A couple plans a wedding after a divorce, but the waiting period may still be running. Another couple needs to understand whether their different religions affect eligibility.

Temporary marriage prohibitions can prevent a valid contract even when both people consent. The first task is identifying the applicable law and the particular impediment.

Quick Answer

Article 32 identifies seven temporary marriage prohibitions under the UAE Personal Status Law. They concern an existing marriage, waiting periods, three irrevocable divorces, the limit of four wives, specified family combinations, and religious eligibility.

A temporary prohibition does not always end simply with time. The relevant legal condition must change. Whether a marriage can proceed depends on the governing framework, marital history, supporting documents, and the parties’ circumstances at the proposed contract date.

Pause arrangements until the precise impediment has been checked. Obtain the relevant marriage, divorce, death, and identity documents rather than relying on family descriptions of marital status.

Have a lawyer or the competent marriage authority identify the governing framework and any remaining condition. Do not assume that booking a ceremony, obtaining consent, or marrying elsewhere resolves the issue.

Temporary Marriage Prohibitions Under Article 32

Federal Decree-Law No. 41 of 2024 on the Issuance of the Personal Status Law contains the rules discussed here. Article 32 lists temporary impediments to marriage.

The word temporary distinguishes these restrictions from permanent prohibitions, such as certain blood relationships. It does not promise that every couple will eventually qualify under the same framework.

Article 26(2) requires the absence of a permanent or temporary prohibition between the proposed spouses. Consent and documentation cannot replace that condition.

Article 32 covers the following situations:

  • A man marrying a woman who is another man’s wife.
  • A man marrying a woman in her waiting period from another man.
  • Remarriage after three irrevocable divorces without the specified intervening marriage and completed waiting period.
  • Marriage to more than four women, including the stated revocable-divorce waiting period situation.
  • Combining two sisters, or a woman and her paternal or maternal aunt.
  • A Muslim man marrying a woman of a non-Abrahamic religion.
  • A Muslim woman marrying a non-Muslim man.

An Existing Marriage Must Be Addressed

A woman cannot marry another man while her existing marriage continues under this framework. Separation in daily life is not necessarily legal termination of the marriage.

Moving out, starting a divorce claim, or agreeing privately to separate does not by itself establish eligibility for another marriage. The relevant judgment or divorce documentation must be examined, and in some cases a lawyer may need to confirm whether divorce is treated as a civil case under the applicable framework.

Marriage During the Waiting Period

Article 32(2) prohibits marrying a woman during her waiting period from another man. Article 83 also prevents remarriage until the applicable waiting period has ended.

The starting date matters as much as the duration. Under Article 83, a death-related waiting period begins on the date of death. A lawyer can also explain when iddah is not required under this law.

For judicial separation, the provision addresses finality of the judgment. For divorce established before the court, proof and admission rules affect the relevant date.

Do not use the date a spouse moved out as a substitute. A judgment date, finality date, and date of admission may raise different questions, and these distinctions often matter when a party later wants to know whether a divorce case can be reopened.

Articles 84 to 86 govern duration for different circumstances. A single calendar estimate cannot safely replace review of the applicable category.

Different Waiting Periods Require Different Calculations

Article 84 addresses a nonpregnant divorced woman. It provides three periods of purity for a menstruating woman, rather than a universal three-calendar-month rule.

It specifies three lunar months for a postmenopausal woman and for a woman who has never menstruated. The provision also addresses menstruation beginning during that period.

Article 85 provides that a pregnant woman’s waiting period ends with delivery or miscarriage. The relevant facts and supporting medical documents require careful review.

Article 86 generally specifies four lunar months and ten days for a nonpregnant widow. It also contains rules for overlapping divorce and death circumstances.

Combining Sisters or a Woman and Her Aunt

Article 32(5) prohibits combining two sisters in marriage. It also covers a woman together with her paternal or maternal aunt.

The rule can still apply while one woman remains in her waiting period from the man. The article expressly includes an irrevocable divorce for this purpose.

It is therefore unsafe to assume that a divorce document immediately permits marriage to the former wife’s sister. The waiting period and legal status must both be checked.

The Limit of Four Wives

Article 32(4) prohibits marriage to more than four women. Its count includes a wife in the waiting period of a revocable divorce. Anyone considering an additional marriage should also confirm whether permission is needed for a second marriage in the UAE, including under second marriage law in the UAE.

Article 49(6) requires equity among wives in treatment, division, and obligatory maintenance.

Article 105(4) addresses conditions for housing more than one wife in the same building. It should not be treated as automatic permission for any shared accommodation arrangement.

A marriage contract may contain relevant conditions under Article 33, within its statutory limits. Have the actual wording reviewed rather than assuming every requested condition is enforceable, and confirm separately whether a prenuptial agreement can be signed after marriage if a condition was not addressed at the outset.

Interfaith Marriage Under This Framework

Article 32(7) prohibits a Muslim woman from marrying a non-Muslim man under this law. That rule should not be presented as a matter of family preference alone.

Article 32(6) prohibits a Muslim man from marrying a woman of a non-Abrahamic religion. The official English translation uses that expression for religions outside Islam, Christianity, and Judaism.

