Our client is a real estate marketing company operating in the country. They entered into a contract with a property developer to market residential units being constructed.
Following a successful marketing campaign for the developer’s projects, our client sold six units, with buyers signing contracts and making initial payments. Consequently, our client was entitled to the agreed-upon commission of 670,000 AED as stipulated in the contract with the developer. Despite numerous amicable requests for payment, the developer ignored our client’s demands.
After seeking our assistance to recover the commission through legal channels, we filed a lawsuit against the developer to claim the outstanding amounts owed to our client, the brokerage firm. The court appointed an accounting expert to assess the financial obligations of the defendant, the property developer. The expert’s report confirmed our client’s entitlement to the commission, as we demonstrated that our client had successfully sold the six residential units.
The court ruled in favor of our client, ordering the developer to pay the due commission along with an additional 5% and requiring the developer to cover legal fees and expenses.
Following the judgment from the first instance court, we took legal action that included seizing the developer’s bank accounts. This prompted the developer to enter into a settlement agreement with our client, resulting in the full payment of the amounts owed.
