hat Is Civil Marriage in the United Arab Emirates Under the Civil Personal Status Law?
The Civil Personal Status Law regulates civil marriage as the legal foundation for establishing the marital relationship for non-Muslims subject to its provisions. It sets out a clear framework of conditions and procedures that ensure the validity of the marriage contract, clarify the legal status of the spouses, and place the marital relationship under judicial supervision from the moment of its conclusion.
Civil marriage under this law is defined through the substantive conditions and procedural requirements prescribed for its conclusion and authentication. The law requires that both the husband and the wife have attained the age of twenty-one years, with age proven by an official document issued by the state of nationality of each party.
The law further provides that the marriage must not be between siblings, parents and children, grandchildren, uncles, or aunts, or any other cases determined by the Executive Regulations. This requirement ensures the absence of prohibited degrees of kinship that would render the civil marriage invalid.
A core requirement of civil marriage is the express declaration of consent by both spouses before the Notary Judge. The law emphasizes that such consent must be free from any legal impediment affecting its validity, confirming that explicit and genuine consent constitutes the essential pillar of the civil marriage contract.
The law also requires both spouses to sign the disclosure form, which serves as a fundamental procedural requirement aimed at ensuring transparency within the marital relationship, in addition to any other conditions specified by the Executive Regulations.
The Executive Regulations complement this framework by prescribing additional conditions for civil marriage. These include the requirement that both spouses possess full legal capacity to undertake legal acts, that the marriage be between a male and a female, that it not occur between relatives up to the third degree, and that it not take place between an adopted child and members of the foster family.
The Executive Regulations further regulate the existence of any prior or current marital relationship. They require confirmation that the wife is not in an existing marital relationship, and impose the same requirement on the husband where his personal law does not permit polygamy. In all cases, the husband must disclose any existing marital relationship before the Notary Judge.
From a procedural standpoint, the law permits the conclusion of civil marriage before the Notary Judge at the competent court through the submission of an application in accordance with the approved form. The marriage is concluded by completing the prescribed form before the Notary Judge, and the spouses may agree on contractual conditions governing their rights during the marriage and following divorce, particularly with respect to joint custody of children.
The Executive Regulations specify the documents that must accompany the marriage application, the mechanism for reviewing the application by the designated officer, its referral to the Notary Judge upon fulfillment of the requirements and payment of fees, and the scheduling of a hearing for authentication of the civil marriage contract.
Upon verifying that all legal conditions are satisfied, confirming the spouses’ express consent, and ensuring execution of the disclosure form, the Notary Judge authenticates the civil marriage contract and registers it in the designated register. The competent court then issues the civil marriage certificate in Arabic and English where required, depending on the nationality of the parties.
This regulatory framework demonstrates that civil marriage under the Civil Personal Status Law is not a mere formal procedure, but a comprehensive legal contract founded on explicit consent, disclosure, and transparency. It produces clear legal effects that are subject to judicial supervision from the moment of its conclusion.
