Real estate litigation is the process of resolving property disputes through the courts and through specialized legal authorities in Dubai. It covers every type of conflict connected to property — ownership, sale, development, construction, tenancy and investment. Dubai has a specific set of laws and a specific set of courts for real estate matters. Knowing where your dispute belongs is the first and most important step.

Where Property Disputes Are Resolved in Dubai

Not all property disputes go to the same place. Landlord and tenant disputes go to the Rental Disputes Centre which operates as a specialist court for tenancy matters. Regulatory complaints concerning real estate-company violations may be submitted through the applicable DLD/RERA channels. Contract termination, compensation and other judicial remedies must be pursued before the competent judicial forum, which depends on the nature and status of the project and the dispute. Ownership, title, sale, purchase and construction disputes that fall within the jurisdiction of the Dubai Courts are filed before the competent court in accordance with the applicable jurisdiction and case-allocation rules. A commercial property dispute may be determined by arbitration or the DIFC Courts only where the applicable arbitration agreement or jurisdictional requirements establish the competence of that forum. The value of the dispute alone does not determine DIAC or DIFC Courts jurisdiction. Choosing the wrong forum wastes months. We identify the right forum immediately.

Most property disputes that go badly start the same way. Someone waits too long, files in the wrong court or loses critical evidence that would have won their case. Early legal review prevents all of this. Here is what we check the moment you contact us.

We determine the competent regulatory, judicial or arbitral forum, which may include the Dubai Courts, Rental Disputes Center, Special Tribunal for Unfinished and Cancelled Real Property Projects, an applicable arbitral tribunal or another competent authority depending on the dispute. Filing in the wrong forum can get your case dismissed and restart the clock.
We identify all available legal remedies including monetary compensation, specific performance, contract termination and injunctive relief. Many clients do not know all the remedies they are entitled to.
We preserve all critical evidence including contracts, payment receipts, DLD records, WhatsApp messages, legal notices and correspondence. Evidence that is lost or deleted before a case starts can be impossible to recover.

RERA vs Court

This is one of the questions we get asked most often. Here is an honest comparison so you can make the right decision for your situation.

The RERA Administrative Route

RERA handles off-plan property complaints through the Real Estate Violations System. There is no service fee to file a RERA complaint and initial action typically begins within 5 business days. RERA may exercise the regulatory and supervisory powers conferred on it by Dubai real estate legislation. Claims seeking judicial termination of an SPA, monetary compensation or other judicial relief must be pursued before the competent judicial forum. The process is faster for administrative remedies. However, RERA cannot order financial compensation directly in the way a court can.If a purchaser seeks a binding financial judgment, the claim must be brought before the competent judicial forum. A prior RERA complaint is not a universal prerequisite for every real estate claim.

The Dubai Property Court Route

Non-tenancy property disputes may fall within the jurisdiction of the Dubai Courts or another specialised forum depending on the nature of the dispute. Certain matters, including qualifying unfinished or cancelled project disputes, may fall within a specially established tribunal rather than the ordinary Dubai Courts. Court filing fees depend on the type, value and classification of the claim and the applicable Dubai court-fee legislation. The applicable fee should be confirmed for the particular proceedings rather than stated as a universal 3.5% fee capped at AED 40,000 for property disputes. Where expert evidence is required, the expert’s fees are determined according to the nature and scope of the assignment and the applicable court procedures. The amount varies from case to case. The duration of property litigation varies according to the nature and complexity of the claim, service of proceedings, evidence, expert appointments, procedural applications and other circumstances. A fixed period should not be presented as generally applicable. However courts can award full financial compensation, order contract termination with refunds, order specific performance and enforce judgments against assets.The Rental Disputes Center has exclusive jurisdiction over rental disputes within the scope of Decree No. 26 of 2013, subject to the statutory exclusions. The duration of proceedings depends on the circumstances and procedural stages of each case.

Which Should You Choose

For off-plan disputes where you want the developer to complete the project, RERA administrative action is often the right first step. Claims for compensation, contract termination or refund must be brought before the judicial or arbitral forum having jurisdiction over the particular dispute. In certain unfinished or cancelled project cases, jurisdiction may fall within the Special Tribunal established under Decree No. 33 of 2020 rather than the ordinary Dubai Courts. The Rental Disputes Center has exclusive jurisdiction over rental disputes falling within Article 6 of Decree No. 26 of 2013, subject to the statutory exclusions, including certain free-zone disputes, lease-finance disputes and qualifying long-term leases. For high-value commercial property disputes where the contract specifies arbitration, DIAC arbitration gives you privacy and specialist arbitrators at a higher cost. We assess your specific situation and advise on the route that gives you the best outcome in the shortest time.

