The types of court judgments in the UAE differ in their effect, challenge procedure, and enforcement rules. Federal Decree-Law No. 42 of 2022 distinguishes judgments ending proceedings from interim decisions, urgent judgments, petition orders, and payment orders. Identifying the decision correctly is essential before calculating a deadline.

This guide covers civil and commercial judgments. Criminal judgments follow the Criminal Procedure Law.

Quick Answer

The main types of court judgments in the UAE include final judgments, non-final judgments, provisional or urgent judgments, petition orders, payment orders and decisions issued by special circuits. Courts may also issue decisions correcting, interpreting or supplementing earlier judgments.

Ordinary civil appeals generally have a 30-day period, reduced to 10 days for urgent matters, subject to the applicable rules. Some decisions cannot be appealed separately, while petition orders and payment orders follow different procedures.

Before taking action, identify the type of decision, read its operative provisions, check the relevant dates and confirm whether it can be challenged or enforced.

Main types of court judgments in the UAE

  • Final judgment: A judgment that ends the whole dispute. It can be appealed within 30 days, or 10 days in urgent matters (Article 152, 161).
  • Non-final judgment: A judgment issued while the case continues. It can be appealed only with the final judgment, except for provisional and urgent judgments, judgments staying the case, enforceable judgments and judgments on jurisdiction (Article 152).
  • Provisional or urgent judgment: A judgment of the urgent matters judge, issued temporarily and without affecting the merits, where delay is feared (Article 27).
  • Order on a petition: An order issued on a written petition, usually the next day, without hearing the other side. The affected person can object to the court or the judge who issued it (Article 140, 141).

For case records, see our guide to checking a civil case in the UAE.

  • Payment order: An order for a written, due debt of a fixed sum of money, issued after a demand of at least 5 days. It is issued within 3 working days of the petition (Article 143, 144).
  • Judgment of a special circuit: A decision issued in a single session by a circuit designated for certain claims, appealable in chambers (Article 29(2), 132).
  • Correction, interpretation, supplementary judgment: A court can correct clerical errors, interpret an unclear operative part and decide a claim it omitted (Article 137, 138, 139).

Final and appealable judgments by value

  • A first-instance judgment of a single judge is final if the claim does not exceed AED 50,000 (Article 29(1)(b)).
  • An appeal court judgment is final and cannot go to cassation if the claim does not exceed AED 500,000 (Article 159(2)).

For appeal preparation, read about assessing a civil appeal in Dubai.

  • Cassation is open against appeal judgments in claims above AED 500,000 or of no stated value, on the grounds in Article 175.
  • A payment order is the mandatory route when its conditions are met, according to a Dubai Court of Cassation General Assembly decision (Appeal 2/2021, 9 June 2021).

Considering an Appeal Against a UAE Court Judgment?

The appeal route may depend on the claim value, decision type and applicable deadline. Ask Leaders Advocates to review the judgment and identify the relevant procedural requirements.

What a valid judgment must contain

  • It must give its reasons and be deposited, signed, in the case file when it is issued. Breaching this makes the judgment void (Article 129).
  • Article 130 requires the court, date, location, case type, judges, parties, and attendance details. It also requires the facts, requests, defense summary, reasons, and operative decision.
  • Deficient factual reasons, a serious error in the parties’ names or capacities, or failing to name the judges makes it void (Article 130(3)).

For notification issues, see our guide to responding to a Dubai court notice.

  • The judgment must decide costs, which fall on the losing party and include lawyer’s fees assessed by the court (Article 133).

From judgment to enforcement

  • Only a copy stamped with the executory formula and delivered to the party who benefits can be used for enforcement. A second copy needs a judicial order (Article 131).
  • The execution judge can order attachment and inquiries into the debtor’s assets. Article 234 also permits a travel ban where there are indications of asset concealment or departure.
  • Article 318 permits a daily fine to enforce a judgment requiring an act or abstention. The fine ranges from AED 1,000 to AED 10,000, capped at the debt amount.

Professional Contribution From Faris Raian

Faris Raian, Senior Legal Consultant at Leaders Advocates, advised reading the operative decision and its date first. The type of decision determines the next step. He explained that a payment order or an order on a petition follows different deadlines from an ordinary judgment, so the wrong assumption can cost the right to challenge.
