Is Sharing Private Photos Without Consent a Crime in the UAE?

Sharing private photos without consent in the United Arab Emirates is governed by Federal Decree-Law No. (34) of 2021 on Combatting Rumours and Cybercrimes .

Can sharing private photos without consent be unlawful?

Yes. Sharing private photos without consent may be unlawful where the conduct involves disclosure, publication, circulation or misuse of private visual material through electronic means without lawful authority or valid permission.

Does it matter if the photos were originally obtained lawfully?

Yes. Even where a person originally received or possessed private photos lawfully, later sharing, forwarding, publishing or circulating them without consent may still create legal consequences depending on the facts and surrounding circumstances.

Can forwarding images through messaging apps create liability?

Yes. Forwarding, reposting or transmitting private photos through messaging applications, social media platforms, emails or other digital channels may expose a person to legal risk where consent is absent or the conduct is otherwise unlawful.

Does it matter whether the person in the photo is identifiable?

Yes. Identifiability may be relevant where the person can be recognised directly or indirectly from the image itself, accompanying text, account details, surrounding context or other circumstances.

What if the images are shared to threaten, embarrass or pressure someone?

Sharing private images in a way intended to pressure, humiliate, threaten or harm another person may increase the seriousness of the conduct and may give rise to additional legal consequences under UAE law.

How do authorities assess these cases?

Authorities assess the origin of the material, method of sharing, existence of consent, identity of the parties, digital evidence, account activity, context of publication and surrounding circumstances to determine whether liability may arise.

Why is sharing private photos without consent legally important?

It is legally important because misuse of private visual material may violate privacy rights, expose a person to criminal investigation and lead to penalties under UAE cybercrime law.
