How Litigation Works in Dubai
Litigation means taking a dispute to court or to a formal dispute resolution body. Here is a simple breakdown of how the process works in Dubai.
The Dubai Court System
Dubai has three court levels. The Court of First Instance is where most cases start. If you are not happy with the result, you can appeal to the Court of Appeal. The final level is the Court of Cassation, which only looks at legal questions, not the facts again. Most disputes are resolved at the first level. Simple debt cases now take around 2 to 4 months. Commercial cases typically take 8 to 14 months. Complex multi-party disputes can take 2 to 3 years.
The language of the court is Arabic. You need a lawyer who is fully fluent and knows how the Dubai Personal Status Court operates, not someone learning it on your case.
Court vs Arbitration
Some disputes are better resolved through arbitration rather than court. Arbitration through DIAC or DIFC-LCIA is private, often faster, and uses specialists who know your industry. Court proceedings are better when you need urgent orders like asset freezes or when the other party has no assets outside the UAE. Many commercial contracts already specify arbitration. Do I need a lawyer to go to court in Dubai?
Technically individuals can represent themselves in Dubai courts but it is not recommended. All documents and pleadings must be in Arabic. The court process has specific rules and deadlines. A mistake at any stage can seriously damage your case. For businesses, having a licensed advocate is usually required. The cost of legal representation is almost always less than what you risk losing without one.
How long does a court case take in Dubai?
Simple debt cases in Dubai now take around 2 to 4 months. Standard commercial cases typically take 8 to 14 months. Complex multi-party disputes involving expert reports and appeals can take 2 to 3 years. Recent court reforms have shortened average case times by 25 to 30 percent since 2021. How much does it cost to file a case in Dubai courts?
Dubai court fees are 7.5 percent of the value of your claim, capped at a maximum of AED 30,000. So for any claim above AED 400,000, the court fee is AED 30,000 regardless of the claim size. You pay this at the time of filing. If you win, the court can order the other side to pay your costs. We calculate the exact fee for your case before you commit to filing.
What is the difference between going to court and going to arbitration in Dubai?
Court proceedings are public, handled by judges and governed by UAE court rules. Arbitration is private, handled by specialists you choose, and usually faster for commercial disputes. Most commercial contracts already specify which route to use. If your contract has an arbitration clause, you generally must use arbitration first. We check your contract and advise on the right forum for your situation.
I won my court case but the other side is not paying. What can I do?
You can apply to the Dubai Execution Court to enforce the judgment. The court has strong tools available including freezing the debtor’s bank accounts, seizing assets and issuing travel bans that prevent them leaving the UAE. These tools are very effective. Most debtors pay quickly once enforcement proceedings begin. We handle the full enforcement process after judgment.
Can I appeal a court judgment in Dubai if I think it was wrong?
Yes. If you believe the Court of First Instance made an error, you can appeal to the Court of Appeal. Appeals must be filed within a specific time limit after the judgment. The Court of Appeal reviews both the facts and the law. If you are still not satisfied, you can apply to the Court of Cassation, but that court only looks at legal errors not the facts of the case.
Do I need to try mediation before going to court in Dubai?
For most civil and commercial disputes in Dubai, yes. The Centre for Amicable Settlement of Disputes has exclusive jurisdiction over many types of disputes before they can go to court. If you file directly with the court without going through this step, the court may dismiss your case. We manage this step as part of the full litigation process.
What language is used in Dubai courts?
