The uae termination rules for employment contracts are in Article 42 to 47 of the Labour Law (Federal Decree-Law 33/2021) and its executive regulation. A contract can end by agreement, on expiry, on a party’s wish with notice, or in the specific cases the Law lists. The way it ends decides notice, end-of-service pay and the risk of a claim.
This guide covers private-sector employment under the Labour Law. Domestic workers, government employees and free zones with their own rules are outside it.
Quick Answer
Under the UAE Labour Law, an employment contract can end by written agreement, expiry, termination with notice or other legally specified circumstances. The usual contractual notice period is between 30 and 90 days. An employer may dismiss without notice only on the grounds in Article 44 and after following the required written investigation procedure.
Employees may leave without notice in the circumstances specified by Article 45. Eligible foreign workers generally receive end-of-service gratuity based on 21 days of basic wage for each of the first five years and 30 days for each subsequent year. Unlawful termination may also lead to compensation, depending on the facts and applicable legal conditions.

| End of term | The fixed term ends and is not extended or renewed |
| A party’s wish | One party ends it, following the Law’s rules and the contract’s notice period |
| Death of the employer | If the contract was tied to his person |
| Death or total permanent disability of the worker | Proved by a medical certificate |
| A final custodial sentence | A final judgment against the worker of at least 3 months in custody |
| Permanent closure | The establishment closes for good under the law |
| Bankruptcy, insolvency or exceptional economic reasons | On the conditions in the executive regulation |
| Permit renewal fails | The worker does not meet the conditions to renew his work permit, for reasons outside the employer’s control |
Notice and notice pay
- Either party can end the contract for any legitimate reason by giving written notice and working the contractual notice period. The period is at least 30 days and no more than 90 days (Article 43(1)).
- The contract continues during the notice, and the worker receives his full pay and must work if the employer asks (Article 43(2)).
- A party who does not serve notice pays the other party notice pay, even if no loss was caused. It equals the wage for the whole notice period or the part left (Article 43(3)).
- If the employer ends the contract, the worker can take one unpaid working day a week during notice to look for work. The worker must tell the employer at least 3 days before (Article 43(5)).

Unlawful termination and health
- Termination is unlawful if caused by a serious complaint to the Ministry or a case against the employer that proved valid. The court sets fair compensation of up to 3 months of wages (Article 47).
- The worker keeps his notice pay and end-of-service pay in that case (Article 47(3)).
- An employer cannot end a worker’s service for ill health before he has used the leave he is entitled to, and any agreement otherwise is void (Article 46).
End-of-service pay and what happens next
A foreign worker with at least a year of continuous full-time service receives end-of-service pay (Article 51).
| Point | Rule |
|---|---|
| Formula | 21 days of basic wage for each of the first 5 years, and 30 days for each year after that |
| Part years | Paid in proportion, if the worker completed a year |
| Cap | The total cannot exceed two years’ wages |
| Unpaid absence | Days of absence without pay do not count as service |
| Deductions | The employer can deduct amounts legally due or owed under a judgment, under the executive regulation |
After a contract ends under the Law, a worker may move to another employer under the executive regulation’s conditions (Article 49). A worker who stops working without lawful reason before the contract ends faces the work-permit restriction in Article 50.
