A lawyer for an international family dispute in Dubai starts with two questions: which court can hear the case, and which law applies. The answer depends on the type of dispute, the family’s religion and nationality, and where the children and assets are.

Cross-border family cases are not all the same. A divorce between spouses of two nationalities raises different issues from a child taken abroad or a foreign custody order used in Dubai.

This guide sorts the main types of cases and the rule that usually applies to each. If you are still choosing counsel, read our guide on how to find an international family lawyer in Dubai.

Which Court Can Hear an International Family Case?

Jurisdiction is the first fight in many cross-border cases. If the spouses file in different countries, the first judgment can shape everything that follows.

In general, UAE courts can hear a family case against a spouse who lives in the UAE. The Civil Procedure Code also covers some cases against a spouse who lives abroad.

Examples include a maintenance claim by someone who lives in the UAE, and a custody or guardianship claim about a child who lives in the UAE. Before filing, a lawyer checks whether a case is already pending abroad, because two courts can issue orders that conflict.

Which Law Applies to Your Family?

The law depends mainly on religion and nationality. These are the usual routes:

  • Muslim families: the federal Personal Status Law, Federal Decree-Law No. 41 of 2024, usually applies. It came into force on 15 April 2025.
  • Non-Muslim UAE citizens and residents: the civil personal status law, Federal Decree-Law No. 41 of 2022, covers marriage, divorce and custody.
  • Non-Muslim foreigners who prefer home law: they can ask the court to apply the law of their own country instead (Article 1 of the 2022 law).
  • Abu Dhabi residents: non-Muslim foreigners can also use the Abu Dhabi Civil Family Court under Abu Dhabi Law No. 14 of 2021.

Where one spouse is Muslim, the federal Personal Status Law usually applies. A party who relies on foreign law must normally prove its content, with an official copy and a certified Arabic translation.

Using a Foreign Divorce or Custody Order in Dubai

A foreign family order does not enforce itself in the UAE. The party must apply to the execution judge, who checks the conditions in Article 222 of the Civil Procedure Code:

  • The UAE courts did not have exclusive jurisdiction, and the foreign court was competent.
  • The parties were properly summoned and represented.
  • The order is final under the law of the country that issued it.
  • It does not conflict with an earlier UAE judgment.
  • It does not breach UAE public order or morals.
  • The issuing country treats UAE judgments the same way (reciprocity).

Under Article 225, a treaty between the UAE and the issuing country takes priority over these rules. Family orders are checked closely on public order, so a fresh UAE case is sometimes the faster route.

Children in Cross-Border Disputes

Child cases need the fastest action. Under the 2024 Personal Status Law, a custodian needs the guardian’s written consent to travel abroad with the child.

If consent is refused, the court can allow travel for up to 60 days a year. For non-Muslim families, the 2022 civil law treats custody after divorce as a joint and equal right of both parents (Article 10).

The UAE is not a party to the Hague Child Abduction Convention, so prevention matters most. Our page on the international child abduction lawyer in Dubai explains the urgent steps. For custody rules, see UAE divorce law on child custody.

What a Lawyer for an International Family Dispute in Dubai Does

  1. Maps the facts: nationality, religion, residence, place of marriage, children and assets.
  2. Picks the forum: decides whether Dubai, the home country or both are right, and in what order.
  3. Confirms the law: federal law, the 2022 civil law or a foreign law the court can apply.
  4. Checks foreign orders: chooses between enforcement under Article 222 and a fresh UAE claim.
  5. Protects children: seeks travel or passport orders when there is a real risk.
  6. Works with foreign counsel: keeps positions consistent in every court.

Faris Raian, Senior Legal Consultant at Leaders Advocates, advises clients to disclose every foreign case at the first meeting. A filing abroad that the lawyer does not know about can change the whole Dubai strategy.

Documents to Prepare

  • Marriage certificate: attested and translated. See how to attest a marriage certificate in the UAE.
  • Children’s records: birth certificates, passports and school records.
  • Court papers: copies of any foreign filings or orders.
  • Assets: a list of property, accounts and income by country.
  • Agreements: any prenuptial or settlement agreement.

Frequently Asked Questions

Can I File for Divorce in Dubai if We Married Abroad?

Yes, in many cases. A marriage abroad does not stop a Dubai court from hearing the divorce. The jurisdiction rules must be met, for example where the defendant lives in the UAE.

Can Non-Muslim Expats Use Their Home Country Law in Dubai?

Yes. Non-Muslim foreigners can ask the court to apply their own law under Article 1 of Federal Decree-Law No. 41 of 2022. The content of that law usually has to be proven.

Is a Foreign Divorce Recognised in the UAE?

It can be. The execution judge checks reciprocity, finality, proper notice and public order under Article 222 of the Civil Procedure Code.

What if My Spouse Already Filed in Another Country?

Get advice in both countries quickly. The earlier case may affect where the dispute is decided and which order is enforced.

Does the Hague Child Abduction Convention Apply in the UAE?

No. The UAE is not a party to it, so a child’s return depends on court action and negotiation in each country.
