Can a mother be the guardian of her child in Dubai?
Under the traditional Muslim personal status framework, the mother is the custodian rather than the guardian. However, the new Federal Decree-Law No. 41 of 2024 strengthened the role of both parents, and courts have discretion to assign guardianship rights in ways that serve the child’s interests.
