This guide explains the polygamy law, UAE rules, the four-wife limit, marriage conditions, maintenance, and housing protections.
Polygamy law in the UAE allows a Muslim man to be married to up to four wives at the same time, under the Personal Status Law (Article 32(4)). A wife’s protections come from conditions in her marriage contract, the housing standard for more than one wife, her maintenance rights and her right to ask for divorce for harm. For non-Muslims, the husband must disclose any existing marriage, and a husband whose own law does not allow more than one wife must declare that none exists (Federal Decree-Law 41/2022, Article 6(3)).
Summary
The Personal Status Law permits a Muslim man to have up to four wives, subject to its restrictions. Each wife’s position also depends on maintenance, housing, and valid marriage conditions.
A breach or legally sufficient harm may support court proceedings. The civil marriage regime has a different disclosure rule, so check the applicable personal law and each existing marriage contract.
Polygamy Law UAE: Key Rules
The law sets seven rules on polygamy.
| Rule | What The Law Provides | Article |
|---|---|---|
| Limit | A man may not combine more than four wives, counting a wife in the waiting period after a revocable divorce | PSL 32(4) |
| Prohibited combinations | A man may not combine two sisters, or a woman with her paternal or maternal aunt, and may not marry another man’s wife or a woman in her waiting period | PSL 32 |
| Housing | A husband may house more than one wife in the same building if the housing is suitable and each wife has almost complete independence. The court can add conditions at a harmed wife’s request | PSL 105(4) |
| Maintenance | Each wife is entitled to maintenance from her husband, even if she is wealthy | PSL 99(1) |
| Conditions | A valid condition in the marriage contract binds the husband, and breach lets the wife ask for revocation without paying consideration | PSL 33 |
| Divorce for harm | A wife can ask for divorce for harm that makes living together impossible | PSL 71 |
| Non-Muslim marriage | Disclosure of any existing marriage to the authentication judge, and a declaration of none where the husband’s law does not allow more than one wife | Civil law 6(3) |
Before another marriage, review conditions in a marriage contract.
What A Wife Can Do
A wife’s main protection is the marriage contract, backed by the courts.
- Write a condition into the contract, for example a condition against a second marriage, if the Law allows it. A condition counts on denial only if it is written in the documented contract (Article 33(7)).
- If the husband breaches it, ask for revocation, but act within a year of learning about it, because one year counts as waiver (Article 33(4)).
- Ask the court to add conditions to the housing arrangement if you are harmed (Article 105(4)).
- Claim maintenance, which is a privileged debt from the date of the claim (Articles 98 and 99).
- Ask for divorce for harm (Article 71), or end the marriage through khula (Articles 65 to 68).
Eligibility also depends on temporary marriage prohibitions.
Steps For A Husband Considering Another Marriage
A husband should check five points first.
- Check the law that governs you: the Personal Status Law or the civil law.
- Check the four-wife limit and the prohibited combinations.
- Read each existing marriage contract for conditions.
- Plan housing that meets the standard in Article 105(4).
- Plan for maintenance for each household.
