This guide addresses the search question “can husband filed case against wife”. Yes, a husband can file a case against his wife in the UAE, in the personal status court for family claims and in the criminal or civil courts for other claims. The claim he brings decides the court, the deadline and the evidence. The Personal Status Law (Federal Decree-Law No. 41 of 2024) sets the family claims for Muslim couples, and the civil personal status law sets them for non-Muslims.
The Personal Status Law applies to UAE citizens where one or both parties are Muslim, to non-Muslim citizens unless special provisions or another permitted law apply, and to non-citizens unless one asks for his or her own law (Article 1). The civil law applies to non-Muslim citizens and to non-Muslim foreigners residing in the State, unless one of them adheres to the application of his or her own law (Article 1).
Quick Answer
Yes, a husband can file a case against his wife in the UAE where there is a recognised legal basis. Depending on the facts and applicable law, this may involve divorce, maintenance, custody, visitation, paternity, property rights or a separate civil or criminal allegation.
The correct court, evidence and deadline depend on the particular claim. A marital disagreement alone is not an independent legal cause of action. Before filing, identify the appropriate personal-status framework, collect supporting records, check procedural requirements and obtain advice about any urgent or claim-specific time limit.
Can Husband filed case against wife explained
The law lists specific family claims. A husband’s disagreement with his wife is not itself a claim, and each deadline below belongs only to the claim it is listed against.
| Claim | What the law provides | Source |
|---|---|---|
| Divorce | Under the Personal Status Law, the husband dissolves the marriage contract by his will and must document the divorce before the competent court within 15 days of its occurrence. Under the civil law, either spouse can obtain a divorce without proving harm, and the court can decide it at the first hearing | PSL Arts 53, 58; civil law Arts 3, 7, 8 |
| Ending the wife’s maintenance | A wife’s maintenance lapses if she withholds herself, refuses to move to the marital home or to reside in it, or refuses to travel with him, without a legitimate excuse. The court decides whether she had an excuse | PSL Art 103 |
| Annulment of the marriage contract | A spouse can request revocation of the marriage contract for breach of a valid stipulation, or for a disease or serious defect. Either spouse can ask the court for divorce for harm that makes living together impossible, or because the other is addicted to drugs, psychotropic substances or alcohol. The law treats revocation and judicial divorce as separate forms of separation | PSL Arts 33, 52, 69, 71, 80 |
| Custody | After the mother, custody goes to the father. A custodian’s right lapses if she loses a condition, fails her duties or moves to a place where the child’s interest is lost | PSL Arts 114, 115 |
| Visitation and educational guardianship | The parent without custody can visit and host the child. A father can refer a dispute over educational guardianship to the Judge of Summary Matters | PSL Arts 112, 121 |
| Recovering a contribution to property | A spouse who joined the other in developing property or building a house can recover a share from the other or from the heirs. Each spouse has a separate financial liability | PSL Art 51 |
| Denying a child’s paternity | The husband may deny a child’s lineage only by an accusation of adultery, filed within 15 days of learning of the birth and not preceded by an acknowledgment of paternity, express or implied. The court considers it after a DNA test if the wife agrees, and proceeds without one if she does not. This is a paternity claim, and its limits do not apply to the other claims in this table | PSL Arts 93, 94 |
| Under the civil law: a lump sum, custody, travel | The court may order either spouse to pay the other a lump sum after divorce. Custody is joint and equal, and either parent can ask the court to decide a dispute or to restrict the child’s travel | Civil law Art 10; Regulation Arts 6, 21, 22 |

Criminal and civil claims
Other claims go to the criminal or civil courts.
| Claim | What the law provides | Source |
|---|---|---|
| Insult or slander | These offences can be prosecuted only on the victim’s complaint, filed within 3 months of learning of the crime and its perpetrator, with the Public Prosecution or a judicial police officer | Criminal Procedure Law Arts 11, 12 |
| Defamation online | Insulting another, or attributing to him a quality that would expose him to punishment or contempt, through an information network, is punishable by imprisonment and/or a fine of AED 250,000 to AED 500,000. A settlement with the victim is possible | Cybercrimes Law Arts 43, 68 |
| A false report to the authorities | The Penal Code punishes a person who knowingly reports a crime that did not occur, or makes a false report accusing another in bad faith. The accused can claim compensation | Penal Code Arts 324, 325; Criminal Procedure Law Art 26 |
| Money lent or paid for the wife | Each spouse has a separate financial liability, so a claim for money lent or paid relies on the civil rules | PSL Art 51 |
Where and how to file
Match the claim to the right court first.
- Choose the claim, using the tables, and gather the documents: the marriage contract, the children’s records, messages, payment records and any medical reports.
- Check jurisdiction. A family claim is filed where the respondent lives or works (Personal Status Law, Article 3(2)). A claim by a wife, child, parent or custodian can also go to the court where the plaintiff or respondent lives or works, or where the marital home is (Article 3(3)).
- Check whether Family Guidance applies. The supervising judge may refer a case to it, but wills and inheritance, urgent and temporary cases, urgent orders on maintenance, custody and tutorship, and cases where reconciliation is not foreseeable, such as cases to prove a marriage or a divorce, are exempt (Article 8).
- File the claim and attend the hearings.
For related evidence and privacy considerations, read about audio recordings in family court.
- Appeal or take the ruling to cassation within 30 days of the day after the ruling (Articles 9 and 10). An order on petition has a one-week period (Article 6).

Limits a husband should know
Three limits apply to every husband’s claim.
- A wife’s disobedience affects her own maintenance. It does not end the child’s maintenance or automatically cost her custody (Articles 106, 112(7) and 120). Our guide on marital disobedience and child rights explains it.
- Paternity claims have their own rules. Lineage is proven by birth in a marriage, acknowledgment, evidence or scientific methods (Article 87). Once lineage is proven under Articles 87, 89, 90 and 91, a claim to deny it is not heard (Article 92). These restrictions concern paternity. They do not limit the husband’s other claims.
- A false accusation against a wife can expose the husband to a complaint and a compensation claim (Criminal Procedure Law, Article 26).
