1- Failure to document the lease contract

Failure to document the lease contract leads to wasting the rights of the owner, such as his inability to claim the rental value, maintenance, or compensation for damages caused by the tenant to the property, because the failure to document the lease contract is considered a violation of Article 4/2 of the Dubai Tenancy Law, and in this case, the contract is considered void. Furthermore, In case the contract is not documented, the court rules the contract invalid, and therefore the owner is not allowed to claim any other legal rights.

2- The tenant’s desire to terminate the lease contract during its term:

According to the provisions of the Dubai Tenancy Law, the lease contract cannot be terminated during its term except by mutual agreement or in accordance with the provisions of the law.

3- Increase in annual rental value

To increase the rental value, it is necessary to send a notice to the tenant that an increase in the rental value of the property will be applied – but the condition for accepting this is that the notice must be sent at least 90 days before the end of the lease, otherwise the owner is not entitled to claim an increase in the rental value.

Also, when increasing the rental value, it is based on the percentages specified by the Land and Property Department.

4- Property Maintenance

Property maintenance during the lease period is one of the important matters. people Opinions about it are abundant and varied due to lack of knowledge of the law.

However, in Dubai’s tenancy law, the issue of maintenance is very clear and simple. The legislator in Dubai has placed the responsibility of property maintenance on the owners during the lease period.

However, the legislator in Dubai has provided flexibility in this matter by deciding that the owner and the tenant can agree for the tenant to bear a portion or all of the maintenance costs.

The legislator has not specified a maximum amount for maintenance costs that can be agreed upon to be borne by the tenant. For example, if it is agreed that maintenance costing 10,000 dirhams will be at the expense of the tenant, then the tenant is bound by that agreement, considering that the contract is the law between the parties. Therefore, we advise to agree on the responsible party for maintenance when entering into a rental contract.

5- Termination of the lease agreement and non-renewal.

The tenancy law in Dubai issued in 2007 used to give the right to the landlord or the tenant to express their desire not to renew the lease contract before 90 days of its expiration.

However, the legislator decided in a later amendment to this law to cancel this right, and limited the cases of vacating the property upon its expiration to only four cases, including re-claiming the property for personal use or for renovation or maintenance in the property, provided there is a report from the Dubai Municipality or the owner’s desire to sell the property.

The legislator has imposed a necessary condition for accepting the vacation upon the expiration of the lease contract, which is to send a notice to the tenant before 12 months from the date of evacuation.

First:  As decided by Dubai legislator in Article 19 of the tenancy law in Dubai the below obligations :

1. Paying rent on time:

– The tenant is responsible for paying the agreed-upon rent amount to the landlord on or before the due date.

2. Maintaining the property:

– The tenant is expected to keep the property clean and in good condition, and report any maintenance issues to the landlord.

Second : Furthermore, Dubai legislator stipulate in article 20 of the tenancy law in Dubai the below obligations:

1- Deposite payment :

– When signing a lease agreement, the tenant must pay a sum of money as a deposit to ensure the maintenance of the property and preserve it from damages that may result from use. However, This amount can be refunded at the end of the contract.

Third : Additionally, Dubai legislator stipulate in article 21 & 23 of the tenancy law in Dubai the below obligations:

1 –  Returning the property in the same condition:

– When the tenancy ends, the tenant should return the property in the same condition as when they first occupied it, excluding normal wear and tear.

– The tenant is not allowed, upon vacating and returning the property, to remove any permanent improvements that he has added, unless the two parties agree otherwise.

Finally, there are some conditions that the tenant must also adhere to, as follows:

– Respecting the property and neighbors: The tenant should not engage in any activities that may cause damage to the property or disturb the neighbors.

– Abiding by the terms of the lease agreement: The tenant must adhere to the terms and conditions stated in the lease agreement, such as the duration of the tenancy, restrictions on subletting, and any other agreed-upon rules.

– Giving notice before vacating: If the tenant wishes to terminate the lease agreement, they are required to give sufficient notice to the landlord as per the terms of the agreement.

– Paying utility bills: The tenant is responsible for paying the utility bills, such as electricity, water, and internet, unless otherwise stated in the lease agreement.

7. Returning the property in the same condition: When the tenancy ends, the tenant should return the property in the same condition as when they first occupied it, excluding normal wear and tear.