A Christian or Jewish woman is therefore not within that particular religious prohibition. That conclusion does not establish that every other requirement for the proposed marriage is met, and the couple should still confirm the correct process for how to do marriage registration in the UAE.

The bride’s consent, valid contract formation, and documentation remain relevant. Article 27 also requires Muslim witnesses where the husband is Muslim, and any foreign documents should be reviewed against the requirements for how to attest a marriage certificate in the UAE.

Why the Legal Route Must Be Identified First

Interfaith is a broad description, not a complete eligibility assessment. The parties’ nationality, religion, residence, and proposed marriage route must be examined together.

Federal Decree-Law No. 41 of 2022 on Civil Personal Status provides a separate framework for eligible non-Muslims. Its conditions should be assessed independently, and couples considering a civil marriage abroad should also check whether a foreign divorce is valid in the UAE if either party was previously married overseas.

Do not assume that a civil marriage service automatically offers a route for every mixed-faith couple. Eligibility and recognition require confirmation for the specific authority and circumstances.

Remarriage After Three Irrevocable Divorces

Article 32(3) addresses a woman irrevocably divorced from the same man by three divorces. The restriction does not end merely because the former spouses reconcile.

The provision requires a valid intervening marriage to another husband, consummation of that marriage, and completion of the resulting waiting period. Each condition matters.

This should not be presented as a checklist for arranging a sham marriage. Obtain advice on the genuine marital history and the applicable legal requirements, ideally from the best marriage lawyer in Dubai for the specific facts involved.

The number and legal effect of earlier divorces also need verification. A casual description that someone was divorced three times may not settle the statutory position, and the household’s documents should be confirmed through the correct route for how to get a divorce certificate in the UAE.

If a Prohibited Marriage Has Already Occurred

Failure to satisfy Article 26(2) raises validity concerns. Articles 35 to 40 distinguish categories of invalid marriage and their consequences.

Article 39 addresses an Al-Fased marriage, including judicial revocation and consequences following intercourse. These can include dowry, lineage, a waiting period, affinity, and qualified maintenance entitlement.

Article 38 deals separately with a void contract. Avoid assuming that every invalid contract has identical financial consequences.

Article 40 permits correction of an Al-Fased contract through a new compliant contract. It does not authorize a new marriage while the relevant prohibition still exists.

Practical Steps Before Making New Arrangements

First, identify the exact reason eligibility is uncertain. Separate a waiting-period calculation from a religious rule, an existing marriage, or a family relationship restriction.

Confirm the competent authority and resolve missing evidence before booking. Check translations, authentication, and the proposed contract date against the reviewed eligibility position.

Documents Needed for Review

  • Passports, identity records, nationalities, and residence information.
  • Existing and previous marriage certificates.
  • Complete divorce judgments and relevant proof of finality.
  • Court records establishing or admitting a divorce.
  • Death certificates where a prior spouse has died.
  • Relevant pregnancy, delivery, or miscarriage records where necessary.
  • A clear description of any relationship between the proposed spouses.
  • Existing marriage conditions and connected court orders.
  • Foreign documents with the required translations and authentication.

These are preparation categories, not a universal filing checklist. The authority may require different evidence depending on the legal route and the particular issue.

Common Mistakes and Risks

  • Treating physical separation as a completed divorce.
  • Calculating every waiting period as three Gregorian months.
  • Ignoring finality or the legal effect of a foreign judgment.
  • Excluding a revocably divorced wife from the four-wife count too soon.
  • Assuming irrevocable divorce immediately permits marriage to a wife’s sister.
  • Describing all interfaith couples as subject to identical requirements.
  • Believing consent or a private contract can override a prohibition.
  • Assuming a later event automatically validates an earlier defective contract.

How a Lawyer Can Help

Faris Raian and the team at Leaders Advocates can assess the couple’s circumstances and identify the relevant marriage framework. The review can distinguish an unresolved impediment from missing documentation.

A lawyer can also examine the effect of previous judgments, proposed contract conditions, and any existing marriage defect. Advice should identify the next legal step without promising approval.

Frequently Asked Questions

People Also Ask

▼ Does Temporary Mean the Restriction Ends Automatically
No. The relevant legal condition must end or change. Some restrictions concern status rather than the passage of time alone.
▼ Can a Muslim Woman Marry a Non-Muslim Man Under Article 32
No. Article 32(7) prohibits that marriage under this framework. Applicable-law questions need individual assessment.
▼ Can a Muslim Man Marry a Christian Woman
Article 32(6) does not prohibit that pairing. The couple must still satisfy the other applicable marriage requirements.
▼ Can a Woman Remarry While Observing Iddah
Not while the relevant waiting period continues. Articles 32 and 83 must be read with the applicable duration rules.
▼ Can a Man Marry His Former Wife’s Sister Immediately After Divorce
Not necessarily. Article 32(5) includes the waiting period even following irrevocable divorce.
▼ Can a Fifth Marriage Proceed While Another Divorce Is Pending
A pending divorce does not establish eligibility. Article 32(4) includes the revocable-divorce waiting period in its restriction.

Identify the specific impediment before choosing a marriage date. Review the governing law, documents, and chronology so the next contract satisfies the applicable requirements.
