisdiction, or a complaint materially concerning excluded internal policies.

  • Submit the bank complaint and response, if any.
  • Attach the agreement, statements, reconciliation, and payment proof.
  • Explain the remedy requested and quantify the disputed amount.
  • Disclose related court proceedings accurately.
  • Keep proof of the Sanadak filing and every later communication.

Debt Collection Conduct

A bank may pursue a valid debt, but collection communications must remain proportionate. CBUAE rules prohibit excessive or coercive pressure and require records of customer communications.

  • Keep a log of the date, time, number, caller, and content of every contact.
  • Save messages and letters in their original format.
  • Ask the bank to identify any authorized collection agent and the amount assigned.
  • Report threats, misleading statements, or excessive contact through the complaint process.
  • Avoid abusive replies and do not make promises you cannot keep.

Collection misconduct does not automatically erase an otherwise valid balance. The amount dispute and the conduct complaint should be documented separately.

If The Bank Starts Court Proceedings

Do not ignore a claim, payment order, execution notice, or appeal deadline. The correct response depends on the document, issuing court, service date, and procedural route.

  • Confirm the claimant’s identity and legal authority.
  • Require proof of the agreement, use of the card, balance, and calculation.
  • Raise unauthorized transactions and missing payments with supporting evidence.
  • Challenge unagreed or incorrectly calculated interest and fees.
  • Address any cheque, guarantee, or settlement instrument separately.
  • Consider settlement only with a written, complete release.

Sanadak is not a substitute for a timely court response. Once proceedings exist, counsel should coordinate the forum position and avoid inconsistent factual statements.

Discuss My Bank Debt Legal Options

Settlement And Payment Plans

A settlement should identify the final amount, installments, dates, interest treatment, default consequences, and whether pending proceedings will be withdrawn or suspended.

It should also address the card’s closure, credit reporting, any security cheque, collection agents, and the clearance letter. Obtain signed terms before making the settlement payment.

A reduced settlement can have credit or tax consequences depending on the parties. A borrower should understand the effect before accepting.

Credit Records Security Cheques And Travel Restrictions

Arrears can affect the customer’s credit record. Correcting a disputed balance may require the institution to update reporting after the complaint or settlement is resolved.

A security cheque or guarantee can create a separate enforcement route. Obtain the instrument, dishonor record, and connected agreement before assuming the card complaint resolves it.

Travel restrictions are not automatic consequences of every unpaid card. They can arise through specific judicial or enforcement processes when legal conditions are met. Check the actual court record.

Settlement terms should address credit reporting, instruments, cases, execution files, and final clearance. A payment receipt alone may not close all related procedures.

Evidence And Documents Needed

  • Signed card application, agreement, and fee schedule.
  • Complete monthly statements for the disputed period.
  • Transaction authorizations, merchant records, and authentication logs.
  • Bank transfers, receipts, salary deductions, and other payment proof.
  • Rate-change and fee-change notices.
  • Bank complaint, reference number, and written response.
  • Collection calls, messages, letters, and agent details.
  • Sanadak submissions and any court or execution documents.

Build one dated chronology and one numerical reconciliation. Those two documents help counsel identify gaps and avoid contradictory explanations.

Common Mistakes And Risks

  • Ignoring statements until the disputed balance becomes much larger.
  • Complaining by telephone without a written record.
  • Disputing the entire balance when only defined items are contested.
  • Relying on screenshots without obtaining full statements.
  • Missing a court deadline while waiting for the bank or Sanadak.
  • Accepting a verbal payment plan or making undocumented cash payments.
  • Assuming collection misconduct automatically cancels the debt.

Professional Contribution From Ekatreina Butseva

Ekatreina Butseva, Founder Partner at Leaders Advocates, notes that many card disputes weaken because the customer lacks the original agreement and complete statements.

She recommends making the first complaint a precise document request. The bank’s response then shows which transactions, rates, fees, and calculations can actually be proved.

How A Lawyer Can Help

A lawyer can review the agreement, reconcile the account, frame the bank complaint, and prepare the Sanadak file. Counsel can also respond to litigation and negotiate enforceable settlement terms.

Legal advice is especially important where the dispute overlaps alleged fraud, a security cheque, travel restrictions, execution, insolvency, or multiple lenders.
