Successful Child Custody & Divorce Case in Dubai

Case Overview

The Background

Due to the husband’s stop to support his wife and children, along with his multiple forbidden sexual relations, the wife requested a divorce. In response, the husband threatened her, demanding the return of all gifts, cars, and the villa he had purchased for her as a condition for the divorce.
So that the wife filed for divorce in court, the husband countered by filing an adultery claim against her, alleging she was involved with another man and had confessed to him in an email. Additionally, he demanded that she repay him 20 million dirhams, claiming she had borrowed that amount and acknowledged her debt in an email to him.

The case involved several complex legal issues, including a divorce dispute, allegations of adultery, an alleged debt of AED 20 million, the use of fabricated electronic evidence, and ongoing concerns regarding the children’s welfare and child custody.
Our Legal Strategy
In this case, we obtained a divorce ruling between the spouses under Dubai’s Personal Status Law for Non-Muslims. The court also issued a decision preventing the father from taking the children abroad, in favor of the mother, due to the father’s ongoing threats that she would not see the children again.
We filed a criminal case against the husband for using his wife’s email while he was out of the country to send messages to himself. Upon his return, he was arrested, and an examination of his mobile phone by a police expert confirmed that he had used his wife’s email to send messages to himself. The criminal court issued a ruling against him. Based on this ruling, the court rejected the husband’s claim for his wife to pay him 20 million dirhams, as he was the one who fabricated the evidence.

The Result

The criminal court ruled to dismiss the adultery case filed by the husband against the wife due to insufficient evidence. The sole piece of evidence against the wife was an email in which she allegedly confessed to having an affair with another person.
The judge stated that it was illogical for the wife to admit to adultery through an email to her husband. Additionally, the judge noted that there is an ongoing criminal case regarding the husband’s unauthorized use of the wife’s email.
In the meantime, we obtained a court ruling requiring the father to pay child support, cover educational and medical expenses, and provide salaries for the maid and driver. The court also ruled to revoke the father’s custody due to his lack of trustworthiness and failure to meet the necessary conditions for child custody.