Legal Framework

Real estate disputes in Dubai are governed by several key laws. The applicable rules depend on the property, the transaction, the contractual obligations and the type of dispute.

Federal Decree-Law No. 25 of 2025 on Civil Transactions governs contracts, property rights, compensation and available legal remedies for contractual breaches.
Federal Decree-Law No. 42 of 2022 on Civil Procedure governs all court proceedings including how cases are filed, how evidence is presented, how judgments are issued and how enforcement works.
Dubai Law No. 7 of 2006 governs real property registration, transfer and amendment of property rights in Dubai and establishes the Dubai Land Department as the registry authority.
Dubai Law No. 13 of 2008 as amended regulates off-plan property transactions and the Interim Property Register that tracks properties before their title deed is issued.
Dubai Law No. 8 of 2007 regulates escrow accounts for real estate development projects and protects buyers by requiring developers to hold purchase payments in escrow until construction milestones are met.
Dubai Law No. 6 of 2019 governs jointly owned properties including apartments, regulating owners associations, service charges, common areas and management of jointly owned buildings.

Additional rules apply to tenancy, construction, brokerage and mortgages. The specific contract, property records and dispute resolution clause in your agreement must all be reviewed before any legal proceedings begin.

Process

Case Assessment

We review all your documents, the contract, DLD records, the evidence and your objectives. We identify the breach, the applicable law, the correct forum and the realistic remedies. We also assess whether a pre-litigation legal notice might resolve the dispute before any formal proceedings begin. Many property disputes settle when the other side receives a formal notice from a licensed advocate.

Pre-Litigation Steps

We prepare and send legal notices. We pursue negotiation or settlement with the other party where this serves your interests. We preserve all evidence and make sure the paper trail is complete before formal proceedings begin. For RERA complaints, we prepare and file the complaint at this stage. For court cases, we use this period to prepare all filings in Arabic.

Proceedings Before the Court or Authority

We file and defend the claim before the Dubai Property Court, the Rental Disputes Centre, RERA or the appropriate arbitration body. We prepare all submissions, arrange expert evidence where needed, attend all hearings and represent you at every stage. All filings are in Arabic. We provide you with updates in your language throughout.

Judgment and Enforcement

Once the court or authority issues its decision, we apply for enforcement if the other party does not comply voluntarily. Enforcement in Dubai can include freezing bank accounts, seizing assets and for developer cases applying to the DLD for registration actions. If the judgment was wrong, we advise on the appeal options and handle the appeal within the applicable deadlines.

A property dispute goes to the Dubai Property Court when the administrative routes have not resolved it or when the remedy needed can only be granted by a court. Ownership disputes, SPA disputes, developer compensation claims above the administrative threshold and title registration issues all go to the Dubai Property Court. Rental disputes go to the Rental Disputes Centre which functions as a specialist court. DIAC arbitration is used when the contract specifically requires it.

What is the real estate litigation process in Dubai?

The process starts with a case assessment reviewing the contract, DLD records and all evidence. We then send pre-litigation legal notices and attempt negotiated resolution. If that fails, we file the case with the correct authority, attend all hearings, work with court-appointed experts where needed and represent you through to judgment. Once a judgment is obtained, we apply for enforcement if the other party does not comply voluntarily.

Which is faster for a property dispute in Dubai — RERA or court?

RERA administrative action is faster for off-plan complaints where you want the developer to act or provide a formal response. RERA complaints cost nothing to file and action starts within 5 business days. Dubai courts are slower, taking 9 to 18 months, but they can award binding financial compensation, order contract termination with full refunds and issue enforcement orders. For tenancy disputes, the Rental Disputes Centre is fastest, typically resolving cases in 30 to 60 days.

Can I file a case against a developer for a delayed property in Dubai?

Yes. You can file a RERA complaint for free and initial action begins within 5 business days. You can also file a Dubai court case for compensation for the delay, for interest on payments made, and for the option to cancel the contract and receive a full refund if the delay exceeds a certain threshold. The two routes can be pursued simultaneously. We advise on which combination gives you the best outcome.

What documents are important in a property dispute in Dubai?

The most important documents are the title deed or Oqood certificate, the Sale and Purchase Agreement or tenancy contract, payment receipts and bank statements, all written correspondence including WhatsApp messages and emails, legal notices and proof of delivery, and any inspection reports or technical evidence. All documents must be in Arabic or officially translated before they can be filed with Dubai courts or the RDC.

How is property ownership proven in a dispute in Dubai?

Property ownership in Dubai is proven through the title deed registered at the Dubai Land Department. A DLD title deed is the definitive legal record of ownership. For off-plan properties where the title deed has not yet been issued, the Oqood certificate from the Interim Register is the relevant document.
